I . BASIC FACTS :
1 . The site is zoned• C-3M -(Main -Street -Commercial) and designated
t commercial--retail on Neighborhood Plan I .
2. 18 .60 .050 of the Tigard Municipal Code states "change in use
of an existing structure within any zone in city; off street
parking spaces shall be as provided in this chapter . " `
3 . 18 .60.120(4a) stated that retail establishments shall have
one space for each 400 sq. ft . of gross floor area, but not
less than four spaces for each establishment .
s41► II . FINDINGS
1 . The applicant is requesting a variance to the Tigard Municipal
Code parking requirements in order to establish-a children' s
clothing store in an existing house .
2. According to the Tigard Municipal Code this business would
need four off-street parking spaces . .::
3. The site in question presently has two structures, a garage
• r which has been used for 10 years as a non-conforming use
(car detail shop) and a house proposed to be used as a
children 's clothing store . Because of limited area, 3, 900
sq ft ., and a large tree which should be retained, on site
parking is not feasible.
• 4 . Problems that have arisen while reviewing this application
have revolved around the site 's non-conforming use. First ,
is the safety aspect, is a car detail shop compatible with
','� a children ' s shop? Second, this non-conforming use generates
r�°h parking of its own, plus the need for a curb cut for access

s's to the garage. This curb cut is 20 ' wide with 17 ' yellow
striping. If the curb cut were closed, three on street
parking spaces would be gained, providing a total of six on
street parking spaces in front of the site.

5 . In August of 1975 the Tigard Planning Commission approved
a parking variance for the site immediately to the north, #
Doug' s Auto Parts . Staff observations have been that this '.:-.
.,Y variance plus several others granted along Main Street have
created a parking shortage ..
III . CONCLOSIONARY FINDINGS
1 . If the applicant wishes to utilize the existing house it -_,
is impertative that more parking be created. Since off
fr: street parking is unfeasible, on street parking must be
created.
2. The large tree on the site is unique and of great value to
the community. The need to save this` tree ha+§-been put
forth by staff and the applicant as a justification for
a variance . Therefore if a variance is granted the tree
should not be removed without Design Review Board approval . fi
; IV. STAFF RECOMMENDATIONS: ':

Staff recommends approval with the following conditions: -
1 . That the existing curb cut be closed off and

on the request Lind that it did not comply with NPO
III policy .
o Shirley Nester, adjoining property owner, stated
:_. that a used car lot would devalue her property plus
cause drainage and traffic problems.
o Cooper, applicant, stated that any sewage would be
self-contained, that other sites had been studied
before selecting this site .
o Staff informed the Commission that NPO III had re--
ceived meeting agendas

Wood moved and Moore seconded to table until NPO III

The motion was approved in a 4 to 2 roll call vote with

APPLICANTS: The Gingerbread Cottage (A childrens clothing store)
Owners: l arilyn Perry, Jeanne Raikoglo and Ann ploy
The applicants wish to request an exception to the Parking Code We
have chosen the partidular site as one that is ideally suited to a small
business venture. a non-polluting and necessary community business. We
would be utilizing a site that because of its unique and limited features
makes it suitable for a small, colorful: and quaint establishment. An
establishment that would be unlikely to expand or in anyway change the basic
building and lot.
We have tried to think of the many ways to conform to the existing
parking code requirements. Unfortunately, the site provides us with some
exceptional and extraordinary conditions that .make it impossible to comply.
:.r The lot is too small for most business ventures, and a small retail
establishment such as we are proposing would not require much more parking
than that already available on the street. Few ventures could accomplish
that.
Directly behind the building is the state owned Highway 99 right-of-ways
Adjacent to the building, on each side, exists already established businesses.
The front of the lot possesses a very attractive yard, walk and a glorious
fifty year old elm tree which lends itself well to the character of our
proposed business. This old tree is so ecologically beneficial to the city >:
street in general that we would be unwilling to saw down the tree and pave
the yard for parking.
We have attempted to obtain off street parking privileges from sur
rounding businesses. Those businesses on our street have none available.
Across the street the U.S. Nat!). Bank and several smaller businesses have
parking lot; , all of which are saturated with their own needs and would be
unavailable for subleasing. We have not contacted the only other sur-
rounding parking lot, that of the U.S. Postal Department fi..,.• for reasons
that are abvious to most of us,
since we are unable to financially,and unwilling to as business
philosophy, purchase adjacent business property to tear down and build a
Parking lot, we have no other alternative. Providing a paved area in front
of the building would add to the parking problems, not solve them, in that
the three on-street parking spaces would thereby be lost.
We trust that you will give serious consideration to our proposal and
pass affirmatively on our request for a parking variance.
