The above-entitled matter came before the Hearings Officer at the regularly scheduled meeting of February 28 , 1985 , at the Durham WaSte Treatment Plant, in Tigard, Oregon; and The applicant requests a sensitive lands permit to allow the placement of approximately 76 cubic yards of fill within the 100 year flood plain of Fanno Creek on property zoned CBD (Central Business DistriCt) and located at 13055 SW Hall Boulevard, property more specifically described as Map 2S1 2DA Tax Lot 400, City of Tigard, County of Washington, State of Oregon; and The Hearings Officer co9ducted a public hearing on FebrUary 28 , 1985, at which time testimony, evidence and the Planning Department Staff Report Were received; and . FACTS 1. General Information CASE Sensitive Lands Application SL 1-85. REQUEST: To allow the placement of approximately 76 cubic yards of fill within the 100 year flood plain of Fanno Creek on property zoned CBD (Central Business District) and located at 13055 SW Hall Blvd. (Wash. Co. Tax Map 2S1 2DA lot 400). { APPLICANT: City of Tigard OWNER: Same PO Box 23397 Tigard, Oregon 97223 2. Background , • The City recently gained approval for a partitioning and Site s` Development Review of the subject property (IMP 9-84 and SDR 29-84). As a condition of the approval for SDR 2984, a Sensitive Lands application was required because the proposed site plan Will necessitate. Y'. some fill within the Fanno Creek flood plain. • 3. Vicinity Information The property is located on the west side of Hall Blvd. and south of Fanno Creek All the adjacent properties west of the street are also 1 • zoned CBD and are partially developed. The land east of Hall Blvd. is zoned I-L (Light Industrial). 4. Site Information and Proposal Description The property is y vacant .� . .,. 100 year flood curreritl vacant and the Fanno Creek plain includes the extreme southern portion of the parcel. The City proposes to construct a civic center that will include a police , y portion Of office, city administrative offices) and a library. Agency and NPO Comments j. . The City Engineer has reviewed the application and has indicated that ' the proposal meets the criteria for land form alteration within the 100 ' year flood plain. A memo from the City Engineer is attached. No other comments have been received. B. ANALYSIS AND CONCLUSIONS Section 18.84.040 of the Code states that the following criteria must be satisfied before Sensitive Lands application may be approved: . „ 1. Land form alterations shall preserve or enhance the flood plain storage function and maintenance of the zero-foot rise floodway shall not result in any narrowing of the floodway boundary; { .. , �, 2. The land form alteration or development within the ones-hundred year flood plain shall be allowed only in an area designated as commercial or industrial on the comprehensive plan land use map; 3. The land form alteration or development is not located within the i' ,., floodway; 4. The land form alteration or development will not result in any increase in the elevation of the zero-foot rise floodway; 5. The land form alteration or development plan includes a ' pedestrian/bicycle pathway in accordance with the adopted pedestrian/bicycle pathway plan; 1 6. The plans for the pedestrian/bicycle pathway indicates that no pathway will be below the elevation of an average annual flood. ' These criteria can be addressed in the following niantiier: } j 1.
