APPLICATION: Request by Joe and Lucille Borsch for a variance to allow a
5'-foot rear yard setback where 15 feet is required and to reduce the side yard
setback from 5 to 4 feet in the R-4.5 (Residential, 4.5 units/acre) zone on
property located at 9935 S.W. Johnson Street, Tigard (Wash. Co. Tax Map 2S1
2BA, Tax `Lot 2100).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above mentioned application subject to certain
conditions. The findings and conclusions on which the Director based his
decision are as noted below.
A. FINDING OF FACT
1. Background
No previous land, use cases have been reviewed by the City on this
property.
2. Vicinity Information
The subject property is surrounded by single family residences
that are also zoned R-4.5. A non-conforming garage with a 1.7
foot side yard setback is on the property to the northwest. Three
flag lots are to the northeast and southeast.

3. Site Information and Proposal Description
The property contains a residence and detached garage. The garage
has a One-foot side and a 5.4
4 foot rear yard setback. The
applicant p proposes to enlarge the house and replace the existing
garage with an attached two-car garage and workshop. A variance
to the side yard and rear yard setbacks of 5 and 15 feet is
requested for the garage and workshop to allow side and rear
setbacks of 4 and 5.5 feet respectively.
Letters have been submitted from the owners of the adjacent lots
stating they have no objection to the proposed garage/workshop.
4. Agency and NPO Comments
The Engineering Division has the following comments.'
a. Johnson street has a 40-foot wide right-of-way and 50 feet
is the requirement for Local streets. An additional 5 feet
of right-of-way should be dedicated along the Johnson Street

The Building Inspection Office has no objection to the proposal.
Other agencies and NPO #2 have not commented.
B. ANALYSIS AND CONCLUSION
In order to approve a variance, the criteria in Section 18.134.050 of
the Community Development Code must be satisfied. The proposed
garage/workshop is consistent with the criteria for the following
reasons.
The - ,
e primary purpose of the setback standards for the R 4.5 zone is to
allow for adequate spacing, air, light, and privacy for residential
structures. The garage/workshop location will not encroach upon any
residences and the nearest building will be the non-conforming garage to
the northwest. The owners of the two properties most affected by this
proposal have no objection.
The location and design of the house dictates the location of the r f`
garage/workshop in the area proposed. The new structure will offer an
increased setback to the side and rear. A garage and non-commercial
workshop are permitted uses in the R-4.5 zone.

C. DECISION
Variance V 8-84 is approved subject to the following conditions: 4.
1. The garage/workshop shall be constructed as shown
on the
"approved" site plan submitted by the applicant dated March 24i �

SETBACK REQUIREMENTS VARIANCE APPLICATION
March 27, 1984
Joe and Lucille Borsch would like to improve their home
at 9935 SW Johnson Street in Tigard, It is a two bedroom
one bath house with a single car detached garage. They
hope to add two bedrooms and a second bath, enlarge the
living/dining area, and remove the existing garage and re-
place it with a two car attached garage and shop. The
garage/shop addition as proposed requires a variance from
the required setbacks.
The existing single car garage which would be replaced by
the new garage/shop is a nonconforming structure: it ex-
tends 3.9 feet into the requited 5 foot side yard setback
to within 1.1 feet of the property line, and extends 9 .6
feet into the required 15 foot rear yard setback. The roof
overhang extends right to the side property line.
The proposed garage is 21'-4" wide, for an interior width
of 21 -0" . We feel this is the minimum practical width for
their two vehicles, because one is a full sie van. The
existing house is built square with the Street, which makes
its sides out of parallel with the side and rear property
lines. Since the hot8e is twisted on the lot, the rear
portion of the proposed garage/shop crosses the side setback
line slightly (approximately 10 foot) , even though the
garage is about 1. 8 feet from the setback line at the front.
The proposed Structure is within the side setback require-
• ment exCept for a few feet at the rear. The only ways to
avoid the side encroachment would be to narrow the garage,
build' it out of square with the exiSting house, or to put
a jog in the Wall, all of Which are impractical and would
cause a hardship to the oWners.
The proposed garage/shop extends into the 15 foot rear set-
back about 9 .4 feet. That puts it about 5 .6 feet from the
rear property line. It is not possible to slide the garage
towards the street, because it would Covet the exiting
dining room windows, Which are already as far forward as
they Can be.
The proposed garage/shop is 41 feet deep--24 '-6" for qarage
and l6 '-6" for shop. The 24 feet is needed to allow for a

work bench, laundry tray, and freezer in front of the
vehicles. The garage is already to narrow to put these
items on the side. The 16 foot deep shop is about the
minimum to allow handling large pieces of wood on free-
, standing woodworking machines, while allowing spade for
work benches on the walls.
Mr. Borsch is serious about his woodworking hobby; the in-
clusion of shop space is an important part of the proposed
improvements to his house. Obviously, if the shop could

be located somewhere else on the site, there woUld be no •
setback problem. Study of the site and the orientation of
the existing house and its windows makes it cleat, however,
that there is really no other location suitable for the
shop.
Mr. Borsch' s interest in woodworking is strictly amateut.
He works in electronics in Portland. He has no intention
of using the shop for commercial purposes . The proposed
use of the garage and shop space is no different than the
uses that would be permitted in a similar conforming
structure.
The proposed structure would have minimal impact on the
heighbors. It extends into the side yard setback much less
than the existing garage, and it would look better. The
only structure on the adjacent property to the side (Tax
Lot 2200) is another detached garage, which iS also noncon-
forming. The owners of that lot agree that their property
would not be detrimentally affected, and their statement to
that effect i8 included with our application.
The proposed garage/shop would also have no adverse impact
on the property to the rear, Tax Lot 2101. The new garage/
shop extends into the setback slightly less than the eXiSt-
ing building. The area of hohconformance is at the back of
their property, far from the house. The properties are
separated by a high wood fence and a row of approximately
15 foot high trees. The structure would have almost no
visual impact an Tax Lot 2101.
The comMon drive for the three flag lots behind the Borsch's
property (Tax Lots 2101, 2102, and 2103) makes the Borsdh
property seem like a corner to Vtorn the point of view of
the owners of Tax Lots 2101 and 2102 Which face the common
drive, the BotSch'S rear setback is in essence a SIDE set-
badk. Since side setbacks are only 8 feet, then the pro-
posed structure i8 in conformance, from that point of view.
The purpose of setback requirements in general is to ensure
the preServation of air and light for structures and yards.
Approval of this variance request wotild not be materially
detrimental to these ptrpoSeS. The proposed structure comeS
closet to meeting the setbacks than the existing one.

The site contains no physical or natural systems (such as
traffic, drainage, dramatic land forms, or parks) that would
be any more affected adversely by the proposed structure
than by a conforming one . ,1
The owners had the site surveyed by Layne Caswell, Regis+ ..,
teted Land Surveyor, Beaverton, to accurately determine
, • thb locations of the existing structures on the site and
the. locations of the adjacent structures. The existing
locations and dimensions shown are generally accurate to
0 . 1 foot.
Approval of this variance request will make the desired
improvements possible, improving the existing nonconforming
situation and also significantly improving the house, up-
- grading the neighborhood in general and increasing the
taxable value of the property.
This then is a summary of our case:
