QECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described application subject to certain n conditions, The findings and conclusions o which the Director based his decision are as noted below, A FINDING OF FACT 1, Background Two previous approvals have been granted by the City relating to the development of the property (SDR 32-76, SDR 15-77) , 2, Vicinity Information The properties that are adjacent to the north and south along Pacific Highway are also zoned C-G, The property to the east is zoned R-12 (Residential, 12 units/acre) and is developed with a nursing home, 3 Site Information and Proposal Oescription The property is developed with two large retail building which have access to Pacific Highway, The subject property does not contain any landscaping between the buildings and the eastern property line, The applicant plans to remodel the building and construct a sun rOOm which will encroach upon the required 20 Foot tear yard setbacIt by thrte feet, This addition will be 16 feet in length and it will connect the two buildings, 4 Agency and NPO Comments i The Engineering uivison and Building InSpettion Office he no objection to the proposal, The Building Inspection notes that 0-2 occupancy isOqUfrds a one hour fire Wall construction for all walls with a setback of lets than 20 feet. 0, ANALYSIS AND CONCLUSION Section 10,134,050 of the Code requires the following approval criteria for variance PrepOsal4! NCB btOISION - V 6- - PAM i 0 1. The propL 41 variance will not be mato-. 419 detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicihity; 2, There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no cohtrol, and which are not applicable to other properties in the same zoning district; 3, The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonable possible, while permittihg some economic use of the land; 4, Existing physical and natural systems, such as but not limited to traffic, draihage, dramatic land forms or parks will not be adversely affected many more than would occur if the development were located as specified in the Code; and 5, The hardship is not self—imposed and the variance requested is the minimum variance which would alleviate the hardship, The primary purpose of the setback standards for the 0-G zone is to allow for adequate spacing, air, light, and privacy for adjacent residential structures, the variance will not have an appreciable effect upon the property to the east, A small portion of the solarium will be within 20 feet of the roar property line and the variance proposal is consistent with the intent of the setback standards cohtained in the Code Because of the existing 25 foot setback of the buildihg, the sun room must ehcroach into the rear yard in order provide a usable area that is eight feet in width, The commercial use of the property is permitted and all other aspects of the • property conform with City Code requirements except for landscaping and bufferihg, The Code requires that a landscaped buffer be provided when • commercial development abuts a residential zone, Landscaping including an evergreen hedge or solid fence should be provided from the existing evergreens • to the north end of the building, • rinally, the variance request appears to be the minimum necessary to locate an addition Of reasonable size on the property, The applicant; has designed the • addition to fit the lot to he greatest extent possible, however, the variance is necessary to allow For a workable floor plan, Because of the minimal nature of the variance along with the additional landscaping noted above, the request is consistent with the intent of the (lode, 0, Ot.01: 1:0111 The Planning birector approve V 6-06 subject to the following conditions!
