FULL RELEASE �3 On the 16th day of January, 1968, Wallace J. Brosseau and Frances A. Brosseau, husband and wife, gave the undersigned their agreement entitled "Tigard Water District Agreement of Temporary Water Connection," which was recorded in Book 679, Page 39, Records of Washington County, Oregon. The undersigned acknowledges that Agreement is fully performed and satisfied, and is therefore now cancelled. Bonita Road Tigard, Oregon 97223 Dear Mr. and Mrs. Brosseau: On January 16, 1968 you were granted a temporary connection to the water main on S.W. Hall Boulevard State Highway 217), At that time you agreed to (1) pay the expense of meter relocation, and (2) pay your fair share of any future water line extension on S.W. Bonita Road paralleling the frontage of your property. In view or this agreement you were not required to pay a rebate charge for the main along hall Boulevard. The main along Bonita Road was installed in November 1969 and paid- . for by Mr, Glen Wilcox, owner of the Bonita Plaza Apartments, at a cost of $16,341 or $3.56 per foot (on one side of the road). He is entitled by Oregon Revised Statutes to a rebate from those owners who have proper— ty frontage on Bonita Road and are being served by the Tigard Water Dis— trict. Your property frontage on Bonita Road is 20 feet. Therefore, the amount due on the rebate is $96120 ($3.56 x 270- feet). It is realized that the payment of this large amount on such a . short notice may be an excessive burden. The Tigard Water District will waive The requirement that the meter be moved, thereby saving you some expense. The rebate to Mr. Wilcox cannot be waived. There are no provisions in the by —laws to authorize extended credit for such rebates, but you are hereby granted until January 10, 1971 to forward the amount due to this office. . Brosseau and Frances A. Brosseau, deeded owners of the described property herein., do hereby agree and consent that the meter installed January 2, 1968, is a temporary connection only and is for our immediate convenience. It is further agreed that when a line extension is laid on S. W. Bonita Road Easterly from Highway 2 the frontage of the property described below, the undersigned will pay the expense of meter relocation and. their fair share of the total cost of the line extension. This is a covenant running with the property. Lot 5, WILSON ACRES, as per the recorded plat thereof on file in the office of the recorder of conveyances of Washington County, Oregon, excepting the West 2 acres of said Lot 5, heretofore con- veyed by Frieda Reichen Wilson and husband to Charles A.
