CITY OF
Tigard, Oregon
Gentlemen:
f RE: Notice of Public Hearing
', I am attaching a photo copy of the Notice of Public Hearing that I
received, and as the property owner which has property adjacent to
this proposal, T would want to indicate that I am against the said
proposal.
We ask that the people residing in our residence attend this meet-
ing and voice that we are against this proposal:
These kind of access variance should be acquired before the approval
of such a building project was approved by the City of Tigard. Its
too bad that after a large multi-family residence was established
comes in and then expects other property owners to give up land that
they have purchased and have paid taxes on the past few years over
as free gratis. If Leonard Cason and Walter West are Willing to buy'
the land that they are trying to come by insuch a manner, I'm• sure
that some of the property owners would be happy to discuss this with
them.
As a property owner this will advise that I am against these access
variance in this area. Again I would point up that the City of
,.' Tigard should have some responsiblity in protecting the rights of
property owners and trust that such a building Will not be permitted
to be built on land that is not adequate to provide ample parking as
• ` well as driveways in the future,
•
Sincerely,
J

Approval of an access variance to facilitate the expansion
of an existing apartment complex from 68 to 128 dwelling
requires a minimum of
Ordinance re
units. The Tigard Zoning q
50 feet of right of way width (36 feet of pavement and.
curbs) to serve between 50 and 100 apartment units. The
subject site is served by a driveway 25 feet in width.

Property
f
The subject property is zoned A--2, Multi-family Residential
and is located on the north side of S. W. Pfaf ale Street
approximately 150 feet west of Hi ;hway 99--WW.
Surroundin Zonin and Land U'se
The area surrounding the property
... subject to the west,
north and northeast is zoned R-7, Single Family Residential.
Lots located along S.W. 78th Avenue to the west are developed
with single family dwellings, The 0-2 and 0.3 General
Commercial parcels to the east and south support a contractor
and a lumber yard.
A, ,plicant'ss justification
. " r
We request a Variance on the accompanying application for the
following reasons:
p: r _ impression
.. essi .. , ^` . s
1. Hardship: We were under the zm ressionr this variance
g . , ..rst permit and have built
had been. . rented under our first
on to the access area required under the Bode:
2. Precedent: The planners for City of Tigard evidently
felt as we did for three more permits have been issued
on the sale master plan since the original permit was
f. .
issued.
•
3. Conflict: This is our own access and will in no way
conflict with neighbors.

4. Uniqueness: This' s is a narrow piece of property and though
code access would not have been impossible, it would have
been extremely impractical.
5. Street Access: Pfaffle Road which is our street access,
is presently narrower than our own.
_r g p .
We are willing to comply conditions you may ask for
y with any condit ons y
under the present circumstances of the property. "
Staff Pindin s and lecommendation
The
the findings reveal that previous building permits
•
he subject apartment complex were issued without the development having the minimum access requirement under
Section 200-2 of the City of Tigard Zoning Ordinance. The
existing driveway meets the minimum access standard for
only 19 apartment units.
The staff further finds that the variance request is in direct
conflict with the intent and purpose of the Zoning Ordinance,
and that approval of the request would
pp . q uest grant a speczal privilege
not available to other
•. property owners within the same district.
It is recommended that the request be denied.

Re: Access Variance
Dear Sirs:
e request a Variance on the accompanying application for the 1
foflo ing reasons:
• 1. Hardship: We were under the impression this varia ce had been
granted under our first permit and have built On to the accuse
area required under the code
2. Precedent: The planners for City of Tigard evidently felt as
we did for three more permits have been issued on the sane Master
plan since the original Permit was issued
•
3 Conflict: This is our own access and will in no way conflict
• with neighbors.
q' • This is property d though code
tni o.eness. e narrow piece of pres era an
access would not have been i,mpocisiblea it would have been
extremely ir+mpract cal.
. Street Aaceas P
affle Road which is our street access/ is
Presently narrower than our own»
e are wtll ng to comply with any conditions you may ask for under
the present circuMstancei of the property.
