B ANALYSIS AND CONCLUSION
Accessory structures are allowed outright in residential zones with a
maximum area of 500 square feet and a height of 12 feet, A variance
which meets the criteria contained ih Section 10,134.050 of the
Community Development Code must be granted prior to constructing a
larger building. The relevant criteria are listed below
•
1, The proposed variance will riot be materially detrimental to the
purposes of this Code, be in conflict with the policies of the
\, Comprehensive Plan, to any other applicable policies and
standards; and to other properties in the une zoning district or
• vicinity,
2, There are special circumstances that exist which are peculiar to
the lot size or shape, topography or other circumstances over
which the applicant has no control, and which are not applicable
• to other properties in the same zoning district;
3 The use Proposed will, be the same as permitted under this code and
City standards will be maintained to the greatest extent that is
• reasonably possible, while permitting some economic use of the
land;
• 4. xisting physical and natural systems, such as but not limited to
•
traffic, drainage, dramatic land forms or parks will not be
• adversely affected any more than would occur if the development
• were located as specified in the Code; and
• 5. The hardship is not self—imposed and the variance requested is the
minimum variance which would alleviate the hardship.
The primary purpose of the size and height restrictions for accessory
structures is to prevent the location of large structures in close
• proximity to residential uses. The proposed building will be larger and
taller than permitted by the code but the building will have twice the
required setback (10 rather than 5 feet) from the north and west
property linos. Also, there is a considerable amount of vegetation on
the subject property and surrounding parcels which acts as a visual
buffer. Finally, the residences on the nearby parcels are over 100 feet
from the proposed building.

designatioh, an attached garage would not be permitted, Also, the
Historic District requires that buildings on the property be consistent

We are requesting a variance for the construction of a detached
garage on the above described property. Per the agreements made with
the city of Tigard regarding the assignment of an historic district
•
to the property an attached garage is not permitted and would be
inappropriate to the historic significance of the property.
•
We wish to build a three car garage with workshop space for
maintenance and storage purposes. The space requested is less than
what would be allow if an attached three car garage were permissable
and appropriate and we were also to build an "accesssory6 building
• of 500 sq feet which is permitted without Variance on our 1:24 acre
lot.
Our variance request is for both additional square feet and height.
'' ' At the hearing regarding the historic designation we testified that
we wished to build the subject garage and we desired that it be
architechturally correct to the vintage of the house, This Was
approved and the historic designation states we be allowed to build
the garage.
As Can be seen from our drawings we wish to build a garage that has
the appearance of a turn of the century carriage house/livery
stable. In doing a great deal of research and discussing our ideas
with a`r architectural historian we feel this best represents the
style that would have been build at the time the house was built.

35 feet high with the main eves at about 20 feet with a 10/12 pitch
roof. The size of the proposed building is also consistant with
accessory buildings of the period.
We are proposing a 1008 square foot building w4i.h an average height

general appearance of the building would be horizontal lap

siding to match (as close as practical ) the outside appearance of
the historic house. On the South shop wall we are considering a
terra.-coca facing so prevalent in out-buildings at the turn of the
century. Small paine windows would be used.
The proposed building would house our three cars plus allow room for
maintenance, additional storage, and display of historically
significant articles of the area given to us by long-time residents
• as their thanks to us for saving this historically significant
house. Had we not moved it, it would have been destroyed by the then
owners of the property. We feel the garaging of the car rs is an
enhancement to the property and in fact our insurance policies
require it and they have overlooked the garaging as we promised we
would be building the garage this summer. With the DEQ burning ban
we have been forced to get a hardship burning permit to help get rid
of the enormous amount of natural debris from the property. While
the plot plan indicates a large portion of the propery as 'natural"
• it is a controlled natural so as to be good neighbors, reduce fire
danger and in general give the property a park-like look that our
' neighbors have complemented us on. This is going to require the
• purchase of a good sized grinder/chipper which doe to its size will
require storage in the garage, A lot of this size requires a good
deal of equipment and the equipment requires its own maintenance,
which we do ourselves:
Since establishing residence at this property, We find we stay home
a good deal more as we have a good deal of the ementities that most
people have to go to the national for,rests etc, to get. We are avid
do-it-yourselfers having done the majority of the house restoration
ourselves and enjoy the lifestyle this property gives us; We feel We
are goad neighbors and have, in fact,, enhanced the surrounding
neighborhood. Some of the neighbors have volunteered testimony
should we need it.
The proposed building will be, directly viewable only by tax lots
2000, 1900 and 1800 and that view is severely restricted by numerous
trees that surround it. Tax lots 8500, 8700 and 8500 have extremely
limited' views due to all the other large trees on the property. All
other lots have no view due to trees, our house and/or topography.
No One' s view of any significant land feature would be blocked by
the proposed variances. In addition We carefully positioned the
..,, house to provide the minimum impact on the surrounding lots and the
setbacks for the house are approximately 35 feet on the north1125
feet on the west, 225 feet on the at and 50 feet on the south.

In conclusion We feel this variance is appropriate to the intent of
the code, the historic significance of the house and to the area in
general . We feel it will be a marked enhancement to the property
with nd negative impact to the surrounding neighbors,, thus

13, 1984, Planning Commission Hearing, Information supporting the
request is found in Planning Department file number ZCHD 17-04, The
property owners supported the Staff recommendation, No other persons
appeared to testify,
Based upon the record of this case, the Commission makes the following
FINDINGS:
• 1 , The relevant approval criteria in this case are Statewide Planning
Goals 1, 2 and 5, Comprehensive Plan Policy 347, 1 and Community
Development Code Section 10,02.010 and 10,02.030,
2. Statewide Planning Goal 1/1 is met because the city has adopted a
Citizens involvement program including review of all deVelopmeht
applications by the Neighborhood Planning Organization (NP0) , In
addition, all public notice requirements Were met,

The former Charles Tigard house, built in 1909, is one and one half stories
high. Its irregular roof line is formed at the intersection of the front

on all facades. The front entry door has three square panels above two

Char' s F. Tigard, and his wife Rose, were well known and respected residents
. of Tigard . Born in February 1862, Charles was the seventh child of Mr. & Mrs.
. Wilson Tigard. With the help of his mother, Charles established the first general

18864 He used the name Tigardville post office to honor his father, Wilson Tigard.
A larger store was built across Pacific Highway on the NE corner of McDonald Street
