(d) Zross Examination Council, staff and Mr. ..Cole discussed application and whether a Planned Development is necessary for site in question. (d) Associate Planner recommended Council uphold Planning Commission denial of , request, however, noting that if Council wished to uphold staff recommenda- tion, the following conditions be attached. 1. That applicant provide a soil analysis test by an independent company . ' to identify any problems and possible solutions to be reported to the City Engineer and Building Department for approval prior to issuance of permits. . 2. That construction and drainage plans be submitted and approved by the City Engineer and Building Departments prior to issuance of permits. PRI 3. That the site drainage system be subsurface (or other method as requested by the Building Official) to the approval of the Building Department prior to final building inspection. ' • 4. That a significant vegetation survey be submitted to the City Community Design Planner for conditions to required landscaping approval prior i to issuance of building permits. 5. That ingress/egress he provided between the subject site on the northwest corner and the HI HAT RESTAURANT with a joint use agreement signed by I both property owners prior to final building inspection. . the satisfaction of the Building 4.:. 6. No final building inspection approval will be given until a traffic light is installed and operating at the intersection of 69th and 99W highway to the approval of Oregon Department of Transportation. 9. All on site vehicle passageway shall be no less than 50 feet radius. 10. That applicant submit a bond agreement covering complete public work improvement on all portions of public right-of-way to include full. street improvement (to collector street commercial standards) on 6cith extension to subject projects prior to issuance of any city permits. (e) Public Hearing Closed ' A . ':. (f) Consideration by Council fi. Cou cil and staff discussed further the conditions which had been recommended. Associate Planner recommended amending conditions #5 & #6 as follows: 5. Should an ingress/egress be provided between the, subject site and the Hi Hat Restaurant, a joint use agreement must be signed by both a property owners prior to final building inspection. 6. Lighting shall be provided on site to the satisfaction of the Building Department especially in regards to the vehicle access between the Hi Hat Restaurant and the subject site, if such an access as indicated in Condition #5 exists. (g) Motion by Councilman Mickelson, seconded by Councilman Cook to remand the application back to Planning Commission as a Planned Development with the 10 conditions, as amended, which staff presented. Motion by Councilman Scheckla to amend conditions by adding condition #11 • which would state "That no restaurant facilities be permitted on the site." Councilwoman Stimler seconded. Motiou to amend by adding condition #11 was denied by a 4-1 vote, Councilman Scheckla voting Aye. We feel very strongly that the variance would be better for the �� . � development and better for the City of Tigard. Even though the costs would not be bourne by us, we also feel responsible to try to assist the Tigard • - Dater District • from spending money unnecessarily and also to try to prevent the need to move the power poles unnecessarily. The reasons for our appeal are as follows: 1) Eliminate the need for Tigard Water District to move fire hydrants and water meters. This is costly and would not be productive labor for sanitary or aesthetic reasons. 2) Eliminate the need to move power poles . This would be costly and serve no real purpose. 3) Although the City would allow meandering around the existing oak trees, in this instance it would still endanger the oak trees because roots would have to be cut to allow for the meander. Also the sidewalk would then be taking up a considerable part of the front yards Of the dwellings. n r. •d. There are a great many trees on the exterior edges of their properties and if all were meandered around, the result would not be a very orderly looking development. Most of them have also expressed a preference for the convenience of being able to step from their car directly on to the sidewalk, instead of into bushes, or mud. 5) All too often, the growing areas between a sidewalk and a curb are a problem to maintain and no3ne maintains them. ' Two and one- half feet is too narrow for grass, too narrow for shrubs: and, is very ' often full of unsightly weeds. Since it is a part of the right-of-way, and. not an integral part of the homeowner 9 s lawn, the homeowner does not take responsibility. 6) The 2i1 would become a part of the homeowner ti s front lawn and he would easily maintain it along with his regular front yard. 7 ) Lot 7 has an existing house which has been there many years. ::e They have a Great deal of nice planting of hedges and shrubs that make their yard beautiful and give them some privacy. The sidewalk ordinance, as it stands, would require removal of these shrubs an open up the front yard to the street. With the variance approved, their front yard would retrain intact and the owner of the property prefers to have the sidewalk next to the curb. :. 8) In our study of Tigard, we have noticed that a great many sidewalks are directly next to the curb. We are also aware that new subdivisions are also being app±over. ,with. sidewalks next to the curb, and it appears that Tigard regards this as an acceptable alternate to their ordinance which requires the 2z' planted ship 9) The City engineer ,approves the granting of our variance. $: 10) The Staffrof the C1 '.,y of Tigard Planning Commission recommended granting our variance. . Stated that it was possible to close the street and place a hard surface under the landscape area to provide for an emergency access. o Smith disagreed with staff on the removal of islands . ' o Brian was concerned with Smith' s reply on: islands and accessibility for emergency vehicles. Thought it was a r. good development.. Agreed with the deletion of #7. The City has approved this type of variance on local streets in 'the past. It is in practice treated as an optional way to construct sidewalks and curbs on local streets. ll. The applicant also wishes that the sidewalk also be meandered to save existing trees. II. Conclusionary Findings: 1. Exceptional circumstances exist due to the location of trees whereby the normal ,sidewalk standard would cause their destruction which would be a hardship. 2. The granting of the variance would not be detrimental to the purpose of the subdivision ordinance. ;, 3. The variance is the minimum variance from the provisions of the ordinance. It is not detrimental to the public's health, safety and welfare. It doe s• not injure the rights of other nearby property owners property. III. Planning Commission: This letter is to ac ,ompany variance requested on Tangela Sub- division, so that we can place the sidewalk next to the curb, without an earth, planted area between curb and sidewalk. The reasons for this are listed: 1) Eliminate the need for Tigard City Water Department to move fire hydrants and water meters. This is costly and would not be productive labor for sanitary or aesthetic reasons. 2) Two beautiful large oak trees would be left standing. The old oak trees are an important part of the character of the neighborhood and would more than offset the loss of a few feet of grass that might be placed in a narrow strip. They provide shade and beauty for Tangela and the entire neighborhood. We also know from previous work with Tigard that Tigard va:_ues existing trees and has helped us save trees in the past, on other projects. 3) Eliminate the need to move power poles. This would be costly to do and would serve no real purpose. /4-) All too often, the growing areas between sidewalk and curb are a problem to maintain and noone maintains them. The home- owner does not take responsibility, and the City doe o little, if anything - certainly not to mow and weed them regularly. 5) It would eliminate the need for the City to maintain them, or to send nuisance notices to property owners to do so.
