In order to accomodate a 30' set hack plus an added 10'
of road right of way, we must set back along the property

line adjoining the S.P. right of way a full 60 as
measured from the existing corner. Under normal
conditions the set back would only be 40' . We are
being penalized because of the lot shape and unless
a variance is granted will be unable to make the best
reasonable use of the remaining land.
The granting of this variance would not damage any other
property owners. The main need insofar as the public is
concerned is to provide adequate land for future etreet
improvement and a set back to assure good visability
when approaching the railroad. Because the road
approaches the tracks at such a wide angle (approx-
imately 1,18°) it would seem unnecessary to provide a
full 30' set back for this purpose, Also the tracks
are 60' beyond our building which helps alleviate this
need. It also would appear that a 120' right of way
(including set backs) is more than would be reasonably
necessary for future planning for Hall Blvd.
We are asking for a minimum variance of approximately 8'
to allow the main structural parts of the building to be
built in a normal fashion without having to have special
trusses built. Even so, it will be necessary to cut
•
off one corner of the building to maintain the maximum
set back possible.
The plot plan and cut of the area in question should
indicate our problem, We respectfully request your
consideration of our immediate needs, "

• The staff finds that Section 170-4 of the Zoning
Ordinance requires 30 feet of setback from the front
property line for M-3 uses. Section 210-8-d requires
an additional setback of 30 :feet measured from the
centerline of Hall Blvd .
The staff further finds that the adopted Tigard
Community Plan designates Hall Blvd as an arterial
with a proposed right-of-way width of between 80 feet
and 120 feet. The existing rieht-of-way width at the
subject site is 40 feet, Future wideniLg and improvement
of Hail Blvd. will probably require substantial changes
in alignment.
The proposed setback would in effect set aside the
additional setback requirement under Section 210-8 and
allow development under M-3 setback standards. If
the Hall Blvd, rig4ht-of-way was widened to 80 feet by
taking 20 feet from each side, the proposed addition
would have a setback of 10 feet from the front property

the subject property.
Approval of the request would grant the applicant a
privilege not available to other property owners
within the same district.

Gentlemen,
I am enclosing an application for a variance in the amount of set back
required fronting on S.W. Hall Blvd. between S.W. Commercial and the Southern
Pacific right of way. We are planning to construct a building on the remain-
ing unused land at this location. The building is to be used to alleviate
overcrowded conditions in our warehouse and Door assembly area.
I am applying for a variance because the remaining land that fronts
on Hall Blvd. is limited and should be fully used now to best advantage. The
land in question is not regular in shape. Our buildings are parallel to the
S.P. right of way and Commercial St. Hall Blvd. crosses the S.P. right of
way on an angle, which, measured at the corner of our property is approximately
138°. Tf, order to accomodate a 30° set back plus an added 10' of road right
