to locate a private driveway within 20 feet of an intersection were 30 feet is
required on property zoned R-4.5 (Residential, 4.5 units/acre) located on the
southwest corner of SW 98th Court and SW Janzen Court, Tigard (Washington Co.

Tax Map 2S1 11BA, Tax Lot 3200).
The adopted finding of facts, decision and statement of conditions can be
obtained from the Planning Department, Tigard City Hall, 12755 SW Ash,, P.O.
Box 23397, Tigard, Oregon 97223. The decision shall be final on May 14,
1984. Any party to the decision may appeal this decision in accordance with
section 18.32.290(A) and section 18.32.370 of the Community Development code,
which provides that a written appeal may be filed within 10 days after notice

corner of SW 98th Court and SW Janzen Court, Tigard (Washington Co. Tax Map
2S1 11BA, Tax Lot 3200).

A. FINDING OF FACT
1. Background
The property is within McDonald Acres subdivision which was
approved in 1982:

The subdivision is in the p rocess o f being developed p
and the
su rroundin g properties consist of vacant and developed lots.

3. Site Information and Proposal Description
The subject property is an undeveloped lot located on the
southwest corner of SW 98th Court and Janzen Court. A residence
with
a one-car garage �anzen Court and a two-car garage
facing 98th Court is proposed.
The driveway on 98th Court is
planned to be 20 feet from the 98th and .anzen Court
intersection. The City standard for the minimum distance between
driveways and intersection is 30 feet,

adequate sight distance is available and the intersection will

B, ANALYSIS AND CONCLDSIDN

In order to approve a variance) the criteria in Section 18.134,05b must
be satisfied. The intent of the 30-foot separation standard is to

reduce conflicting traffic movement. Because of the low traffic levels
on the two short cul-de-sacs and the orientation of the driveway, a
reduction to 20 feet should not be detrimental to the purpose of the
Code.
The terrain dictates the location of the garage near the intersection if
a retaining wall is to be avoided. The applicant wishes to avoid this I'
for financial and aesthetic reasons. If a retaining wall is not used,
the variance request appears to be the minimum necessary to relieve the
hardship.
C. DECISION
Variance V 8-84 is approved subject to the following conditions:
•
1. The driveway on 98th Court shall be a minimum of 20 feet south of
the intersection with Janzen Court. The driveway on Janzen Court
shall be subject to the 30-foot standard.
2. This approval is valid for the period of one year from the final
decision date noted below.
D. PROCEDURE
1. Notice: Notice was published in the newspaper, posted at City
Hall and mailed to:
