The City Parks and Recreation board reviewed the segment of the plan which affects the A Boy property and it was the consensus of the group that it was imperative to maintain the concept of pedestrian access and visibility from hail Street, The Board also indicated that the plan is somewhat 'flexible and alternative designs can be pursued with the property owner, Finally, the Board stated that if necessary, land area for the park which lien above the • 100 year flood plain could be purchased by the City, I also recommend early initiation of preliminary discussions with the City in order to prevent the resolution of this open space issue from delaying your development plans. Reference Number: 071-0YA-4-005g08 The applicant has received approval from the City of Tigard to remove 2, 607 cubic yards of material to develop additional parking as outlined in the original application. In order to develop a more suitable mitigation plan, the applicant met with the OREGON DEPARTMENT OF FISH AND WILD • LIFE to develop the alternative excavation plan which will develop two sumps,. The two sumps created will be at least 30 feet by 60 feet in size with an island in the center and an irregular shoreline. The island shall be 15 feet by 30 feet and the surface two • feet above the spring water level . The sumps shall be at least 3 feet in depth in the deepest area and grade to the margin with and average depth of 2 feet . Disturbed areas adjacent to the sumps shall be planted with selected plant material suggested by the OREGON DEPARTMENT OF FISH AND WILDLIFE. (See attachment) Construction of the sumps will be done in coordination with the ODFW and the City of Tigard. The specific proposal is covered under Section 18;84.0156(1), "A land form alteration or development within the 100-year floodplain". The project, which is commonly referred to as "Stevens Marine", will require an alteration to the topography of Fanno Creek's floodplain. The present design will extend the boat storage facility into the 100-year floodplain, but will terminate before reaching the zero foot floodway boundary. The earth fill required for this extension will be approximately 2607 COY. and will be obtained from a cut within the zero foot floodway (subject to the soils engineer's recommendations). This cut will :\ offset any flood storage displacement caused by the fill. Furthermore, there will be space available for a pedestrian/bicycle pathway in accordance with the adopted 14 pedestrian/bicycle pathway plan, and sensitive land ordinance provisions. The "approved standards of Section 18.84.040 (A) are addressed as follows: • 1. The expansion of the boat storage facility will both preserve and enhance the flood storage function. Not only Will the fill Within the 100-year floodplain be balance by excavation (confirmed by attached calculations), the location of the excavation will enhance floodway hydraulics by providing greater flow during high flood flows. Furthermore, since the fill does not encroach upon the floodway boundary, the zero foot rise floodway is maintained. 2. The site is designated "commercial" by the Comprehensive Plan, and is zoned "CBD". 3. The land form alteration will have no adverse effect upon the zero foot floodway. The fill will be outside of the floodway boundary, while the cut will come from within the floodway. Public Improvement Review shall be applicable to all new developments and remodeling of existing developments. B. All provisions and regulations of the Municipal Code shall apply unless modified by other sections of said Code (e.g. Planned Development, Chapter 18.50.; Variance, Chapter 18.134; Unusual Conditions, Section 15.04.120; Sanitary Sewerage Regulation, Chapter 12..05). C. The application and approval process is a three-step procedure which involves: 1. A Prea• .lication Preliminary Public Improvement Construction. Plan Review. (Prior to formal submittal of public improvement construction plans). ..the Applicant must submit one copy of the proposed public improvement construction plan, said plan having been prepared and signed by a Registered Civil. Engineer, to the City's engineering office to facilitate preliminary review. Upon conclusion of said review, City staff will contact the Applicant and the Applicant's Engineer to discuss any obvious deficiencies and, also, formal submittal requirements applicable thereto. ■ 2. Formal Public Improvement ,cons,truction plan Submittal, • Circulation and .Final Review . Should the plan be deemed by City staff to be approvable,,, the Applicant and the Applicant's Engineer shall then be notified thereof. Notice of City readiness to issue an approvable plan does not mean that construction can commence nor does it mean that building permits • can be secured; public improvement construction documentation must first be completed (prior to the actual issuance of the approved public improvement construction plan). 3. Public Improvement Construction Documentation .
