MELIg8TIQN: Request by William and Jean Lindsay for a variance to allow a
rear yard setback of 0 feet where 15 feet is required on property zoned R-7
(PD) (Residential, 7 units/acre), planned development and located at 15505 SW
109th Ave, (Wash, Co. Tax Map 291 10DD, Tax Lot 13600),
DEctgONt Notice is hereby given that the Planning Director For the City of
Tigard has APPROVED the above described application subject to certain
conditions, The Findings and conclusions on which the Director based his
decision are as noted below.

A FINDING OF FACT
1, Background
The City has not reviewed any previous land use applications for
the subject parcel.
2 Vicinity information
• The adjacent properties are all developed with single family
residences and are zoned R-7 (PD), except the land to the west
which is zoned R-25 (PD) (Residential, 25 units/acre, planned
development), The subject property •and the sUrrounding area are
part of the Summerfield development, Approval was recently
granted for the development of the land to the west with •attached
• residential units, The area immediately adjacent to the subject
property is to be utilized as common open space,
• 3, Site Information and Proposal Description
The parcel is pre!tently occupied by a single Family residence.
The applicant proposes to replace a covered patio with an encloSed
sun MOIR in the rear yard which will be attached to the egisting•
structure. The western side of the addition will be within 9.5
feet of the roar property line instead OF the required 15 foot
setback.
4, AgehCy and NPO Comments
The Engineering Division and guilding Inspection Office, have 110
abjection to the proposal, No other comments have been reteived.
ANALYSIO ANO CONS
Oection 10,134,060 of the Code requires the following approval trittri
for variance proposalst •

1, The proposed variance will not be materially detrimental to the
purposes of this Code, be in conflict with the policies of the
Comprehensive Plan, to any other applicable policies and
standards; and to other properties in the same zoning district or
vicinity;

2, There are special circumstances that exist which are peculiar to
the lot size or shape, topography or other circumstances over
which the applicant has no control, and which are not applicable
to other properties in the same zoning district;
3 The use proposed will be the same as permitted under this Code and
city standards will be maintained to the greatest extent that is
reasonable possible, while permitting some economic use of the
• land;
44 Existing physical and natural systems, such as but not limited
trarFic, drainage, dramatic land forms or parks will not be
adversely affected any more than would occur if the development
were located as specified in the Code; and
5. The hardship is not self-imposed and the variance requested is the
minimum variance which would alleviate the hardship,
The primary purpose of the setback standards for the R-7 (Pb) zone is to
allow •For adequate spacing, air, light, and privacy For residential
structures, The variance will hot have an appreciable effect upon the
existing propOtids in the area, Because the rear property line abuts a
common open space area, the structure will not encroach upon ail
adjoining residential lot, The variance proposal is consistent with the
• intent of the setback standards contained ih the Code.
The location oF the house and existing patio has already determined the
location of the solarium, In order for the addition to have a desirable
configuration, the proposed variance is necessary,
The residence is a permitted use in the zone and all other aspects of
the building will conform with the Code, The Variance will have no
effect upon existing physical and natural systems,
Finally, the variance request appears to be the minimUm necessary to
locate an addition of reasonable it Oh the property, The applicant
has designed the solarium to Fit the lot to the greatest extent possible,

,ft VARIANCE REQUEST RATIONAL
The variance request would in no ,tiwa abort the
request y purpose of the
zoning ordinance which requires a fifteen (15) foot set-back from
back property lines. The property abutting the rear property line ,...
is designated as Greenway, to be maintained as such in perpetuity
by the Summerfield Association, and will be 85' in depth.
The ros f height will be approximately the same as the ex eting
patio cover and thus will in no way adversely affect the view of the
adjoining property owners.
To reduce the planned solar room to the size allowable by the
15' set-back requirement would make it too small (8' wide) for
planned Use, and would make the cost impractical for the end result.
Anything less than the variance requested would not permit use of the
existing frame patio without pr oh h ibitively expensive modifications.
There would be no change in the use of the land (for residence),
and all other existing standards will be maintained.
