PINAL 00E0 No 84—_ALP0 — Page 1 • 4 The applicant proposed a third freestanding sign in the southwest corner of the property which is 16 feet in height with each face being approximately 37 square feet in size, The applicant contends that the sign is necessary to obtain adequate visibility on Pacific Highway. The sign is also intended to encourage motorists to use the southwestern entrance to the shopping center, 5, Agency and NPOpommenis The Engineering Division has no objection to the proposal, The Building Inspection Office has not submitted comments, NPO #4 did not meet formally to review the request, but the chairperson did discuss the application with the members that could be reached by phone, The group expressed concern regarding the request and it was generally felt that the sigh was not appropriate, B. FINDINGS AND CONCLUSIONS The re pp levant approval criteria in this case are Statewide Planning Goals 1 and 2, and Section 18: 114,145 of the Community Development Code,. 4 . The Planning Commission concludes that the applicable Statewide Planning Goals have been satisfied based upon the following findings; • 1 Goal 1 is met because the City has adopted a Citizens Involvement program including review of all development applications by a Neighborhood Planning Organization (NPO) , In adliti.on, all public notice requirements were met, 2. Goal 2 is met because th city applied all applicable Statewide Planning Coals, City Comprehensive Plan policies, and Development Code requirements to the application, The Planning Commission concludes that the relevant Community Development Code requirements have not been met based upon the findings below In order to justify an exception to the sigh code, one of the following three criteria (CDC 184114,145) must be satisfied a, The proposed sign exception is necessary because a conforming building or sign on an adjacent property would '..' limit the view of a sign erected on the site in conformance with the sign ode standards, b, The proposed exception to the height limits in the sigh code is necessary to make the sign visible from the street because o... . . f the topography of the site c, There is an access drive which services the business Or s+ rvlce from a street other than the, street on which the business is located, FINAL ORDER NO, 04,-4_16_0C ' Page 2 jj ° ........l..,..„...i..................u...-..ux J.«...rr-um_:........r.r.—u........tee..—...»r...`-........ -..... 2. None of the above criteria are directly related to the situation at hand. The first two criteria (a, and b.) are applicable only when an exception to sign height or size is proposed. The third criteria (c,) applies when an additional sign is requested due to access to more than one street, 3. The exception criteria allow for a second sign if a business has • access from more than one street. The Plaid. Pantry has frontage • on Pacific Highway and secondary access through the center to 78th Avenue is available. The store will have a wall sign and a section on the Crossroads Shopping Center sign which are oriented towards Pacific Highway, not 78th Avenue. This sign will also be intended for Pacific Highway traffic, 1 4, The exception for the shopping center sign (SCE 3-84) W s proposed and approved basil upon the rationale that supplemental sign area :. was necessary to Jequately advertise the individual tenants, 1 .f 5, This proposal will establish a third free standing sign for the center and a third sign for Plaid Pantry that is oriented toward Pacific Highway. The request is not consistent with the exception 1 approval criteria because all signs are on one street frontage, It does not appear to be consistent with one purpose of the Code which is to limit the number of signs in the City, Finally, this proposal could set a precedent for other tenants to request additional free standing signs, C, DECISION A based upon the above findings and conclusions, the Planning Commission denies SCE 5-84, PASSED: This 7 day of 2-A4e4+4444-A... .. , 1984, by the Planning Commission of the City of Tigard, •i A, Donald Moen, President Tigard Planning Commission (K8(..::bs/0813P) FINAL Ot bER NC, 84 PC Page 3 PUBLIC HEARING CLOSED o Discussion followed regarding the size of the sign, the height, and distance for visibility. o Commissioners Leverett, Fyre, and Butler supported Staff's recommendation. o Commissioners Peterson, Bergmann, and Vanderwood supported a second free standing sign with the removal of the Motel sign. o Commissioners Moen aryl Owens felt some type of compromise could be worked out, but were not pleased with what is being proposed, * Commissioner Owens moved and Commissioner Butler seconded to approve a 48 foot 216 squ th are feet per side with the conditions that the . existing free standing sign be removed and that the approved- sign will be removed when a freeway logo sign becomes available and is in place.
