This is to inform you why Washington County has created
tax lots on the south five feet of Lots 1 , 8, 9 and 10 of
the Plat of Solarcres.
These lots were created due to a Trustee's Deed recorded
February 27, 1985 as document number 85-6749 to the 1
Benjamin Franklin Federal Savings and Loan Association.
It included all of the plat of Solacres except the south
5 feet. Therefore, we had to split the ownership.

criteria for a Conditional Use, Planned Develoment, and Variance, He
explained that the applicant had done extensive investigation regarding
location, visibility, good access, 'compatibility, and topography and this
site moot all their needs, This use would create less traffic than any
general commercial which would in them a good neighbor, They had
exceeded most of the buffering reqUirements. They had reviewed the staff
report and had no objections and he was available to answer questiono Neal Conser, 18858 Aftegheny Cr, , Oregon City, OR, 07045, reviewed past
projects that they had constructed, He showed a &awing of the proposed
• mini—storage, stating that this would be a high quality project and
constructed with brick, He had met with NPO # 6, the Summerfield
Association . and Tualatin Development Company who all supported the
project, He submitted a folder of pictures of the area and letters
supporting the project, He read into the record a letter From IOC and
reViewed the landscaping which is being proposed, He requested that the
Commission approve the proposal,

VARIANCE V 17-85
APPLICATION: Request by Benj. Franklin and Tom Miller to adjust three parcels
of 7,500, 8,165, and 7,931 square feet into three parcels of approximately
8,403, 7,732, and 7,461 square feet and to allow a variance to the minimum lot
size requirement of 7,500 square feet on property zoned R-4.5 (Residential,
4.5 units/acre) and located within Solarcrest Subdivision, a southwest corner
of Elrose St. and 97th Ave. (WCTM 2S1 11BA, TL 4900, 5600 and 5700.
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has approved the above described application subject to certain
conditions. The findings and conclusions on which the Director based his
decision are as noted below. ;,.�
A. FINDING OF FACT
1. Background
Solarcrest Subdivision was approved by the City in 1980 (S 6-80)
and the plat has recently been recorded.
2. Vicinity Information
The properties to the north and west are undeveloped lots within
rr '
Solarcrest Subdivision. Single family residences on large lots
lie to the south and on the east side of 97th Avenue.
3. Site Information and Proposal Description
Lots 1 and 8 of Solarcrest Subdivision are undeveloped and Lot 9
includes
a residence that was built on the property prior to the
subdivision. A foreclosure occurred related to the development of
the property. The underlying ownership and financing of the,
subdivision consists of two parts. The southern 5 feet and Lots 9
and 10 and the remainder of the subdivision are legally regarded
as separate entities with different liens applying to each.
Since the problems relating to the foreclosure will not be
resolved for some time, the app requesting the lot line •
e applicant is re e l
adjustment in order to allow the majority of the subdivision to be
developed (Lots 1-8t 11 and 12) in the near future.
The proposed lot line adjustment' will reduce the size of Lots 1
andn
8 by transferring the southerly five feet of those lots to Lot
. The size of Lot I will be reduced below 7,500 square feet and
therefore a variance request is also required.
4. Agency and NPO Comments
The Engineering and Building Inspection Division have no objection
to the proposal.

B. ANALYSIS AND CONCLUSION
•
After the lot line adjustment is implemented, Lot 9 will include a 5
foot wide strip extending to 97th Avenue and Lots 1 and 8 will be
reduced to 7,461 and 7,732 square feet respectively. Except for the
necessary variance to reduce one of the lots below the 7,500 square foot
minimum lot size, the proposal is consistent with City Code } ,
requirements. Although the creation of the 5 foot strip is not ideal,
it appears to be the only solution available to initiate development of 1•
the subdivision in a timely manner. It should be made clear that the 5
foot strip attached to Lot 9 shall not be used for access and the City
will expect this strip to be maintained as required by Section 7.40.020
of the Tigard Municipal Code. The City would be receptive to a future
lot line adjustment proposal to eliminate the 5 foot i§trip. .'
Because this proposal will create one lot that is smaller than the �.
minimum lot size of 7,500 square feet for the R-4.5 zone, a variance
approval is necessary. Section 18.134.050 of the Community Development
Code contains the following criteria which must be addressed before a
variance may be granted. -
1. The proposed variance will not be materially detrimental to the

purposes of this Code, be in conflict with the policies of the
Comprehensive Plan, to any other applicable policies and
standards; and to other properties in the same zoning district or
vicinity;
:. 2. There are special circumstances that exist which are peculiar to ,
the lot size or shape, topography or other circumstances over
which tie applicant has no control, and which are not applicable
to othe.x properties in the same zoning district; q
3. The use proposed will be the sag, as permitted under, this Code and
City standards will be maintainew to the greatest extent that is
reasonably possible, while permitting some economic use of the
land; ..

traffic, drainage, dramatic land forms or pattts will not be
adversely affected any more than would o u.r' 1,4' the development

5. The hardship is not self-imposed and the variance requested is the
minimum variance which would. alleviate the hardship:
The.. pr3.irary purpose of the minimum lot size of the R-=4.5 zone is to provide a
control /tor housing density and spacing between buildings. This proposal will

merely shift a small amount of square footage from one lot to another and will
have no effect upon the overall density of the subdivision.
The legal problems mentioned' earlier in this report have necessitated this
solution• The 7,500 square foot mi lmum could be obtained for Lot 1 but an
irregular lot configuration would result. The proposed residential uses
proposed lot conform Code requirements and the e, size of Lot
(7461 square feet) is only 39 square fe et under square foot mini m

It appears that the following events took place on or about these dates !
4/12/82 City of Tigard Sewer liens were assessed against Tax Lot 1000
8/18/82 Assesment for street improvements liened Tax Lot 1000 .
10/4/82 Loan from Ben Franklin was documented & ready for recording
(Mary Burnham borrower)
10/6/82 Trust deed securing said loan on Tax Lot 1000 was recorded.

4/2/84 Mary Burnham took title of the five feet South of the Solarcrest
Subdivision & added onto said subdivision.
4/9/84 Plat of Solarcrest is recorded. Said plat is signed by Mary
Burnham but was not signed by Ben Franklin. Mary agrees to dedicate
the use of public right of way forever, but has Ben agreed????'??
Judging from the sequence of above dates it would appear
that the City does not have any liens on the S. 81 as their
assessment took place prior to Mary, taking title.
