1. Tax Lot 1500 of Washington County Tax Map 2S1 2AD, 18 zoned
M-4 and designated on the Neighborhood Planning Organization
#1 Plan map as "Commercial_Industrial"
•' 2 . Section 18 . 52.040 of the Tigard Municipal Code requires that
the side yard setback in a M-4 zone shall be 20 feet , except

1. The site is a flat parcel with an existing _building .oca�-
ted in the southwest corner of the lot . Access to the site
is provided through a 30 foot easement that extends from
the site out to S.W. Burnham Street Surrounding land uses
the Tigard Shop igard Radiator and ROK Stock (parts and ac-=

essories to the south, Oregon Electric Railroad line to
the east) Tigard Machine to the north, and to the weSt Wilts

APPLICATION FOR VARIANCE
Modern Plumbing Co. is a plumbing contracting business
which has been operating in the Tigard area for 18 years It
.:, employs approximately 40 employees and operates a fleet of 25
trucks. There is now one building on the property which is the
subject of this application for variance. It is being used as
an office and shop. The rest of the property is being used for
Storage of plumbing fixtures. Modern Plumbing Co. wishes +.ro pro-
vide for inside storage by constructing a building along the North-
east line of the property. Therefore, Modern Plumbing Co. requests
a variance from the 20 feet setback requirement along that property
line.

Since the entire property is now being used for storage,
it is impractical to put a large storage buildin g` on the p ro P ertY
and abide by setback requirements. The property is relatively
small, and the most efficient Use and development of the property
requires that the maximum square footage be retained for storage
when the buuidmriq is constructed. This can only be accomplished
by putting the building On the property line.
The Tigard Planning Commission has recognized the problems'
of developing small lots in the general 'vicinity of the subject
propeJty, and has been liberal in allowing setback variances. It
' is obVious that the use and development of the property Will be
hindered if Modern Plumbing do. does not obtain the requested v'ar

Because of the above-mentioned problems of the development
of small lots in the vicinity and the policy of the Planning
,N Commission, the granj;ing of the requested variance cannot be con-

to any plan or policy ot the City of Tigard. Further., it will not
ihjure other properties in the same vicinity. The only property
which would be affected by the variance is the contiguous parcel
