AGREEMENT OF TEMPORARY WATER CONNECTION
We, the undersigned, Eugene F. Tienken and Katherine N. Tienken, deeded owners of
the described property herein, do hereby agree and consent that the meter install-
, ation is a temporary connection only and is for our immediate convenience.
It is further agreed that if and when a line extension is laid on the present ease-
ment road paralleling the southerly frontage of the property described below, that
we, the undersigned, will pay our fair share of the total cost of the line extension.
This is a covenant running with the property.
A tract of land in Section 8 Township 2 South, Range 1 West, Willamette Meridian,
Washington County, Oregon, beginning at the Northwest corner of that certain tract
of land conveyed to Raymond V. Meyer and Mary Jane Meyer by deed dated April 3,
1962, and recorded in Book 460 at Page 463, Deed Records of Washington County,
Oregon, which point is West 683.55 feet from the East quarter corner of said Sec-
tion 8: thence North 89° 54' East along the North line of said tract so con-
veyed 198 feet to a point; thence South parallel to the West line of said tract
so conveyed as described in Book 460 at Page 463, 330 feet to the South line of
said tract; thence West along the South line of said tract 198 feet to the
Southwest corner of said tract as described in Deed Book 460 at Page 463; thence
North along the West line of said tract so conveyed 330 feet to the pot of

In my Administrator's Report I refer to the fact that there
are only 13 outstanding agreements for temporary water connections.
You have one of them.
Now I do not know whether you incurred this liability or
not when you bought the property, presumably from Tienken, but
the liability is there.
Such temporary connection was authorized in 1970 because it
was impracticable to extend the main the entire length of the
easement road from SW 150th Avenue. It could have been done but
it would have been a hardship on Tienken. (and your next door
neighbor to the east who also has this liability).
If you have problems with this matter, you are not alone.
We should just never approve such connections.

Dear Bob:
I have your note dated January 8, 1988, regarding my service connection
to the District main on 150th. I am aware of Tienken's covenant with the
District. Since then, several things have happened of which you may not be
aware.
Tienken at that time was building on an easement. Tienken's property
did not abut 150th (300 and 400 as shown on your copy of the old tax map).
Chadwick owned 600, 500 and 700. I bought 500, 600 and 700 from Chadwick,
and resold 600 and part of 500 to Thomas. I consolidated part of 500, 400
and 300 into one tax lot and own that tax lot (300) and own 700. My property
now, therefore, abuts 150th. My meter and my service line are therefore both
located on property owned by me which abuts an existing main. The only prop-
erty that does not now abut 150th that is served by the 150th main is 200
owned by Lane and Kathy Wilton. They have an easement across my property.
As the District has now installed a main through tax lot 100 being pur-
chased by Lane and Harriet Wilton, 100 no longer needs to be served by a
service line from 150th. Further development of tax lot 100 would be served
from that line. If a main were extended to serve tax lot 200, that extension
would logically and economically seem more likely to be installed between the
main installed through tax lot 100, rather than a main all the way from SW
150th.
I have not yet consolidated tax lot 700 with tax lot 300, but can do so
at any time now that the Chadwick contract has been paid in full and I have
received a deed. I do not currently plan further development of tax lot 300,
nor, to my knowledge do Lane and Kathy Wilton plan to further develop their
acre (tax lot 200).
