APPLICATION SUMMARY FILE NAME: CITY OF TIGARD LOT LINE ADJUSTMENT CASE NO.: Lot Line Adjustment(MIS) MIS2008-00008 PROPOSAL: The applicant proposes to adjust one (1) lot line which will reconfigure two (2) parcels. Parcel 1 is 0.8 acre and will become 2.08 acres. Parcel 2 is 4.25 acres and will become 3.06 acres. The subject parcels are publicly owned. Parcel 1 is owned by the Intergovernmental Water Board. Parcel 2 is owned by the Tigard Water District. Two water tanks and an accessory building exist partially on Parcel 1 and 2. A monopole tower and its accessory_structure exist on the southwest portion of Parcel 2 just south of Parcel 1. The John Tigard House exists entirely on Parcel 2 in the northeast corner. The R-3.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 10,000 square feet. Duplexes are permitted conditionally. Some civic and institutional uses are also permitted conditionally. COMP PLAN DESIGNATION: Low-Density Residential District; and Historic District (HD), applicable to the John Tigard House. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.390, 18.410 and 18.520. NOTICE OF TYPE I DEQSION MIS2008-00008- CITY OF TIGARD LOT LINE ADJUSTMENT PAGE 1 OF 4 SECTION II. DOISION • Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. CONDITION OF APPROVAL THE FOLLOWING CONDITION SHALL BE SATISFIED WITHIN 18 MONSTHS OF THIS DECISION: Unless otherwise noted, the staff contact shall be Emily Eng in the Planning Division at (503) 718-2712. 1. The applicant shall record the lot line adjustment at Washington County within 18 months of this decision. The applicant shall submit a copy of the recorded survey map to the City within 15 days of recording. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site Information and History. The subject parcels are located on the south side SW Canterbury Lane, just west of SW 103` Avenue and across the street from the Calvin Presbyterian Church. The subject parcels are publicly owned. Parcel 1 is owned by the Intergovernmental Water Board (IWB made subject o} the Tigard Water Distract, City of Tigard, City of Durham, and City of King City. Parcel 2 is owned by the Tigard Water District. Two water tanks and an accessory building exist partially on Parcel 1 and Parcel 2. A monopole tower and its accessory structure exist on the southwest portion of Parcel 2, just south of Parcel 1. The John Tigard House exists entirely on Parcel 2 in the northeast corner and is designated a Historic District ( ) The majority of Parcel 2 is undeveloped and covered with trees. The City of Tigard plans to develop Parcel 2 into a park in the future. The water tanks and accessory building were built in the 1960s. The relocation of the John Tigard House to the Water District property was approved in 1979 by the decision SDR 17-79. The existing monopole is operated by Washington County and was approved as a conditional use in 2003 by the decision CUP21003-00010. There have been no other previous land use decisions related to the site. Proposal Description: The applicant proposes to adjust one (1) lot line, which will reconfigure two (2) parcels. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; NOTICE OF TYPE I DECISION MIS2008-00008- CITY OF TIGARD LOT LINE ADJUSTMENT PAGE 2 OF 4 • Two parcels exist and two is will remain. Parcel 2 will be reduced from 4.25 acre to.3.06 acre. Therefore, an additional parcel is not created by the lot line adjustment and the parcel reduced in size will not be reduced below the minimum lot size of 10,000 square feet required by the R-3.5 zone. By reducing the lot size the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Parcel 2 will be reduced to 3.08 acres. The monopole tower that is currently on Parcel 2 will be within Parcel 1 after the lot line adjustment. The John Tigard House is currently on Parcel 2 and will remain on Parcel 2 after the lot line adjustment. The lot line adjustment will not change any of the setbacks for the John Tigard House which was approved to be sited on the property in 1979 (SDR 17-79). The lot line adjustment will reduce the rear setback of the'existing monopole which received a conditional use permit approval in 2003 (CUP2003-00010). However, the setback from the right-of-way will not change and the distance of the monopole from privately owned property in the vicinity will not change meeting the purposes of the setback as approved in CUP2003-00010. Therefore, reducing the size of Parcel 2 for the purposes of a lot line adjustment will not cause any lots or structures to violate site development or zoning district regulations. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. The proposed lot line adjustment meets these criteria as shown below: • The widths of the building envelope area of Parcels 1 and 2 will continue to exceed the required minimum of 50 feet. • Parcels 1 and 2 will continue to exceed the minimum lot size of 10,000 square feet. None of the lots are flag lots; therefore the flag lot provision does not apply. • Each lot fronts a public right-of-way by at least 15 feet. Parcel 1 has 247.58 feet on SW Canterbury Lane and Parcel 2 has 600.13 feet of frontage on improved streets, SW Canterbury Lane and SW 103`d Avenue. • As explained previously, the only setback being reduced is the rear setback for the monopole; however, the setback from the right-of-way will not change and the distance of the monopole from privately owned property in the vicinity will not change, meeting the purposes of the setback as approved in UJ'2003-00010. With regard to flag lots: When the partitioned lot is a flag lot the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. None of the lots are flag lots. Therefore,these criteria do not apply. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. Each lot has direct access to the street. Parcel 2 has 247.58 feet of frontage on SW Canterbury Lane. Parcel 2 has 600.13 feet of frontage on SW Canterbury Lane and SW 103`d Avenue. The existing driveway on Parcel 1 will not be changed as a result of this lot line adjustment and should not be of concern in terms of fire-fighting. Therefore, this criterion does not apply. NOTICE OF TYPE I DECISION MIS2008-00008- CITY OF TIGARD LOT LINE ADJUSTMENT PAGE 3 OF 4 Where a common drive to be provided to serve more tha ne lot, a reciprocal easement which will ensure access and maintenance rights shall be recor ed with the approved partition map. There are no common drives. Therefore,this criterion does not apply. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. Each lot has direct access to the street. Existing accesses comply with Chapter 18.705 and will not change as a result of the lot line adjustment. Therefore, this criterion is met. Exemptions from dedications: A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. No dedication is required as a result of this lot line adjustment. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. The applicant has not requested a variance or adjustment. FINDING: Based on the analysis above, Staff finds that the Lot Line Adjustment criteria have been met for Parcels 1 and 2. SECTION V. PROCEDURE AND APPEAL INFORMATION Notice was mailed to the applicant and owners Final Decision: A Lot Line Adjustment is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant, whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. The relocation of the John Tigard House to the Water District property was approved in 1979 by the decision SDR 17-79. The existing monopole is operated by Washington County and was approved as a conditional use in 2003 by the decision CUP2003-00010. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: Section 18.410.040 - Approval Criteria states that the Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; NOTICE OF TYPE I DECISION MIS2008-00008-CITY OF TIGARD LOT LINE ADJUSTMENT PAGE 2 OF 4 • • Two parcels exist and two parcels will remain. Parcel 2 will be reduced from 4.25 acre to 3.06 acre. - Therefore, an additional parcel is not created by the lot line adjustment and the parcel reduced in size will not be reduced below the minimum lot size of 10,000 square feet required by the R-3.5 zone. By reducing the lot size the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; Parcel 2 will be reduced to 3.08 acres. The monopole tower that is currently on Parcel 2 will be within Parcel 1 after the lot line adjustment. The John Tigard House is currently on Parcel 2 and will remain on Parcel 2 after the lot line adjustment. The lot line adjustment will not change any of the setbacks for the John Tigard House which was approved to be sited on the property in 1979 (SL)R 17-79). The lot line adjustment will reduce the rear setback of the existing monopole which received a conditional use permit approval in 2003 (CUP2003-00010). However, the setback from the right-of-way will not change and the distance of the monopole from privately owned property n the vicinity will not change meeting the purposes of the setback as approved in CLJP2003-00010. Therefore, reducing the size of Parcel 2 for the purposes of a lot line adjustment will not cause any lots or structures to violate site development or zoning district regulations. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. The proposed lot line adjustment meets these criteria as shown below: • The widths of the building envelope area of Parcels 1 and 2 will continue to exceed the required minimum of 50 feet. • Parcels 1 and 2 will continue to exceed the minimum lot size of 10,000 square feet. None of the lots are flag lots;therefore the flag lot provision does not apply. • Each lot fronts a public right-of-way by at least 15 feet. Parcel 1 has 247.58 feet on SW Canterbury Lane and Parcel 2 has 600.13 feet of frontage on improved streets, SW Canterbury Lane and SW 103` Avenue. • As explained previously, the only setback being reduced is the rear setback for the monopole; however, the setback from the right-of-way will not change and the distance of the monopole from privately owned property in the vicinity will not change, meeting the purposes of the setback as approved in CUP2003-00010. With regard to flag lots: • When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. None of the lots are flag lots. Therefore,these criteria do not apply. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. Each lot has direct access to the street. Parcel 2 has 247.58 feet of frontage on SW Canterbury Lane. Parcel 2 has 600.13 feet of frontage on SW Canterbury Lane and SW 103` Avenue. The existing driveway on Parcel 1 will not be changed as a result of this lot line adjustment and should not be of concern m terms of fire-fighting. Therefore,this criterion does not apply. There are no common drives. Therefore,this criterion does not apply. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. Each lot has direct access to the street. Existing accesses comply with Chapter 18.705 and will not change as a result of the lot line adjustment. Therefore,this critenon is met. Exemptions from dedications: A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. No dedication is required as a result of this lot line adjustment. Variances to development standards: An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. Applicants Statement The subject property is generally bordered by SW Canterbury Lane on the north, SW 103`d Avenue on the east, SW Murdock Street on the south and an alleyway on the west. Primary access to both parcels is off SW Canterbury Lane. Based on the City's Comprehensive Plan, the subject property is located in a portion of the City that is designated as Low Density Residential. In accordance with this designation, the property is zoned R-3.5 and is designed to accommodate detached single-family homes with or without accessory uses. Duplexes are permitted conditionally. In addition, some civic and institutional uses are also permitted conditionally. Within the R3.5 zoning district, there are 10,000 square foot minimum lot areas (minimum of 65 wide for detached units and 90 feet wide for duplexes). Minimum setbacks consist of 20 feet along the front, 5 feet along side interior lots, 20 feet along side corner lots and 15 along rear. Applicable City of Tigard Development Code Standards The following information is intended to address specific-City of Tigard Development Code requirements for lot line adjustments. Responses to individual sections are highlighted in bold for each applicable development standard criterion. 18.410.010 Purpose A. Purpose. The purpose of this chapter is to provide rules, regulations and criteria governing approval of lot line adjustments. Response: The applicant acknowledges the purpose of the rules, regulations and criteria for lot"line"adjustments. The proposed lot line adjustment between tax lots 2600 and 2602 will comply with established regulations, procedures and criteria of Section 18.400 of the City of Tigard Development Code. 18.410.020 Approval Process A. Decision-making process. Lot line adjustments shall be reviewed by means of a Type I procedure, as governed by Chapter 18.390, using approval criteria contained in Section 18.410.040. Response: The applicant acknowledges that application will be processed as a Type I procedure(as outlined in Section 18.390) with the Director being the decision making authority. B. Time limit on approval. The lot line adjustment approval by the Director shall be effective for a period of 1-1/2 years from the date of approval. Response: The applicant acknowledges that the time limit on the approval is 1- 1/2 years from the date of approval. C. Lapsing of approval. The lot line adjustment approval by the Director shall lapse if: 1. The lot line adjustment has been improperly recorded with Washington County without the satisfactory completion of all conditions attached to the approval; or • 2. The final recording is a departure from the approved plan. D. Extension. The Director shall, upon written request by the applicant and payment of the required fee, grant an extension of the approval period not to exceed one year provided that: 1. No changes are made on the original plan as approved by the Director; 2. The applicant can show intent of recording the approved partition or lot line adjustment within the one year extension period; and 3. There have been no changes in the applicable Comprehensive Plan policies and ordinance provisions on which the approval was based. Response: The applicant acknowledges that Director, upon written request by . the applicant and payment of a required fee, may grant an extension of the approval period not to exceed one year. 18.410.030 Application Submission Requirements • A. General submission requirements. All applications shall be made on forms provided by the Director and shall include information required for a Type application, as governed by Chapter 18.390. Response: The submission requirements related to the lot line adjustment will be submitted to the City on Type I form. For further information, please refer to Section 1 Introduction for the Type I Lot Line Adjustment application form. This criterion has been satisfied. B. Specific submission requirements. All applications shall include the preliminary lot line map and necessary data or narrative, detailed information for which shall be obtained from the Director. Response: The specific requirements (e.g. narrative, exhibit drawings and supportive documentation) related to the lot line adjustment will be submitted to the City. Please refer to Section 2 Applicable City of Tigard Development Code Criteria, Section 3 Exhibit Drawings and Section 4, Appendices for additional information. This criterion has been satisfied. 18.410.040 Approval Criteria 4110 A. Approval criteria. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; 3. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation; c. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and d. Setbacks shall be as required by the applicable zoning district. • 4. With regard to flag lots: a. When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Sections 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 5. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. 6. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. 7. Any access way shall comply with the standards set forth in Chapter 18.705, Access, Egress, and Circulation. • "Canterbury Property" 2-3 April 2008 Lot Line Adjustment Application P:ICity of Tigard10342511DesignlCode ReviewlCanterbury-Code Responses.doc • Response: The proposed adjustment intends to modify an existing parcel boundary by changing the common boundary between two (2) lots of record without creating an additional lot. Each of these lots will meet the minimum lot size and dimensional standards for each parcel. Each of the lots maintain adequate street frontage on a public right-of-way. For further information, please refer to Section 3 Exhibit Drawings, Sheet C2.0 Preliminary Lot Line Adjustment Map for further information. This criterion has been satisfied. B. Exemptions from dedications. A lot line adjustment is not considered a development action for purposes of determining whether floodplain, greenway, or right-of-way dedication is required. Response: The applicant understands that lot line adjustments are not considered development actions for purposes of determining right- of-way dedications. Therefore, this criterion is not applicable to this application. C. Variances to development standards. An application for a variance to the standards prescribed in this chapter shall be made in accordance with Chapter 18.370, Variances and Adjustments. IIIResponse: No variances to the development standards are required. Therefore, this criterion is not applicable to this application. 18.410.050 Recording Lot Line Adjustments A. Recording requirements. Upon the Director's approval of the proposed lot line adjustment, the applicant shall record the lot line adjustment with Washington County and submit a copy of the recorded survey map to the-City, to be incorporated into the record. Response: Upon the Director's approval of the proposed lot line adjustment, the applicant will record the lot line adjustment with Washington County and submit a copy of the recorded survey map to the City to be incorporated into their records. B. Time limit. The applicant shall submit the copy of the recorded lot line adjustment survey map to the City within 15 days of recording and shall be completed prior to the issuance of any building permits on the re-configured lots. Response: A copy of the recorded lot line adjustment survey map will be submitted to the City within 15 days of recording and will need to be completed prior to the issuance of any building permits on the re- configured lots. Staff will attempt to preliminary identify sensitive lands areas at the pre-application conference based on available information. HOWEVER, the responsibility to precisely identify sensitive land areas, and their boundaries, is the responsibility of the applicant. Areas meeting the definitions of sensitive lands must be clearly indicated on plans submitted with the development application. • Chapter 18.775 also provides regulations for the use, protection, or modification of sensitive lands areas. If a replacement tree of the size cut is not reasonably available on the local market or would not be viable, the Director shall require replacement with more than one tree in accordance with the following formula: 0 The number of replacement trees required shall be determined by dividing the estimated caliper size of the tree removed or damaged, by the caliper size of the largest reasonably available replacement trees. If this number of trees cannot be viably located on the subject property, the Director may require one (1) or more replacement trees to be planted on other property within the city,either public property or, with the consent of the owner,private property. P. The planting of a replacement tree shall take place in a manner reasonably calculated to.allow growth to maturity. IN-LIEU OF TREE REPLACEMENT under Subsection D of this section, a party may, with the consent of the Director,elect to compensate the City for its costs in performing such tree replacement. g CLEAR VISION AREA (Refer to Code Chapter 18.795) The City requires that CLEAR VISION AREAS BE MAINTAINED BETWEEN THREE (3) AND EIGHT(8) FEET IN HEIGHT at road/driveway, road/railroad, and road/road intersections. CITY OF TIGARD Pre-Application Conference Notes Page 3 of 6 Engineering Department Section Storm Sewer Improvements: • All proposed development within the City shall be designed such that storm water runoff is conveyed to an approved public drainage system. The applicant will be required to submit a proposed storm drainage plan for the site, and may be required to prepare a sub-basin drainage analysis to ensure that the proposed system will accommodate runoff from upstream properties when fully developed. Must detain runoff from new impervious surface areas, if any. Storm Water Quality: The City has agreed to enforce Surface Water Management (SWM) regulations established by the Unified Sewerage Agency (USA) (Resolution and Order No. 00-7) which requires the construction of on-site water quality facilities. The facilities shall be designed to remove 65 percent of the phosphorus contained in 100 percent of the storm water runoff generated from impervious surfaces. The resolution contains a provision that would allow an applicant to pay a fee in-lieu of constructing an on- site facility provided specific criteria are met. The City will use discretion in determining whether or not the fee in-lieu will be offered. If the fee is allowed, it will be based upon the amount of impervious surfaces created; for every 2,640 square feet, or portion thereof. Please contact the Building Division for the current fee. Preliminary sizing calculations for any proposed water quality facility shall be submitted with the development application. It is anticipated that this project will require: ® Construction of an on-site water quality facility. ❑ Payment of the fee in-lieu. If creating new impervious surface areas the runoff must be treated in accordance with current CWS standards. Other Comments: All proposed sanitary sewer and storm drainage systems shall be designed such that City maintenance vehicles will have unobstructed access to critical manholes in the systems. Maintenance access roadways may be required if existing or proposed facilities are not otherwise readily accessible. 1) 18.705.030.H.1 Must provide preliminary sight distance certification for all existing and proposed access points. 2) 105th Avenue ROW is not adequate for a full street and may be considered for one-way access or for an alley way. TRAFFIC IMPACT FEES In 1990, Washington County adopted a county-wide Traffic Impact Fee (TIF) ordinance. The Traffic Impact Fee program collects fees from new development based on the development's projected impact upon the City's transportation system. The applicant shall be required to pay a fee based upon the number of trips which are projected to result from the proposed development. The calculation of the TIF is based on the proposed use of the land, the size of the project, and a general use based fee category. The TIF shall be calculated at the time of building permit issuance. PERMITS Public Facility Improvement (PFI) Permit: Any work within a public right-of-way in the City of Tigard requires a PFI permit from the Engineering Department. A PFI permit application is available at the Planning/Engineering counter in City Hall. For more extensive work such as street widening improvements, main utility line extensions or subdivision infrastructure, plans prepared by a registered professional engineer must be submitted for review and approval. The Engineering Department fee structure for this permit is considered a cost recovery system. A deposit is collected with the application, and the City will track its costs throughout the life of the permit, and will either refund any remaining portion of the deposit, or invoice the Permittee in cases where City costs exceeds the deposit amount. NOTE: Engineering Staff time will also be tracked for any final design-related assistance provided to a Permittee or their engineer prior to submittal of a PFI permit application. This time will be considered part of the administration of the eventual PFI permit. The Permittee will also be required to post a performance bond, or other such suitable security. Where professional engineered plans are required, the Permittee must execute a Developer/Engineer Agreement, which will obligate the design engineer to perform the primary inspection of the public improvement construction work. The PFI permit fee structure is as follows: NOTE: If an PFI Permit is required,the applicant must obtain that permit prior to release of any permits from the Building Division. Building Division Permits: The following is a brief overview of the type of permits issued by the Building Division. For a more detailed explanation of these permits, please contact the Development Services Counter at 503-639-4171, ext. 304. Site Improvement Permit (SIT). This permit is generally issued for all new commercial, industrial and multi-family projects. This permit will also be required for land partitions where lot grading and private utility work is required. This permit covers all on-site preparation, grading and utility work. Home builders will also be required to obtain a SIT permit for grading work in cases where the lot they are working on has slopes in excess of 20% and foundation excavation material is not to be hauled from the site. Building Permit (BUP). This permit covers only the construction of the building and is issued after, or concurrently with, the SIT permit. It covers all work necessary for buWg construction, including sub-tad!!!(excludes grading, etc.). This permit can not be issued in a subdivision until the public improvements are substantially complete and a mylar copy of the recorded plat has been returned by the applicant to the City. For a land partition, the applicant must obtain an Engineering Permit, if required, and return a mylar copy of the recorded plat to the City prior to issuance of this permit. Other Permits. There are other special permits, such as mechanical, electrical and plumbing that may also be required. Contact the Development Services Counter for more information. GRADING PLAN REQUIREMENTS FOR SUBDIVISIONS All subdivision projects shall require a proposed grading plan prepared by the design engineer. The engineer will also be required to indicate which lots have natural slopes between 10% and 20%, as well as lots that have natural slopes in excess of 20%. This information will be necessary in determining if special grading inspections will be required when the lots develop. The design engineer will also be required to shade all structural fill areas on the construction plans. In addition, each homebuilder will be required to submit a specific site and floor plan for each lot. The site plan shall include topographical contours and indicate the elevations of the corners of the lot. The builder shall also indicate the proposed elevations at the four corners of the building.
