After lengthy discussion, Council requested a resolution be prepared i
for the August 25th meeting to set a new fee for a fifteen ( 15) yard
compacted container and asked that staff and the garbage franchise
. holders be prepared at the September 15th meeting to discuss some of
the problems being experienced with garbage nuisances and the MSD rate
increase.

placed by the Planning Commission on his variance request for property

o eliminate the possibility of construction on the site.

Please be advised that the Tigard Planning Commission at their regular meeting
of August 5, 1980, approved your request for a variance to the mniimum lot
size required in an R-7 Zone of 7,500 square feet for single family residence
which is necessary as a condition of a Minor Land Partition (MLP 9-80)
application.for this location. The approval was based on Staff's Findings
and Recommendations.
This approval is subject to the following conditions:
1. Half-street improvements be made to Knoll Drive to local street standards
for the full length of the property. Grading plans and construction
plans on all public righs-of-way shall be submited. and approved by •
the Public Works DireCtor prior to commencement of work. Street
improvements be constructed to the approval of the public Works Director
prior to the recording of the final plat or iSstance of BUilding

2. Plans for the inStallation of the sewer line to serve the larger lot
which is vacant, shall be submitted to the Public worke Diredtor for
approval. The intent of this is to serve as many propertied ae possible
in the futtre. The applicant shall participate in the formation of a
Lodal Improvement District for sewer if a Didtrict is formed.
3. A Six (6') foot Sight obscuring fence Shall be erected along the entire
sOtthern and eastern property lines prior to the issuance of an Occtpancy \
Permit if development takes place. Larger lot shall be maintained in
the interim as to not dreate a htisande.

Applicant proposes to partition an existing oversized R-7 lot
so as to create two single family residential lots. One lot will contain
approximately 7,531 square feet. The other lot will contain approximately
6,800 square feet, a variance of 700 square feet, or less than 10%.

E. Written Narrative
Applicant proposes to partition an existing oversized R-7 lot
so as to create two single family residential lots. One lot will contain
approximately 7,531 square feet. The other lot will contain approximately

6,800 square feet, a variance of 700 square feet, or less than 10%.
i) Out of 11 lots in Knoll Acres, 9 lots are irregular in shape
and this seems to have been the pattern of development, No two lots are
the same shape amOsitv The square footage of this lot was loSt to
dedications in the approximate amount of 625 square feet leaving an actual
variance of 75 square feet which is trivial,
2) Most properties in the Knoll Acre area, are capable of being
partitioned without variance of 700 square feet because of the taking of
the excess right of way by the State Highway Division in fact, it now
appears that the right 4h,==*.kt of way will not be used in the forsee
able future. Widening Rail past the 60 would conflict with policy #86
In NPO#5. Therefore the granting of this variance will give the applicant
only those rights of partition already available by surrounding properties.
3) This variance is not injurious to property in the zne or
vicinity. According to the comprehensive plan for the NPO#5 area this
vicinity is labeled urban low density residental and we are meeting that
goal with a minor variance, Under the Samo reasoning the variance will not
be detrimental to any objectives of the city or planning policy, Any
detrimental Would be clearly out weighed by the benefit of the additional
housing that would result from this variance.
4) The variance requested is indeed the minium needed to permit
the partition thus allowing 2 separate lots of which will provide more
housing in the city of Tigard, meeting the goal of urban low density.
