1. The site is desginated "General Industrial" on the Tigard
Municipal Code and zoned M-2, "General Industrial" .
2. The surrounding land use is general manufacturing.
3. This parcel was originally partitioned through a major
land partitioning (MLP 4-74) approval of which was given
following appeal to City Council on August 26, 1974 with .
the following conditions:
A. That property owners shall agree to participate in
local improvement district for the purpose of improving
SW 72nd Avenue to city collector street standards and
shall execute a recordable covenant herewith.
13, That the property owner shall dedicate sufficient land
to allow a 500 radius curb for future alignment of
SW 72nd Avenue.
C. That property owner dedicate a street right of way
meeting city standards as defined in section 17 ,28. 040
of the Tigard Municipal Code and as shown on the appli-
. dantls tentative map df major land partition as it is
approved by City Public Works Department . ,
D, That the property owners construct a street meeting
city standard as defined by Title 17 Tigard Municipal
Code within the dedicated right of way as shown on
the applicant ' s tentative map of major land. partition

5. The Planning Commission on March 4, 175 approved a
variance to the sideyard setback requirements in the
M- 2 zone on the following conditions:
"That the conditions attached at the time of the
initial major land part be finalized before building
permits are issued" .
6 , Section 17.44. 040 of Tigard Municipal Code requires that •
11 concrete sidewalks shall be installed along both sides
of each street in accordance with standards adopted by
the city, not less than 5 ' wide in areas where the Pro-
posed lots are 10,000 square feet or less in size . Side-
walks shall be constructed adjacent to the property line" .
7i Section 17.48 ,020 of Tigard Municipal Code requires that
:4.
a variance shall not be granted unless the Commission
finds that all of the following exists:
A. That there are special circumstances or conditions
affecting the property which are unusual and
particular to the lands or development of the project
involved as compared to other lands similarly
situated.
B. That the variance sought is necessary and the minimum
required for the preservation of protection of a
substantial property interest of the partitioner to
the degree that extraordinary would result from strict
compliance with the regulations of this chapter
applicable to the particular subdivision major and
minor land partition involved.
C. That the gTanting of the variance will not be determintal
to the public health, safety and welfare but will be
consist therewith and shall not be injurious to the rights
of other property owners in the near vicinity nor con-
,
stitute a departure from or be in violation of the
Comprehensive Pan of the City of Tigard,
D, That the applicants proposal for variance and subdivision
or major land partition conforms to and is consistent
with all other regulatory requirement of this title
(Title 18) of this code, that adequate provision is made
for traffic circulation, recreation, open space) and
other similiar factors and that the variance sought has
been considered by other public agencies concerned with
Tire protection, sewer, water and other utilities as well. L

FINDINGS
1 . Conditions of the previous major land partition, minor
land partition and variance creating SW Landmark Lane
have been satisfied.
2. The present right of way width of SW Landmark Lane is 50 ' .
3. The topography of the site along the south side of Landmark
Lane show elevation differences which vary as much as
'..
3 '60 vertically with 5 ' horizotnal measurement. It should be
,,. t noted that these topography changes are somewhat the result
{ of the construction of the Owens Corning Building at that
site. The area to the south of SW Landmark Lane is land-
scaped and planted in street trees and groundcover .
4. Present paved width of SW Landmark Lane is 40' leaving a
10 ' easement along the north side of the street .

5. The applicant has stated that due to the topography of the
lot on the south side the possibility of adding a sidewalk
along that side is rather remote and that owning to special
circumstance they are requesting that a sidewalk only on r
the north side be required.
6. The loss of newly planted vegetation including street trees
" and ground cover would result in a hardship to the property
owners and the public,
7, No detrimential impact will be created by the relaxation of
this requirement in that., the street is 40 ' wide whereas
the code normally requires 36 wide pavement width and the P"
:k location of a sidewalk being on the north of the cul-de-sac.
Engineering Department has found that one sidewalk on the
north side of Landmark Lane be located from the existing
right of way on SNP 72nd around the cul-de-sac to the west
edge of 8ethleham Steel ' s driveway apron would provide
adequate pedestrian circulation,
CoNCLUSIONARY FINDINGS :
of the site which will warrant the granting to the topography
1. There are special circumstances in regards i g of this variance,
2. Granting this request would allow one sidewalk as opposed
to the required two and would save the destruction of recent
landscaping activity, The aesthet,.c value of the south
side of the street would be reduced if existing landscaping
were moved,
Sy The e variance appears to be the minimum without being injurious
to the Tigard Code.

F. Commission. Discussion and Action
o Sakata asked the staff to further explain the existing
topography.
o Krause moved and Sakata seconded to approve the request
based on staff findings with the staff recommendation .
The motion was approved by a unanimous voice vote.
7, OTHER BUSINESS
o A letter was presented by Roger Zumwalt in opposition to the
• proposed Yolo subdivision originally scheduled for this agenda.
o Popp asked that the staff give Mr . Trumbo a warning for out-
side storage in that it is presently in violation of the Con-
ditional Use Permit ussued by the Planning Commission.

o Daniels asked the Commission for their view on the slide
presentation . The Commission advised that their Use be reserved
for items of unique setting,
o Daniels updated the Commission on the forthcoming Babe Ruth
appeal to be heard by Council 7/21/76 , •o Popp advised the commissioners that they should try to attend
all Planning Commission meetings in order that a quorum be
assured.

Gentlemen:
Re: O. W. Landmark Lane
On January 6, 1976, we received a six month time extension for the
completion of construction on S. W. Landmark Lane.
Luring this period, we have been involved in preliminary planning of
the two remaining sites on the north side of the street, with the in-
tent that final street construction would be completed, including
approaches, etc., 'for the two projects.
Unfortunately, the projects have not been finalized and our six month
period has expired.
With this letter, we request an additional 60 day extension during
which the required street construction will be completed, regardless
of the f
final design of the two remaining sites.
Again, we express our appreciation to you and the City of Tigard for
the cooperation.

Re; Subdivision Variance S. W. Landmark Lane
The following is directed to "Findings Required," Section 17.48.020 of
Chapter 17.48 Variances, items #1 through #4.
General Information
Again, it should be explained that the street design was submitted and
approved with the first project, 414 Properties, now occupied by Owens
Corning. The design then, and as now constructed, was for a 50' wide
right of way of which 40' is paved, leaving a 10'0" utility easement,
The approval of this design, set the North property lines of the South
• lots at the back side of the South curbs, thus requiring the 10'0" easement
to be located on the North side of the right of way.
As the area continued to develop, we, in cooperation, with the City, have
made all agree, changes, such as the addition of the duly-de--sac,street
lighting, etc. , leaving only the sidewalks to complete for final accept-
ance of the street.
Because of the South curb location as related to the North property lines
and the extreme elevation differences from Owens Corning parking lot to

approval of the street placing the North property line of the South lots
and the South curb line of the street.
Also, the existing circtmatance of the elevation differences from top of
curb to the paved parking lot at Owens Corning. These elevations vary as
much as 3'6" vertically in a 5'0' horizontal measurement, again approved
with the initial design.

3. If the variance is granted, the construction of the sidewalks will {

structed in the designated right of way on the North side, it, also, in-
sures the future property owners of their rights.
