The Director shall approve, approve with conditions or deny an application for a variance based on finding that the following criteria are satisfied: • proposed '.r 1. The variance will., not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies district or s; and to other properties in the same zoning and standards and di y. Staff Analysis - There is inadequate distance on the back of the site to include a 15 foot separation, two rows of parking, and one parking aisle. The factor limiting the size of the parking lot is Vanno Creek. Also, the carports cannot be setback 15 feet from the principal structure without eliminating a row of required parking stalls. The Development Code . requires covered parking for new multi-family housing. The Applicant's proposal would bring the use into conformity with the covered parking requirement, even though the • apartments were built prior to the requirement's adoption.. . '' 4. Existing physical and natural systems, such. ab but not �• limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified in the Code . Staff Analysis -, If the 15-foot separation was enforced, the applicant would have to construct a parking lot that would ' encroach onto the Fenno Creek floodplain. This course of action would require a Sensitive Lands permit. It is the ' intent of the Comprehensive Plan to restrict development Within the 100-year floodplain. The applicant desires to minimize construction which would require an expensive '1H retaining wall. 5. PROPOSED RELIEF That the required fifteen feet of seperation from a primary structure and an accessory building be reduced to ten feet. HISTORY The subject property is currently developed as a ninety-six unit apartment pro- . ject in the configuration of a compound. The site is bounded on the North and West by existing multi-family projects, on the South by existing single family residence;, and on the East by Fanno Creek and vacant commercial-industrial property. The main floor elevation of the dwelling units is approximately eight feet below the centerline grade of SW 76th Avenue and traverses the site more or less level to the grade of SW Bonita Road at its intersection point with Fanno Creek. The apartment buildings are of wood and masonry construction three stories in height. All parking is paved with ashaltic concrete and drained with a subsurface drainage system to Fanno Creek. All planting areas are landscaped and said landscapi ng is mature and cf significant size primarily consisting of evergreen trees and bushes. There is an existing continuous row of desi- duous trees 2-4 inches in caliper between the parking and Fanno Creek on the eastern portion of the site. In addition, the proposal allows for weather,protection and security through lighting, and provides for a pedestrian access that does not conflict with the established automobile circulation pattern. If authorized the relief will not be materially deterimental to the public welfare or materially • injurious to other property in the vicinity. ". , A-2 There are special circumstances that exist which are peculiar to the site over which the applicant has no control and which are not applicable to other properties in the same district. The site is relatively flat for a distance of 80 feet east of Building "C", then the site grade drops approximately 12 feet to the centerline of Fanno Creek. The existing parking layout and improvements are currently as close as six to ten feet from Building "C", THEREFORE, there is not adequate distance on the site to meet the re- quired fifteen feet of seperation to the proposed carports and at the same time provide an adequate traffic isle, retain the existing parking and land- scape areas and not interfere with the natural area adjacent to Fanno Creek.
