Please be advised that the Tigard Planning Commission at their regular
meeting of June 21 , 1977 approved your request for a variance to 17.44.
040 of the Tigard Municipal Code proposing that the sidewalk be construe-,
.*11 ted adlacent to the curb at 9830 S.W. McKenzie Street. This approval
is subject to the following conditions:
1 . The sidewalk shall be located contiguous to the previously approved
curb line.
2. The sidewalk shall be four feet wide, when measured from the face of
the curb.
3. The Sidewalk shall meander, when necessary, around existing trees;
easements to be provided, where neceSsary, by the developer.
4. The sidewalk Shall conform to City standard specifications in all
respects, except as noted above.

Density and zoned A-2) Multiple Family. Surrounding land
uses are apartments to the west ) a parking lot to the north,

and to the south a house and lumber yard.

T.I . FINDINGS OF FACT:

2. On December 14, 1976 the. Design Review Board approved a re-
quest for a ten unit apartment complex on the subject site.
3. There exists along the northeast property line several large
conifers. These trees would have to be removed if sidewalks
are to be built to code

In the matter of Mr. Ralph Jo Peter's variance request, it
is herewith recommended that adjustment of a previously approved
sidewalk be permitted; such adjustment to be subject to the
.1' following conditions:
1) The sidewalk shall be located contiguous to the
previously approved curbs line.
2) The sidewalk shall be four (4) feet wide, when
measured from the face of the curb.
3) The sidewalk shall meander) when necessary, around
• existing trees; easements to be provided, where
necessary, by the developer.
4) The sidewall( shall conform to City standard specifications
in all respects, except as noted above.
Site inspection of the proposal discloses no foreseeable
negative aspect should the commission. choose to affirm said
request. Frankly, existing building orientation along McXenzie
Street, particularily at the Pacific Righway terminus thereof,
precludes construction of sidewalk anywhere other than adjacent
to the turb.
