APPLICATION; Request by James Mitchell for a variance to allow a 17 foot
front yard setback fora garage where 20 feet is required on property zoned
R-7 (PD) (Residential, 7 units/acre, Planned Development) and located on
Copper Creek Drive, Lot 141, Copper Creek Phase IV' (t.JCTM 2 i 14BA, T.L, 13600) .
DECISION; Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described application subject to certain
conditions. The findings and conclusions on .which the Director based his
decision are as noted below.
A. FINDING OF FACT
1, Background
No previous land use cases have been reviewed by the City
regarding this lot in Copper Creek subdivision.
2, Vicinity Information
The property to the north, west, and south is zoned R-7 (PD) and
the area to the west is zoned R-4,5 (Residential, 4,5
units/acre) , the entire area surrounding this property is
committed to singia family residential development,

Site+ Sate Information and Proposal Description
The property is undeveloped and the applicant wishes to construct
a single family residence, The lot ha,s an irregular shape and the
applicant is proposing to meet all applicable setback standards
except for the 20 foot requirement between the garage and the
street right—of—Way, The garage setback will vary between 17 and
20 feet,

The Engineering and Building Inspection pivisions have no
objection to the request,
The NPO will receive a copy of the decision and have the
opportunity to appeal,
B, ANALYSIS ANA CONCLUSION

1, The proposed variance will not be materially detrimental to the
purposes of this Code, be in conflict with the policies of the
Comprehensive Plan, to any other applicable policies and

standards; and to other properties in the same zoning district or
vicinity;
2, There are special circumstances that exist which are peculiar to
the lot size or shape, topography or other circumstances over
which the applicant has no control, and which are not applicable
to other properties in the same zoning district;
3. The use proposed will be the saw as permitted under this Code and
City standards will be maintain(d to the greatest extent that is
reasonable possible, while permitting some economic use of the
land;
4, Existing physical and natural systems, such as but not limited to
traffic, drainage, dramatic land forms or parks will not be
adversely affected any more than would occur if the development
were located as specified in the Code; and
5, The hardship is not self—imposed and the variance requested is the
minimum variance which would alleviate the hardship,
The primary purpose of the 20 foot front yard setback for the garage is
to provide private parking which will not encroach upon the public
sidewalk, the proposed 17 foot setback for one corner of the garage
will provide sufficient space oh the driveway to accommodate most
private vehicles, The City standard for the length of standard and
compact parking spaces of 18 and is feet support this finding, The
variance will hot have ah appreciable effect upon the existihg
properties ih tho area, A V4ry Mail portion of the garage will be
within 20 feet of the front property line and the variance proposal is
consistent with the intent of tht setback standards contained ih the
Code.
In consideration of the lot configuration, the applicant has shifted the
house to meet the setback requirements eut much as possiblo, rh ordor
for tho house to have a desirable floor plan, the proposed variance it
hOdossaq,
The residence is a permitted use in the zone and all other aspects of
the building will conform with the Code. The variance will have no
effect upon existing physical and natural systems,
