Co, Tax Map 181 34 AC, Tax Lot 2622) . DEcIgON; Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described application subject to certain conditions. The findioo and conclusions on which the Director based his decision are as noted below, P A, FINDING OF FACT 1. Background The city has not reviewed any previous land Use applications for the subject parcel. 2 Vicinity Information The pooperty is located within Englewood Subdivision NO, TXI and the surrounding parcels are also zoned R-4.5. 3. Site Information and Proposal Description ° ! Th4 parcel is presently occupied by a single family residence. The applicant proposes to add a solarium in the rear yard which dr will be attached to the existing strUCture, The southern corner of the solarium will be within 13 feet of the rear property line instead of the required 15 foot setback, 4, Agency and NPO Comments The 5ngineering Division and building Inspection Office have no objection to the proposal. No other comments have been received, b ANALYSIS AND CONCLUSION Section .0,134.050 of the dode requires the following approval triteria For Variance proposals; 1, The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies or the comprehensive Plan, to any other applicable policies and standards; and to other properties in the same 2oning district or vicinity; NOTICE Or OWISION VARIANOt V 4-05 — POE! 1 k 2, The are special circumstances that exist which are peculiar to the lot size or shape, . topography or other circumstances over which the applicant has not control, and which are not applicable to other properties in the same zoning district; 3. The use proposed will be the same as permitted under this Code and City standards will be maintaihed to the greatest extent that is reasonable possible, while permitting some economic use of the land; 4 Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be • adversely affected any more thah would occur if the developmoht were 1octed as specified in the Code; and J, The hardship is not self—imposed and the variance requested is the minimum variance which would alleviate the hardship. • The primary purpose of the setback standards for the R-4,5 zone is to • allow For adequate spacing, air, light, amd privacy for residential structures. The variance will not have an appreciable effect upon the existing properties in the area. A very small portion of the solarium will be within 15 feet of the rear property lino and the variance proposal is consistent with the intent of the setback standards contained In the Code. Because the location of the house, the applicant has shifted the solariUm to meet the setback requirement as muth as possible. In order for the addition to have a desirable configuration, the proposed , I variance is necessary. „ The residence is a permitted use in the zone and ail other aspects of the building will conform with the Code, The variance will have no effect upon existing physical and natural systems.
