The Director of Planning and Development has approved a request to vary the
street side yard setback from 15 to 10 ft. and to vary the required distance
between a primary building and accessory structure from 15 to 4 ft. in the
R-4.5 (Residential 4.5 units/acre) zone on property located at 11960 SW 121st
Avenue, Tigard (Wash. Co. Tax Map 1S1 34, lot 3700).
The adopted finding of facts, decision and statement of conditions can be
obtained from the Planning Department, Tigard City Hall, 12755 SW Ash, P.O.
Box 23397, Tigard, Oregon 97223. The decision shall be final on April 20,
1984. Any party to the decision may appeal this decision in accordance with
section 18.32.290(A) and section 18.32.370 of the Community Development code,
which provides that a written appeal may be filed within 10 days after notice
is given and sent. The deadline appeal dune- for filing, of an a es1 is April 20, 1984.
The hearing on an, appeal will be De Novo.

VARIANCE CASE NO. V 5-84
APPLICATION: Request of Jack Durrett to vary the street side yard setback
from 15 to 10 feet and to vary the required distance between a primary
building and accessory structure from 15 to 4 feet in the R-4.5 (Residential,
4.5 units/acre) zone on property located at 11960 SW 121st Avenue, Tigard
(Wash. Co. Tax Map 1S1 34, Tax Lot 3700).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above application subject to certain conditions. The
findings and conclusions on which the Director based his decision are as noted
below.
•, A. FINDING OF FACT
1. Background
No previous cases have been reviewed by the City on this property.
2. Vicinity Information
The property is on the southeast corner of 121st Avenue and
'`' Katherine Street within Leron Heights Subdivision which consists
of single family residences on lots that range between 11,000 and
, 'I 21,000 square feet. Similar residential development is located on
I the west side of 121st Avenue.
f 3. Site Information and Proposal Description
The property contains a residence which has a driveway on
Katherine Street. The house had an attached garage which has been
converted to increase the living area. The applicant proposes to
use the existing driveway and construct a detached two car garage
that conforms with the architectural style of the house. The
variance is requested to allow a 10-foot street side yard setback
and a 4-foot distance between the residence and the garage.
A solid wood fence with a 10-foot setback along Katherine Street,
is of the driveway. The proposed garage . situated
east he g_ will be
immediately south of the fence on the east side of the driveway.
The garage wit.. . l maintain an 18-foot setback from the rear yard
property line to the east.

The reviewing agencies and NPO #7 have no objection to the
proposal.

B. ANALYSIS AND CONCLUSION
In order to approve a variance, the criteria in Section 18,134.050 must
be satisfied. The proposed garage is consistent with these criteria for
the following reasons. The location of the garage is consistent with
all other applicable provisions of the Code, and its location represents
the minimum deviation from the setback requirements to alleviate the
hardship. The garage is allowed in the zone and the structure will not
encroach upon adjacent properties. Because of the fence which will be
in front of the garage, the garage should not have a significant visual
impact.
C. DECISION
Variance V 5-84 is approved subject to the following conditions:
1. The garage shall be located as shown on the site plan submitted by
the applicant. The garage shall have a minimum setback of 10 feet
from Katherine Street and 15 feet from the eastern lot line.
2. The existing driveway shall be utilized for the new garage. Any
modification r or relocation of the drivewa y must be approved roved by the
Engineering Division.
3. This approval is valid for the period of one year from the final
decision date noted below:

Thank you for meeting with me on February 24, 1984 for a pre-application
conference to discuss the new garage project I am proposing for my
residence at the address noted above.
Based on your review and our discussion of the proposed project, I am
submitting an application for variance to the zoning ordinance (Title 18) ,
The approval of this variance will allow construction of the proposed
building five (5) feet closer to the property line than is currently

The proposed location has the minimum impact on the existing site and
surrounding properties. The requested 5 ft, reduction in the setback ``
affects only one corner of the building and would not change the
existing amenities ( i .e. landscaping, driveway, screen fence).
Alternate building locations have a significant negative impact both to :''.
the applicant, adjacent property owners, and the general public that
travel along Katherine St. These alternatives would involve relocating f.
the existing driveway, removing most of the landscape buffer along
Katherine St., removing the privacy fence, and eliminating access to the
backyard from the driVeway. Other alternatives are prohibitive because
they conflict with existing public utilities in the right-of- way or
would require additional reduction in the setback than is requested.
' , Most other properties in this zoning district do not have the same
physical constraints or existing amenities which are beneficial to
retain.
3. The proposed use as a garage for parking Vehicles is currently allowed
in this residential district. All zoning and building codes
' requirements will obviously be met without hesitation. In most cases
extra measures will be taken to provide above—average quality ih the
• building and site improvements. This is consistant with the applicantts
approach historically, and the proposed project would not differ. Both •'

5. The hardship was created by previous owners of this property, and not
