'.;r APPLICATION: Request by John Barnes and J. and B. Construction for a Variance
to allow a 10-foot rear yard setback in place of the 15-foot requirement on
property zoneu R-4.5 (Residential, 4.5 units/acre) and located on S.W. Janzen
Court (Lot 6, McDonald Acres), Tigard (Wash. Co. Tax Map 2S1 11BA, Tax Lot
3100).
DECISION: Notice is hereby given that the Planning Director for the City of
• Tigard has APPROVED the above described application subject to certain
conditions. The findings and conclusions on which the Director based his
decision are as noted below.
A. FINDING OF FACT
1. Background
The property is within McDonald Acres subdivision which was
approved in 1982..
2. Vicinity Information
The subdivision is in the process of being developed and the
surrounding properties consist of vacant and developed lots. A
large, undeveloped parcel which is not part of the subdivision
lies to the south along the rear lot line of subject property.
Th.a subdivision is zoned R-4.5 and the land to the south is zoned.
R-3.5 (Residential, 3.5 units/acre).
3. Site Information and Proposal Description
The subject property is an undeveloped lot located on the, south
side of Janzen Court. A 1,230 square foot, one story residence is
proposed. The applicant indicates that the variance to allow a
10-foot rear yard setback is necessary for the following reasons.
{
a. The front portion of the lot has an abrupt slope which
limits the amount of developable area.
b. The lot is shallow with a depth of approximately 58 to 75
feet.
c. A two-story house will be more costly to obtain an
equivalent amount of usable area and because of the terrain
a two-story structure would not be aesthetically pleasing.
d. The variance would allow most of the house to be built on
the level portion of the lot.

4. Agency and NPO Comments
The Engineering Division and Building Inspection Office have no
objection to the proposal.
NPO #6 has no objection but notes that if opposition is raised,
the matter can be discussed at the August 15, 1984 meeting,
The Tualatin Rural Fire Protection District has not submitted any
comment.
B. ANALYSIS AND CONCLUSION
Section 18.134.050 of the Code requires the following approval criteria
for variance proposals:
1. The proposed variance will not be materially detrimental to the
purposes of this Code, be in conflict with r the policies of the
Comprehensive Plan, to an y other applicable
policies and
standards; and to other properties in the same zoning district or
vicinity;

2. There are special circumstaL es that exist which are peculiar to
the lot size or shape, topography or other circumstances over
which the applicant has no control, and which are not applicable
to other properties in the same zoning district;
3. The use proposed will be the same as permitted under this Code and
City standards will be maintained to the greatest extent that is
reasonably possible, while permitting some economic use of the
land;
4. Existing physical and natural systems, such as but not limited to
traffic, drainage, dramatic land forms or parks will not be
adversely affected any more than would occur if the development
were located as specified in the Code; and
5. The hardship is not self-imposed and the variance requested is the
minimum variance which would alleviate the hardship.
The primary purpose of the setback standards for the R-4.5 zone is to
allow for adequate spacing, air, light, and privacy for residential
structures. The variance will not have an appreciable effect upon the
existing residences in the area. Also, the undeveloped land to the
south is higher in elevation than the subject property and the one story
residence should not impose upon future residences on the southern
parcel.
The lot is exceptionally shallow with a minimum depth of approximately
58 feet. The slope in the front of the lot, particularly toward the
east side, places a further limitation upon the property. The applicant
is proposing a house depth of approximately 25 feet and front yard of 23
feet (20 feet required) and a 10-foot rear yard.

The residence is a permitted use in the zone and all other aspects of
the building will conform with the Code. The variance will have no
effect upon existing physical and natural systems.
Finally, the variance request appears to be the minimum necessary to
locate a house of reasonable size on the property. The applicant has
designed the house to fit the lot as much as possible, however, the •
additional 5 feet are necessary to allow for a workable floor plan.
C. DECISION
The Planning Director approves V 10-84 subject to the following ~
conditions:
1. The house shall maintain a minimum setback of 10 feet from the
southern property line. •
2. the appropriate permits shall be obtained from the City Building
Inspector.
3. This approval is valid if exercised within one year of the final
decision date noted below.
D. PROCEDURE

with Section 18.32.290(A) and Section 18.32.370 of the Community
Development Code which provides that a written appeal may be filed
within 10 days after notice is given and sent.
