CALL TO ORDER: The Meeting was called to order at 7:35 p.m. 2. ROLL CALL: Members present: Ems, Nicoli, Sakata, Popp, Porter, Wakem; staff: Powell 3. MINUTES: Minutes of November 4 approved with the correction of Wakem's vote on item 5.3 on page 5 to reflect that Wakem voted ',aye', on the motion. ., Correction of addendum to Minutes of October 7 meeting . were approved. 4. Agenda Item 5•4 VARIANCE A request by Tualatin Development Co. for ,a side yard variance on a parcel of land at SW Highland Drive and SW Greens Way, Summerfield PD (Wash. Co. tax map 251 11CC, tax lot 222) . Staff Findings • 1. Tualatin 1Development' s letter (October 21) 1975) requests a variance of the 10' required "front" yard -- required under , the conditions of approval for the Summerfield project. 2. Applicant alleges that an engineering error caused the subject site to be undersized and the site opposite, " on the other . side of SW Ores Way, to be oversized. Applicant further states that said undersized lot has been sold to an in- - dividual who now wishes to build a "MK V" house on the site, but that there is inadequate lot width for that particular house due to the dimensions and configuration of the site. 3. The variance requested would diminish the front yard setback facing SW Greens Way to 6' . 4. There are no adjacent buildings on that side of SW Greens Way that would establish a uniform setback, or with which a reduced setback would interfere; however, a reduced setback in this location will tend to make the proposed dwelaing loom very close to the street as there will be open space both in front and in back of the house. 5. The requested variance would put the foundation 61 .from the property line and approximately 17' from the curb. The eaves of the house would apparently project into this. 6. The proposed dwelling is approximately 421 wide. Other models built by Tualatin Development Co. vary from approximately 38' to 44 in width, according to information on file with the City. 7. Chapter 18.76 (Variances) of the Tigard Municipal Code states, in part that! "No variance shall be granted by the Planning Com- mission unless it can be shown that all of the • following conditions exist!
