A request by Benol, Inc. for a variance of the front yard setback
requirements in a C-3 zone (general commercial) section 18.28.040
of the Tigard Municipal Code, for additions to the Safeway store
(Tigard Shopping-Pra'Za)' at--260,Tigard Plaza (Washington County
tax map ISI 35DD, tax lot 2100)
STAFF FINDINGS
• D
1. Existing Safeway store is built on the property line along
Hall Boulevard and proposed addition would extend the building
an additional 56 feet from the present 128 feet to a length of
184 feet along Hall.
2. The 10' front yard setback in the C-3 one plus the 40' center-
line setback for Hall Blvd. would make the minimum legal setback
from the property line here 20° .
3. Parking ratio proposed is 2.7/1000 square feet gross lease area
for the whole project, assuming full occupancy (a portion of
the shopping center, about 20,000 square feet, has never been
completed or occupied).
4. According to typical standards, Tigard Plaza has, about the
minimum parking space that it can stand, although it has
far more than Tigard's minimum standards require. It is staff's
opinion that Benol could safely reduce its number of parking
• spaces by 10 to 15 percent without creating a parking problem.
Also the parking areas, as presently designed are wasteful
of space and could be redesigned to accomodate as many or more
automobiles as well as landscaping.
5. Minimum landscaping requirements are; 101 land, lape setback
from front property line, major landscape feature (shade tree)
70 feet on center (both ways) in parking lot, 2 landscape
buffer and sight obscuring fence or hedge between parking and
adjacent residential areas, and, a minimum of 15% of total
lot area must be landscaped,

RE: Application for Variance to Zoning Code for Safeway Store •
-Addition at our TIGARD SHOPPING PLAZA •
Gentlemen:
•
We respectfully request your approval of the above. The following are pertinent
facts and our reasons for this application:
1. Safeway Stores have been the prime tenant in our centre since it was completed
in 1962. They find that their business has expanded to the point where they must
increase the size of their store to handle their present and future requirements.
They therefore requested that we provide additional space of approximately 10,000
square feet, so we have arranged to purchase sufficient additional property to
accommodate their requirements. The only way we can do this is to add a small
addition at the front and a larger addition at the rear and both additions are
required to be at the property line, to line up with their existing space which
is and has always been, on the property line. The present zoning of both our pro-
perty and the property we have purchased is C-3, which, if we were planning a new •
project, would apparently require a setback from Highway 217 (Hall Boulevard) of ten
feet. While we consider this a "side yard") which would require no setback techni
cally it apparently must be considered a "front yard", so we request that you
grant us approval to build the additions with no setback.
2. Conditions of our application do not apply generally to other properties in
the same vicinity.
3. We believe our variance request is necessary to protect our property, and is
reasonable. In fact, to involve a setback now, would create an unworkable building
for commercial purposes.
4. Authorization of this variance will not be contrary to the purpose or intent
of the zoning code; nor will it cause or allow injury or detriment to other properties .
In the same zone or vicinity, because the completed addition will be at the same
property line location as the existing building. Purthermore) after discussion
with the Planning Department) our variance application seems reasonable and will
not be contrary or detrimental to the intent or objective of any City plan or policy.

3. APPROVAL OF MINUTES: The minutes of February 17, 1976, were

o Mr. Sherr stated that there was a need in the community
for an establishment of the nature he proposed; that
his establishment would provide a service needed in
the community, particularly to the youths. He stated
there were 18 parking spaces in front of his building
and those spaces were adequate for their needs.

end operation of the flea market would conflict with
the proposed billiard parlor in that their peak
operation hours would coincide.

that site as he had never seen a deficit of parking
availability.

posing, what his hours of operation were, what
signing he would use and if he had looked for alter-

opposed to the duplex.
o Mr. Paul Johnson opposed duplex construction as being
detrimental to the neighborhood.
o Don yeller, SW Frewing St. , stated that he felt
duplex construction was not necessarily detrimental,
but that development of the area, with only one
access (Frewing) was undesirable.
o Russ Austin, Building Official for the City of Tigard,
stated that he was opposed to the proposed duplex.

Gentlemen:
We respectfully request your approval of the above: The following are pertinent
facts and our reasons for this application:
1. Safeway Stores have been the prime tenant in our centre since it was completed
in 1962. They find that their business has expanded to the point where they must
increase the size of their store to handle their present and future requirements.
They therefore requested that we provide additional space of approximately 10,000
square feet, so we have arranged to purchase sufficient additional property to
aaccommodate their requirements. The only way we can do this is to add a small
