Registered Professional Land Surveyor, which provides the
correct measurements for the rear-yard setback on both the
presently existing building and the addition presently under
construction. As you will note, We have a minimum rear
yard of 18 feet 3 inches and maximum of 18 feet 4 inches.
We, therefore, have complied with the variance given to
Circle AW Products Company at the Tigard City Planning
Commissions meeting of June 4, 1974,

By this letter I want to confirm my understanding
of the Tigard City Planting Commission' s action oh Tuesday,
June 4, 1974 concerning Circle AW Products Company' s ap-
plication for a variande.
• A8 a result of our misunderstanding as to exactly
what the Commission had granted to us on March 19 , 1974 , the
• Commission made the following determination:
1. If Circle AW Products Company has at least
a 17 1/2 foot rear yard, the Commission grants
a variance from the requirement for 20 foot
set-back.
) 2, If Circle AW Products does not have
at least 17 1/2 feet between the proposed new
structure and its rear yeard property line,
Circle AW Products Company shall obtain an
easement on sufficient adjoining property
to provide a 20 foot set-back for the rear
yard of the addition and of all the existing
structure. The easement will prohibit any
construction in the easement area and Will meet
all the criteria of the 20 foot set-back re-
quirement. The adjoining ownerls rear yard
set-back requirements will commence at the
easement line on their property.

3. Circle 1W Products will obtain a certified
survey of the property in order to determine
the exact amount of property available to meet
the 20 foot rear yard set-back requirement.
4 4. Mr. Brooks is directed by the Commission to
immediately authorize construction of the
proposed addition upon his receipt of a
guarantee by Circle AW Products to remove the
structure if it is not able to meet the variance
criteria indicated above.
If you concur with my interpretation of the
Commission' s ruling, I would appreciate it if you would sign
the enclosed copy of this letter and return it to me for my
files.

to answer any questions the Commission had.
B. Whittaker asked the city Attorney if Mr. Beam
could apply for a variance to allow an expansion beyond
the 20% allowed in the non-conforming use section of
the ordinance.
C. Fred Anderson said that, while he is* in sympathy with

D. The motion was put to a vote and passed by a unanimous
vote of the members present.
E. Mr. Lowe then asked the Planning Commission if they would
instruct the Planning Director to sign off their plans
so they could get a building permit as rapidly as
possible and begin oonstructionc He stated that Circle
A,-W Company would tear out any foundations or footings
constructed if Circle A-W Company could not Meet the
condition placed UllOn the variance as filially approved.
r. BarkhUrst moved to authorize the planning Director to turn

the plans over to the Building Department where they could
issue a building permit if the requirements of the Building 4-
Department had been Met,

1. The Planning Commission, on March 19, 1974, took
action to approve a side yard setback variance from
a required 20 feat to 12 feet based upon the following
condition.
"That the applicant obtain a minimum 28 foot easement
on the property adjacent the subject setback area.
Said easement shall preclude any building construction
within said 28 foot easement and shall be approved
by the City Attorney"
• 2. The applicant has submitted an "Agreement for
Easement" for an area immediately adjacent the
proposed new addition to the Circle A-W complex.
3. The City Attorney and the Planning Commission Chairman
recall the Planning Commission' s intent, regarding
the condition upon the variance, was to create an
easement the entire length of the existing and
proposed structures.
4. Please note the attached letter from the applicant' s
attorney.

Dear Mr. Moreland:
We have reviewed the request of the Circle A-W. Products Company
for a waiver of the maximum area requirements on their Plans Review
41167-73.

They have taken all of the area increase permitted by the Code and
have exceeded by 3,000 square feet these allowable increases. This
is four percent more area than the Code permits.
Inasmuch as the building is completely automatic sprinklered and only
a four percent increase in area;has been requested and the building will
be fitted with plastic skylights and draft curtains , we believe that the
fire protection requirements are being reasonably served, and a variance

permittin g the 3,000 sq« foot area increase is allowed.
It is pointed out, however, that no further future increase in area will
be approved.

to have a 12 foot side yard setback where a 20 foot setback is required
in an M-21 General Industrial zone.

1. Applicant's justification is stated as follows: "It is impossible to
efficiently utilize the existing building and the proposed new building
fl' 6: if we are required to provide 20 feet rear yard setback. However, we
can meet all accepted fire protection measures and provide a safe building."
2. The applicant proposes a 48 foot easement on an adjacent tax lot, said
easement restricting the further construction of structures upon the easement
and providing a potential 60 foot separation between buildings. The applicant
has furnished no easement documents for review by the planning staff and City
Attorney.
3. The applicant has not submitted a description oE the problems inherent
in the manufacturing process that causes loss of efficiency inside the
building and proves an undue hardship.
4. Section 18.76.010 (Tigard Municipal Code) states ". .. the planning
commission may authorize variances from the requirements of this title where it
can be shown that owing to special and unusual circumstances related to specific
piece of property, the literal interpretation of this title would cause an
undue or unnecessary hardship...Xn granting a variance the planning commission
may attach conditions which it finds necessary to protect the best interests
of the surrounding property or neighborhood and to otherwise achieve the
purposes of this titles.
In addition Section 18.76.020 (Tigard Municipal Code) states that no variance
shall be granted by the planning commission unless it can be shown that all the
following conditions exist:
(i? (1) Exceptional or extraordinary conditions applying to the property that do
not apply generally to other properties ih the same one or Vicinity,
which conditions are a result of lot size or shape, topography, or
other circumstances over which the applicant has no control;

Dear Mr. Whittaker:
Attaohed is an application for a variance from the
requirements of the City' s M-2 Zoning Requirements, permitting
Circle A-W Products Company to construct .1i addition to its
existing building under one of two proposed alternatives :
1. The Planning Commission grant a variance
from the 20 foot setback requirement for a rear-yard
to allow Circle A-W Products Company to construct
an addition to its existing building with a 12 foot
rear-yard; or
2. Grant the requested variance subject to
Circle A-W Products Company obtaining a easement
on sufficient adjoining property to provide a 20
foot setback for the rear-yard of the addition,
The easement would prohibit any construction it the
easement area and would meet all the critera of the
20 foot setback requirement.
Plans for the addition to the presently eisting
Circle A-W Products Company plant were submitted to the
City on June 25, 1973. shortly thereafter, we were advised
that the City' s Zoning Requirments and a M-2 designation
required a 20 foot rear-yard setback for the proposed addi-
tion. The setback which we were able to provide amounted to
approximately 12 feet. In addition, we were also having some
problems with the State rite Marshall' s Building Code and as
a result we have spent a considerable amount of time attempt-
ihg to meet the requirements of the City and the State so that
we could proceed with the cor.strUction of the proposed additioh,

Due to the elevation of the building site, the nature
of the area, which is within the general industrial area
of the City of Tigard' s adopted Comprehensive Plan, and
the nature of the business itself, we believe that the City •
could and should grant a variance to the 20 foot rear-yard
setback requirement. In addition, we should like to bring
to your attention that after the original, plant and addition
were constructed, and while the plant site was outside of the
City of Tigard' s jurisdiction, our company and officials of the
City discussed the desirability of the company petitioning
for annexation to the City. At that time there apparently
was no thought on either parties part that the company might
run into a problem with regard to the rear-yard setback re-
quirement. In fact, the company was told that no additional
requirements would be imposed upon the building site and that
the County' s building requirements would apply to future
additions to the plant. With that thought in mind, the
company did petition the City for annexation.

It is clear that there was no misrepresentation by
the City to the Company, but the fact that the City does have
a restrictive rear-yard setback requirement has halted the
expansion of the plant and caused us considerable problems
both in meeting our plant production requirements and in main-
( taining the line with respect to our building costs. We believe
that we have worked out a solution to the problems which we
had with the State Fire MarShall' s office and we are very hope-
ful that the City will see fit to grant us a variance from the
20 foot setback requirement or, in the alternative, grant a
variande subject to the obtaining of a clear zone easement
from the adjoining property owner, Northern Yards, Inc.
We have previously submitted a site plan to the
Commission. We are enclosing herein our application for a
• variance, a letter to Mr. Robert Johnson, President of
Circle A-W Products Company from Mr. Duane A. Wolfe k President
of Northern Yard , /nail the owner of the adjoining property
just south of the Circle A-W Products Company property,
our response to the Pasano requirmentS and a statement
concerning the e5tistance of conditions required by Section
18.76. 020 of the City Code. A

This letter will confirm my conversation with
you of several weeks ago that Northern Yards, IAc. , is the
• owner of the property immediately south of the Circle
AW Property in Tigard, Oregon.
• We have discussed the possibility of our granting
your corporation an easement along the northern edge of
our property sufficient to give you a 60 foot clearance
• between• your proposed new structure and the nearest
possible building site.
In other words, we are prepared, subject to

"FASANO" REQUIREMENTS
The following are responses to questions which
the Planning Commission requires answered as a condition
to consideration of an applicant' s request for a variance
from present zoning requirements.
• a. Circle A-W Products Company has requested a
•
variance to the presently existing M-2 zoning requirements
which require a 20 foot setback of the building from the
rear-yard property line. We are requesting the Commission to
• consider two alternatives in the order of their acceptability
to us,
1. To grant a variance allowing Circle A-W
Products Company to have a 12 foot rear-
, yard setback instead of a 20 foot set-
back; or
2. To grant the applicant a variance conditioned
upon the applicant obtaining a "clear gone"
easement on the adjoining property which would
• prevent any future construction on the property.
• This would provide the equivalent of at least
a 20 foot setback for the rear-yard and assure
a clear zone in perpetuity of 20 feet from the
• southern edge of the proposed new construction.
The intent of the M2 zoning rear-yard setback
will be fully met by conveyance of the
easement and assU.co that no construction can
take place within the property which is the
subject of the casement,
b. Under either of the two alternatives proposed,
the requested variance is in conformance with city of Tigard' s
adopted Comprehensive Plan. The area is designated as general
industrial,

c. The proposed variance fulfills a community need
for the proposed use, since Circle A-W Products Company is
considered to be a desirable occupant of the land and a
good neighbor in the community. It will provide a higher tax
base to the City and additional employment for residents
of the area. In addition, the plant itself is aesthetically
acceptable to the community and comprises one of the better
examples of industrial development in the community.
d. Not applicable.
e. The proposed variance allows for required plant
expansion of Circle AW Products Company in a manner which is
consistant with the past development of the plant and most
adequately meets its requirements for future development.
In particular, it is important that the addition provide a
continuation of the present "work-flow" in the plant. That is
the reason why the proposed addition is identical in terms
of width and location to the presently existing plant.

f. The proposed variance Will have no effect on 1
adjacent properties or on adjacent neighborhoods. In fact,
Northern Yards, Inc. is the owner of the immediately adjacent
property to the south and it is from that corporation that the
applicant will obtain an easement to allow it to construct the
proposed addition to itS plant, if the CommiSsion deems that
alternative necessary.
g. The proposed variance will not necessitate any
additional public services and will have no impact on those
public services
h. The proposal has no adverse (Affect on the
community.

Capliance with Section 18. 76. 020 Granting--Conditions.
We wish to invite the Planning Commission' s
attention to the existance of the following conditions:
(1) Exceptional or extraordinary conditions
apply to the property that do not apply generally to other
properties in the same zone or vicinity, the circumstances
over which the applicant has no control.
When the first two segments of the plant were
t '
constructed, the property in question was subject
only to county zoning requirements. At the time
of the construction, a 12 foot setback for the side
and back yards was acceptable as there was no side
and back yard requirements. After the completion
of the construction of the first two stages, Circle
A-W Products Company and the City of Tigard discussed
the desirability of the property coming under the
city' s jurisdiction. During those discussions, Circle
A-W Products Company was advised that no additional
restrictions would be placed on the building site,
in particular with regard to the expansion of the
plant. AS a result, Circle A-W Products Company
petitioned the City for annexation.
Thereafter k when the plan for the third construction
otae was SUbMitted to the city t the applicant was
. .
advised that the City had a 20 foot rear-yard setback
requirement. The construction had been planned to
take place in the summer of 1973 and as a result
of the City' s requirement all construction has ceased
until a means can be found to either comply with
. A the City' s requirement or to seek a variance from
this Commission.
The existing plant has been planned with a view
that future additions would be constructed on the western
end of the structure to permit a "flow-through" assembly
technique in the plant. To off-set the new structure or
to reduce its size to meet the 20 foot rear-yard setback
requirement would destroy the "flow-through" concept of the•plant and impose a severe hardship on the continued growth
of the company, if not entirely prevent it.
(2) The variance is necessary for the preservation of
a property right of the applicant substantially the same as
possessed by owners of other property in the same zone or vicinity.
It was because of assurances which the applicant
thought he had from the City that he petitioned for
annexation to the city. Had he remained out of the
City' s jurisdiction and in the County, there would
be no problems with respect to the structure that
is now proposed. The land upon which the new structure
will be built is at a oonsiderable elevation over
the adjoining property and the purpose for which

the rear-yard setback requirement is required by
the City is fully met by the topography of the land
itself. Our alternative proposal to the Commission,
by which a clear zone easement would be obtained
from the adjoining property owner, would also fully
meet the requirements of the City for a rear-yard
20 foot set-back.
(3) The authorization of the variance is not
materially detrimental to the purposes of the City zoning
regulations, injurious to property in the zone or vicinity
in which the property is located, or otherwise detrimental
to the objectives of the City development plan or policy.
The property has already been zoned for industrial
development and the proposal has the full concurrence
of the adjoining property owner, Northern Yards, Inc.
There is substantial clear space around the two prop-
erties and the presently existing plant and the neW 4
addition are aesthetically pleasing and fully in com-
pliance with the City' S future development plan.
(4) The variance requested is a minimum variance
from the provisions and standards of the City zoning
regulations and will alleviate the hardship which has been

imposed upon Circle A-W Products Company by the reat-yard
20 foot setback requirement.

• only alternatives which would meet the ojectives of the
City and at the same time allow the applicant to construct
an addition to its existing plant which would meet its
manufacturing requirements.

Staff Findings
1. Applicant's justification is stated as follows: "It is impossible to
`'; efficiently utilize the existing building and the proposed new building
if we are required to provide 20 feet rear yard setback. .However, we
can meet all accepted fire protection measures and provide a safe building."
2. The applicant proposes a 48 foot easement on an adjacent tax lot, said
easement restricting the further construction, of structures upon the easement
and providing a potential 60 foot separation between buildings. The applicant
has furnished no easement documents for review by the planning staff and City
Attorney.

3. The applicant has not submitted a description of the problems inherent
in the manufacturing process that causes loss of efficiency inside the
building and proves an undue hardship.
4. Section 18.76.01.0
(Ti and Municipal Code) states a. . . the planning
commission may authorize variances from the requirements of this
title where it
can be shown that, owing to special and unusual circumstances re.l a, ted to specific
piece of property, literal interpretation of this title would cause an

SECTION 160-3 - LOT SIZE

SECTION 160-4 - SETBACK REQUIREMENTS
