The second party shall have all rights of ingress and egress to and from the real estate (including the right from time to time,
except as hereinafter provided, to cut, trim and remove trees, brush, overhanging branches and other obstructions) necessary for the
second party's use, enjoyment, operation and maintenance of the easement hereby granted and all rights and privileges incident
thereto.
Except as to the rights herein granted, the first party shall have the full use and control of the above described real estate.
The second party agrees to save and hold the first party harmless from any and all claims of third parties arising from the sec-
ond party's use of the rights herein granted.

be made so that this agreement shall apply equally to individuals and to corporations. If the undersigned is a corporation, it has caused
its name to be signed and its seal, if any, affixed by an officer or other person duly authorized to do so by its board of directors.

We, the undersigned, William E. Richardson Jr. and Sharon
Richardson, husband and wife, and Harlan Siebert and Barbara F.
Siebert, husband and wife, fee title holders of the described
property herein, do hereby agree and acknowledge that the water
service to 13045 S.W. Pacific Highway via a common meter at 13055
S.W. Pacific Highway is a temporary connection only and is. for our
immediate convenience.
It is further agreed that when all or any .portion of said real
property is sold, assigned, transferred, or conveyed, we will pay the
purchase price and the cost of installation of a new meter, at the
amount prevailing at that time, to serve the house at 13045 S.W. Pacific
Highway.
This is a covenant running with the property.

c On or about April 14, 1975, the owners of the subject
property executed an agreement of temporary water connection
so that two houses could be served from the same meter.
Normally, each house has its own meter, A copy of the agree-
ment is attached hereto.
At the time of execution of the agreement, it was be-
lieved that each house would be sold individually at some
future time and another meter would be necessary. However,
this is not the case, as Midas Muffler Company intends to
purchase the entire lot (both houses which will be torn down).
In view of this change in circumstances, the owners of
this property will not be held responsible for installing a
4 second meter upon sale of the property. Midas Muffler Co.
It will require a larger meter to serve their proposed develop -
ment. They have agreed to purchase a 1 -inch meter and will
receive some credit for the existing 3/4 -inch meter.

0— In conclusion, all provisions of the temporary agreement
executed by the owners are hereby waived and are null and void.
