AGREEMENT OF TEMPORARY WATER CONNECTION
We, the undersigned, Ronald R. Aiken and Mike W. Lee, deeded owners of
the described property herein, do hereby agree and consent that the meter
installation to serve water at 15330 S. W. Bull Mountain Road is a temporary
connection only and is for our immediate convenience.
It is further agreed that when and if a water main extension is laid along
an avenue," street,. or right -of -way paralleling the frontage of the property
described below that we, the undersigned, will pay our fair share of the
total cost of the line extension and the expense of meter relocation.
This is a covenant running with the property.
A portion of that tract of land the Northwest quarter of
the Northeast quarter of Section 8, T2S, R1W, W.M., Washington
County, Oregon, conveyed to Maude L. Bushnell by deed recorded
February 28, 1964, in Book 507, page 322, Washington County,
Oregon Deed Records, said portion being more particularly described
as follows:
Beginning at the.most westerly Northwest corner of that tract of
land conveyed to Arthur H. Wilson, et ux, by deed recorded August
28, 1969, in Book 755, gage 148, Records of Washington County,
Oregon; thence South 0 05' West along the West line of said
Wilson tract, a distance of 150 feet to the South line of said
Northwest quarter of the Northeast quarter of Section 8; thence
-- Westerly along the said South line of the Northwest quarter of
the Northeast quarter of Section 8, a distance of 210 feet, more
or less, to a point which is 50 feet East from the East line of
that tract of land•conveyed to Leslie L. Nunn, et ux, by deed
recorded September 10, 1962, in Book 471, page 331, Washington
County, Oregon Deed Records; thence North parallel with the East
line of said Nunn tract, a distance of 150 feet; thence North
89 51' East, a distance of 210 feet, more or less, to the point
of beginning.
We; undersigned, do covenant that we are lawfully seized of the here -
inabove - described real property and that we have the lawful right to con-
vey same, and that we will warrant and defend the title thereto against
the lawful claims of all persons.

1 - A G R E E M E N T
THIS CONTRACT made between RONALD R. AIKEN and MIKE W:
) LEE, called "builder ", and LEE E. EMERY, JR. and SUSAN L. EMERY,
husband and wife, called "owner ";
WITNESSETH That:
.. Builder, on this date has agreed to sell to owner the
parcel of real..property described in Exhibit A attached hereto
.and builder has agreed to construct thereon the improvements
described in the houseplans and the specifications attached
hereto, and owner has agreed to purchase the same, now therefore,
IT IS AGREED between the parties as follows:
1. Builder agrees to construct such improvements in
accordance with said plans and specifications and to complete the
same by November 1, 1971.
2. Builder agrees to furnish all labor and materials
and to cjiia :rantee the same against defect for it period of one year
following completion and to repair and replace any defective
material or workmanship promptly upon demand of owner. -
3. Upon completion and acceptance by owner, builder
shall convey said real property and the improvements thereon to
owner by Warranty Deed free from encumbrances, but subject to
• rights of the public in streets, roads and highways, the statutory
powers of the, Unified Sewerage Agency of Washington County, an
easement recorded December 13, 1962 in Book 477, page 73, Deed
Records, an easement recorded January 21, 1964, in Book 505, page
13, Deed Records, and a'first mortgage executed by builder in
favor of Benjamin Franklin Federal. Savings and Loan Association
in the sum of. $30,400.00, and builder .shall:.furnish:•owner with .an
r ..' owner's policy of title insurance issued by Pioneer National Title
Insurance Company in the sum of $34,000.00 showing fee simple
