We, the undersigned, Thomas N. CASEY and Clara M. CASEY,
husband and wife, deeded owners of the described property
herein, do hereby agree and consent that the meter to be
installed on or about this date to serve our property at
16100 S. W. 128th Avenue, Tigard, Oregon (Map 2S 1 16A,
Tax Lot 102) is a temporary connection only and is for our
immediate convenience.
It is further agreed that if and when a water main extension
is installed along any thoroughfare, public or private,
paralleling any side of the property described below, that
we, the undersigned, will pay our fair share Of the cost of
the pipeline extension and expense of meter relocation.
This is a covenant running with the land.
Legal Description
Beginning at a point that is S 0 07' 14" E 203.15
feet and S 89° 28' 30" W 568.66 feet from the sec-
tion corner common to Sections 9, 10, 15, and 16,
T2S, R1W, W. M., Washington County, Oregon; thence

Ladies and Gentlemen:
It has been brought to our attention that Mr. Forsman has
allowed the Casey's and Warr's, several years ago, to connect to
his domestic water system via a meter located at 12830 S. W. Beef
Bend Road. This is totally illegal and will not be condoned.
Mr. Forsman is fully aware of the proper procedures to obtain
water from Tigard Water District. We have been more than coopera-
tive with him in the past so that he could be provided with water,
not only to his present home, but with a temporary connection to
the Smith property at 16230 S. W. Beef Bend Road. (formerly owned
by Mr. Forsman).
One should be aware, first, of the proper procedures to obtain
water service. Normally, a pipeline (main) must be installed in
front of one's house. (at owner's expense). This can amount to
thousands of dollars. Everyone, one way or another, pays for the
main in front of his or her house. When one purchases a house, he
pays or will pay for the main at some point in time, usually in-
cluded in the mortgage payment.
Now, in unusual circumstances, or when severe hardship results,
the district can authorize (in writing) that a temporary connection
be granted and a main not be installed until a later date. These
cases are few and far between and, as a general rule, the district
requires that a main be installed. It should be fully understood
that this is no small favor granted by the water district.
Re: Illegal Water Connections

Prior to granting a temporary connection, the home owner
must agree to pay his fair share of a. pipeline extension across
one side of his property at some future date, when and if such
main is extended. This deferral is a bonanza for the recipient(s).
The customer enjoys all the benefits of the water system, but is
not required, at this time, to fully pay for those benefits.
From the water district's viewpoint, the practice of granting
temporary connections is ill- advised. First, the home owner re-
ceives no fire protection (fire hydrants). In subsequent years,
when it is time to "pony up" money for the main extension, the home
owner balks. (because, supposedly, the water district is being un-
fair). He is quite happy with the arrangement "as is" with no
further investment. However, the water distribution system is made
up of successive property owners paying their fair share for a
water main. If it had not been for others up the line paying for
a main installation, no water would be available to you, today.
In the case at hand, it would be within our right to discon-
tinue all water service to the Forsman's for the flagrant violation
of the rules and regulations of the water district. Any such future or
continued conduct will result in such action taken. Actually, a
severe financial penalty should be imposed, at this time, because
the water district has been cheated out of hundreds of dollars in
user fees. This is so because user fees also include a minimum
charge which is not the case when three houses are served from one
meter.
We are not here to treat people unfairly or without regard to
health and the necessities of life. I have visited your home sites
and feel it would be an injustice to require that a (6 -inch) main
be installed to the most southerly point of Warr's property on S. W.
128th Avenue. The cost would be prohibitive. Secondly, no one
knows for sure if 128th Avenue will be the exact thoroughfare in
that area in the future. Consequently, the district will allow both
the Casey's and Warr's to connect to the system with a temporary
meter.
Therefore, to obtain water from Tigard Water District the
following action must be taken by the Casey's and Warr's:

1. Come to the office and. purchase a 3/4" meter for $775,
along with signing an application card.
2. Sign a temporary connection agreement (see attached
document) which states that each of you agreesto pay your pro -
rata share if and when a main is installed across one side of
your property. This document will be recorded.at Washington
County. It must be notarized.
Meters will be installed by the water district at the corner
of S. W. 128th and Beef Bend Road (adjacent to Brad Smith's).
It will be your responsibility to install service lines between
the meter and your homes. Also, you must disconnect the present
service line to the Forsman's.
Each of you is hereby granted thirty (30) days or until
September 30, 1983 to accomplish the above.
