Gentlemen:
Please be advised that the Tigard Planning Commission at their regular meeting
of July 17, 1979 approved your request with respect to cul-de-sac length, how-
, over, your requedt for variance to 40 foot street width was denied, based on the
following findings:
1. The inability of the applidant to develop the parcel without the
variande of cul-de-sad length has been demonstrated, which is an
exceptional or extraordinary condition.
2. That without the variance, applicant would be denied development
to the underlying zone.
3. That the variance will not be materially detrimental to the ptrpode
of the Title because completion of the street plan of the City will
reduce the cul-de-sac to acceptable length.
4. That the variance requested is the minimum variance necessary to
alleviate the hardship in deVelopment of the tear portion of the
lot.
In support of the denial of the variance in right-of way width, it is held
8. That the only harm that domes from refusing to vary the width of the
street is that only 14 instead of 15 lots may be placed on the pardel.

The Request
In conjunction with BARBEE' COURT, a proposed 15 lot R-5 residential
subdivision, a 40' right-of-way street standard is proposed° The findings below
show that there is good cause for granting the requested 10' variance from the
50' standard local street section.
FINDINGS
•
I. The property to be subdivided contains two existing dwellings. The
, i
r dwellings are n good repair and do not warrant removal. The proposed
subdivision (contingent upon zone change approval) is envisioned to have
15 single family lots; two of which will be at least 10,000 square feet in
area in order to support the existing dwellings: The minimum allowed
centerline radius on a local street is 100'. The relationship between the •
roadway and the western property boundary is tight because the existing
dwellings are to remain; a 100' centerline radius is required; and the
alignment of the street intersection with Greenburg Road is dictated by
r,. the 92nd Avenue alignments With 15' front and rear setbacks required,
Lot 112 suffers a hardship with only 23' of buildable depth if a 50' right-
, ,
of-way is required. Granting of the variance would increase the depth
of the buildable area to 28' without creating a substantial change from
the required roadway standard.
It should be noted that as shown on the prep)

SUPPLEMENTAL INFORMATION TO REQUESTED VARIANCE
BARBEE COURT PRELIMINARY PLAT
Barbee Court preliminary plat includes a cul-de-sac and stub street to
properties to the west of the site. The staff of the City of Tigard
Department of Planning has indicated that the street configuration may
not meet the terms of the 'present subdivision ordinance. The ordinance
appears to state that the cul-de-sac in the interim period before
continuation of the stub street westward is longer than permitted by the
ordinance.
While it is clear that cul-de-sac streets greater than 400' in length
are not permitted,, it is not clear in the ordinance language how
development of an incremental street pattern over a period of time
throughout a developing area is to be evaluated. Therefore, the staff
has indicated that there is a need for the Planning Commission to interpret
the ordinance in this subdivision request to determine the adequacy of
interpretation street configuration. The applicant request
