Phillips to facilitate installation of a sanitary sewer line to specified standards and specifications; and WHEREAS, said Compliance Agreement stipulated that: "At such time as all public improvements have been completed in accordance with the City's requirements, Petitioner shall notify the City of readiness for final inspection and upon certification by the Department of Community Development that all requirements of the City have been met, the Council agrees to accept said improvemerts, for operation and maintenance responsibility, and release the Petitioner's guarantee bond"; and • NOW, THEREFORE, OE IT RESOLVED by the Tigard City Council that The Tigard City Council hereby accepts the public improvements known as Phillips Sanitary Sewer Extension; AND, FURTHER, the City Council hereby authorizes release of the Petitioners guarantee bond, PASSED! That construction of the proposed sanitary sewerage improvement Shall not commence until posting of a 100% performande bond, payment of publio improvement plan check and inspection fees and execution of (and city acCeptance of) a construction compliance agreement occurs. That erosion controls be applied throughout the course of construction and, further, that a temporary (before and during construction) and permanent (after construction) erosion control plan be submitted to and approved by the City Engineer, prior to commencing improvement work. 4. " An existing 10 foot wide gravel driveway serves the two proposed parcels. The applicant wishes to retain this driveway rather than install a paved, 20 foot wide improvement required by the Code (18.108,070). The applicant has submitted a number of exhibits which describe the request. 5, Agency and NPO Comments ' The Engineering Division has 110 objection to either proposal, provided the recommended conditions of approval are met. The Building Inspection Office questions the property owners ability to properly maintain the driveway. The Tualatin Rural Fire Protection District has no objection to the proposal, B, ANALYSIS AND CONCLUSIONS The proposed sewer line and service laterals to the two homesites will be within the 100 year flood plain or the ravine which is identified as a significant wetlands area. Development in the flood plain area below 128 feet is subject to the following requirements contained in Section 10,84.040 of the Code. The hearings officer shall make findings that ail of the following criteria are satisfied when approving, approving with conditions or denying an application request within the 100 year flood plaint (1) Land form alterations shall preserve or enhance the flood plain storage function and maintenance of the zero-foot rise floodway shall not result in any narrowing of the floodway boundary; (2) The land form alteration or development within the 100 year Flood plain shall be allowed only in an area designated as commercial or industrial on the comprehensive plan land use map; (8) The land form alteration or development is not located within the floodway; (4) The land form alteration or development will not result In any increase in the elevation of the zero—foot rise floodway; (5) The land form alteration or development plan includes a podestrian/bicycle pathway in accordance with the adopted pedestt-ian/bicyole pathway plan; (6) The plans for the podesteianibioycle pathway indicate that no pathway will be below the elevation of an average annual flood, Development ih the ravine area between 120 and 140 feet is subject to the following standards in Section 18,84,045 of the trade; EXception for Development in the 100th/110th Ravine 8ignificant Wetlands STArtr ROOT SL 2-85 & V 8-85 — PAGE 2 • (a) Under the Sensitive Lands Permit process, the Hearings Officer •may allow portions of the Ravine mt 108th and 113th designated as a significant wetlands area to develop provided that all of the following criteria are met. (1) Al]. of the land (within the ravine) being considered For development is at less than 25% slope. (2) There are no unstable soil conditions on the land being considered For development. (3) The provisions of chapter 18.150- TREE REMOVAL shall be met, In order to approve a variance request, the following criteria in Section 18.134.050 of the Code must be met: The director shall approve, approve with conditions or deny ao application For a variance based on Finding that the following criteria are satisfied; (1) The proposed variance will not be materially detrimental to the purposes of this code, be ih conflict with the policies of the comprehensive plan, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity; (2) There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; (a) The use proposed will be the same as permitted under this code and city standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land; (4) Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land Forms or parks will not be adversely affected any more than would occur if the development were located as specified in the Code; and (5) The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship, The applicant has thoroughly addressed the above criteria in the • attnhod exhibits, The inrormation and statements made by the applicant have been reviewed and the staff concurs with the analysis as presented, The applicant's proposal is consistent with city requirements provided the conditions below are meet 0, RECOMMENDATTON The Planning staff recommends approval of L 2-05 subject to the Following conditions; 8TArF PEPOT • 81... 2-05 & V 3-85 - PACE 8 k, 1 That construction of the proposed sanitary sewerage improvement shall not commence until positing of a 100% performance bond, payment of public improvement plan check and inspection fees and execution of (and City acceptance oF) a construction compliant agreement occurs, 2. As a result of our + ' . discussion, I have the following information for you. 1. A Sensitive Lands Permits is required to construct the proposed sewer line within the 100 year flood plain. The relevant criteria are contained within Section 18.84.040 of the Code. 2. For the ravine area above the 100 year flood plain, the recently adopted Section 18.84.045 supersedes, all other standards for sensitive lands or wetlands. As a 'result, variance to the 25 foot setback requirement from the 140 foot elevation is not required and item 3. of r ! my letter to Mr. Phillips dated February 1, 1985, should be disregarded. 3. The Code requires that driveways be paved to 20 feet in width when serving two residences. A variance will be necessary if the existing gravel driveway is to be maintained. The prospective purchasers of the two parcels have been informed of this requirement and have been advised regarding the criteria which must be addressed before the City • may grant a variance. ' 4. I have enclosed all of the relevant information including the following: -- Section 18.84.040 and 18.84.045 of the Community Development Code Chapter 18.150 of the Code Variance approval criteria in Section 18.134.050 of the Code Sensitive Lands Application 5.
