held at the Tigard Civic Center -- Town Hall Room — 13125 SW Hall Blvd.

Senior Planner Liden reviewed the proposal and made staff' s recommendation
for approval with four conditions. Discussion followed regarding the
criteria, number of signs, location of the signs, and the size of the
sighs,

REBUTTAL
o Robert Thompson, Architect, noted that the building was taller than the
sign. He explained that they had taken a 50% reduction in signage because
access for Scholls Ferry Road was denied by the State Highway Department,
a Discussion followed regarding the types of businesses going into the
development.

o Commissioner Vanderwood favored the proposal but was concerned about the
size,
o Consensus of the rest of the Commission was that an additional sign was
not necessary because of good visibility for the site and the fact that
Burger King is easily recognized,

6- 86 based on the finding that the sign did not meet the criteria for a

Senior Planner Liden explained that Engineering had made several changes
to the conditions. A memo dated June 3rd, with new conditions was
distributed. He explained that the City has a proposal to take over
jurisdiction of the majority of County roads within the City on July 1st,
which would enable the City to form an LID for 135th and a portion of
Murray Blvd. Also, the maintenance overlay for 135th has been delayed,
He made staff's recommendation for approval with 13 conditions,
APPLICANT'S PRESENTATION
o Dick Bancroft, Hillsboro, Project Engineer, supported staff's
recommendation and was available to answer any questions, Discussion
followed regarding street alignments and access at the end of Crist Court
(easement to commercial area) .
a Russell Krueger, 3515 SW Barbur Blvd. , Portland, 97201, requested
approval. He felt the proposal for Crist Court was the best way to
provide access to the Commercial site, leaving options open, Discussion
followed regarding Phase TV and the design of the subdivision.
PUBLIC TESTIMONY
o Roger Naar, 11766 SW Swendon Loop, Tigard, opposed the proposal, His home
is opposite lot 132 and he opposed having any more trees cut down than had
already been removed. Discussion followed regarding tree cutting
procedures. He was also concern about the stream and what would happen
, : with the water, Also, the grading was 4 to 5 feet higher and wanted to

o Marilyn Rider, 11768 SW Swendon Loop, Tigard, lives opposite of proposed
lot 133, She was concerned about the number of trees which had already
been removed without authorization, Also, presently her drain goes from
under her house into the woods, She asked who would be responsible for
this drainage once the property developed, }:

o Dick bancroft, explained that the grading and drainage would be subject to
City Engineers approval and would not create any additional problems. He
stated the City was aware of the problem with builders who let water drain
onto other peoples property and some kind of solution would be necessary,
o Russ Krueger, stated that the City had been getting in the Winter
,�. Lake Development regarding flooding across adjoining properties and they
are working with the City to resolve the issue, He explained how he had
hired a wood cutter to remove s. me of the trees and had assumed he had
gotten the proper permit until City staff had called him to put a stop to
the cutting. He stated that the north south line of trees had been left,
o Discussion followed regarding the tree cutting, access to the Commercial
site and setback requirements.

the LID assessments and the use of a performance bond:

11-86 with conditions submitted by staff with their June 3rd memo,
modifying condition number 3, by adding "provisions for storm drainage
from Cotswaid I and II to this development shall be made by the
developer." Modify Condition number 10 to read as follows: "10. A 15
foot wide public utility easement running east-west shall be required in
the vicinity of lot 84 to accommodate the necessary sanitary and storm
sewer facilities serving the parcel to the east. The final location shall ,
, be approved by the City Engineer." Add the following to condition number
11, "Lot lines shall be located prior to a field inspection by the
planning staff to mark the trees over 6 inches in diameter that may be
removed, Add condition number 12. "Crest Court shall be reduced in
length so that it does not abut the commercial property to the west. A 10
foot wide walkway easement shall be provided between the cul-de-sac and
the property to the west." Add condition number 13, "The minimum setback
for any side yards abutting the commercial area to the west shall be 10
feet (Community Development Code 18,100,130) , Change existing condition
number 12 to 14 and existing condition number 13 to 15, Also, for staff
to prepare the final order and for President Moen to sign off on that

pursuing plans to modify access to the property and consider

The purpose of this letter is to request a temporary '
relocation of the existing Wayside Inn sign to the location.

�,. As you are aware , over the past several years Mr .
Way Lee ; owner of the Wayside Motor Inn has been working
to improve the access to the Inn from the Pacific
Highway: Currently, the Inn , a one-hundred and
seventeen unit full service facility is the only
business facing the Pacific Highway between I-5 and Hwy
217 which does not enjoy direct east and west automobile
access ,
The Wayside Inn is situated in an ideal location to
serve business and other travelers to the Tualatin
Valley and the Sunset Corridor , As of 1983 , the average
traffic count on the segment of Pacific Highway between
1-5 and Hwy 217 was counted at 38 , 000 vehicles per day
with a p . m . peak rate of 1 , 600 vehicles per hour ,
Highway department experts concede that these figures
are probably up from the last count and that the ' 83
figures represent maximum design capacity .
While these figures should represent good news for
a traffic intensive business as the Wayside Inn , the
reality for Mr , Lee is that the current configuration
for entrance to his business prevents two events from
occuring :

for the site , which we feel Would be significant a
addition to the City and to solicit your advocacy for
the changes that we feel are necessary for realizing the '
. present potential of the motel and the future potential `r

subject to improved access , Mr . Lee is currently
exploring the feasibility for the construction of an
additional 10 , 000 square feet of meeting 4nd conference
room space for the Inn.
Although a separate project ; the completion of the fj
69th Ave , LID will allow for the continued development
of a 70 , 000sq , ft . office and retail project adjacent to
the hotel .
Though the 69th Ave . project will have a
significant impact on the area . We feel that dual access
is critical for both the motel and the overall
development concept . It will provide the opportunity to
j direct out-going traffic ih several directions and it
will provide the factor that is so critical to the
success of this type of development ; easy access and
exit :
While we realize that the Pacific Highway is under
the ,jurisdiction of the State of Oregon . It is
F important that we gain the support and advocacy of the
City of Tigard so that these:' activities can move forward

in an orderly manner . The State has been very

o Discussion followed regarding the need for the height of the sign to
be 30 f t.
o Commissioner Owens questioned if the picture showing the new sign had
been done to scale. The applicant stated that it was.
o Commissioner Edin questioned the ownership of the vacant land between
the highway and the Motel. Mr Lee stated that the land was owned by
the state and added to his visual problem. Further discussion
followed.
o Director of Planning and Development stated that staff would have no
problem with a 22 to 30 ft. sign as long as the need is met with the
minimum height necessary. Further discussion regarding height. •
o President Tepedtno was concerned because the Commission had denied a
similar request for a Shell Service Station on Greenburg Road and
217. Discussion followed as to how that request was different.
o Commissioner Butler asked the applicant if they had done precise
measurements to assure that 30 ft. was the minimum they required.
Bob Fulton, sign representative, stated they had used a fiberglass
pole and tape measure to determine that they needed the 30 feet.
o Further discussion followed regarding the size and height of the sign.

{ o Commissioner Edin expressed his concern for approval. He felt it
conflicted with the recommendation for denial of the next sign code
exception on the agenda.

o Commissioner Fyre felt a 24' height might be sufficient,
o Chairinan Tepedino felt because of the safety issue the sign should be

o Sally Thomas, 16575 SW 85th, owner of the Dairy Farm east of the
propoed site, opposed the application, She stated there is already
a traffic problem and this development would only increase the
problem. She did not feel the site was a suitable location for a

development of this type because of the terrain and flooding that
occurs. She then read a letter from Tom and Jeannie Perin, 16585 SW
92nd, who also opposed this application.

Engineer for Century 21 Homes: Reviewed the history of the .
application noting communication problems which had occurred.
o Lengthy discussion followed regarding processing of the application.
Consensus of the Commissioners was that the there were many difficult
issues to deal with and there was confusion as to staff's position on
this application.
PUBLIC TESTIMONY
o Mrs. Rodde, 13745 SW 121st, read her letter into the record opposing
the proposed road alignment and requesting the application be denied.
o Mr. Gordon Moore, 13535 SW 121st, opposed the proposed application.
He stated that Washington County had planned to put the Gaarde Road
Extension through the Century 21 Property and that Century 21 was
aware of this when they purchased the property. Now Century 21 is
proposing shifting the burden onto his property and others without
even contacting them.
o Ray Barnum, 14405 SW Hazelhill Drive, respresenting the homes owners
in the Bull Mountain area opposed the application because of the
density and the gaarde/Murray Road extension.
o Discussion followed regarding continuance of the meeting.
o Commissioner 'Ellin moved amid Commissioner Owen seconded to table
Planned Development S 8 .83 PD to December 6, 1983, and requested
staff to schedule a meeting between Washington `County, City Staff,
Applicant, NPO # 3 and affected parties to address issues of
concern. Also requested applicant to provide a true school impact
statement.

Free-standing signs shall have certain limitations and conditions when
permitted on properties zoned commercial and industrial. One multifaced,
free-standing sign identifying the principal goods, products, facilities
• or services available on the premisies, shall be permitted on the
premises, subject to conditions and limitations as stated herein. A
readerboard assembly may be an .ntergral part of the free-standing sign. .

i Areas Limits. The maximum square footage of signs shall be seventy square
feet per face or a total of one hundred forty square feet for all sign
faces; No part of any free-standing sign shall extend over a property
• line into public right-of---way space.
Area Limit Increases. The sign area may be increased one square foot for
each lineal foot the sign is moved back from the front property line the
sign is adjacent to. If the street is curbed and paved the measurement
may be taken from a point which is fifteen feet from the pavement. This
• increase in sign area is limited to a maximum of ninety square feet per •
d. face or a total of one hundred eighty square feet for all faces.
Height Limits. Free-standing signs located next to the public
right-of-way shall not exceed twenty feet in height. height may be
increased one foot: in height for each ten feet of setback from the
property line or a point fifteen feet from the edge of pavement whichever
is less to a maximum of twenty-two feet in height.
STAFF COMMENTS
The exceptions from the sign code for the proposed sign are: height, total
sign area, and number of free-standing signs.
Currently, there are two freestanding signs Oh the motel property in the
immediate vicinity of the proposed sign. A permit was issued for the
free-standing sign that is 364 sq, ft. and 13 feet it't height: No permit
' was issued for the 24 sq. ft, free-standing sign (displaying the word
"motel" with a large arrow underneath) located at the driveway entrance on 'f
SW Pacific Highway. The motel, which is on commercially zoned property, 1
. is allowed only one multi-faced sign.
The proposed sign is 3O feet high, which is itt excess of the maximum
allowable height of 22 feet.

The applicant contends that the current. s ignage is not adequate to
identity thci motel site. Alter a field investigation, staff agrees that

the proposed sign is necessary. The limited access to the motel justifies
the need for a sign with directional information for motorists traveling
on SW Pacific Highway.
Staff suggests that ii the proposed sign is permitted, the maximum height
should be 22 feet. This height would allow visibility for traffic from
either direction. Also, the existing 364 sq. ft. and 24 sq. ft. signs
should be removed.

when allowing the additional sign against the effect on the intent of the
Site Design Review Provisions listed here:
