APPLICATION SUMMARY FILE NAME: BEKEY ACCESSORY RESIDENTIAL UNIT CASE NO.: Accessory Residential Unit(MIS) MI S2007-00012 PROPOSAL: The applicant requests approval to build a 490 or 562-square foot 1-bedroom accessory residential unit sharing a common wall with a single-family primary unit. The 1,008-square foot primary unit will be 1,078 or 1,230 square feet with the addition of a new closet and/or bedroom. The accessory unit will be constructed in conjunction with the addition. APPLICANT/ OWNER: Ronald S.Bekey 9310 SW 74th Avenue • Tigard,OR 97223 LOCATION: 9310 SW 74th Avenue;WTCM 1S125DB,Tax Lot 3001. ZONING DESIGNATION: R-4.5: Low Density Residential. The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.390, 18.510 and 18.710. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION NOTICE OF TYPE I DECISION MIS2007-00012 BEKEY ACCESSORY RESIDENTIAL UNIT PAGE 1 OF 3 • • SECTION III. BACKGROUND INFORMATION Site Information and Proposal Description: The subject property is a flag lot located on SW 74th Avenue where SW Cedarcrest Street ends. The property is 0.23 acre and the existing single-family dwelling was built in 1984 and is 1,008 square feet. With a new closet and/or bedroom addition, the existing dwelling will be 1,078 or 1,230 square feet. The applicant proposes to build a 490 or 562 square foot -bedroom accessory residential unit, which will share a common wall with the existing dwelling. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Chapter 18.710 of the Tigard Development Code permits an accessory residential unit by means of a Type I procedure, providing the accessory unit complies with all of the following standards: 1. An accessory residential unit may be created within or as an addition to a detached single family dwelling. For the purposes of this chapter, "addition" means the sharing of a common wall with the primary residence. A garage may not be converted to an accessory residential unit unless it is rebuilt as part of the primary structure; The accessory residential unit will be created as an addition to the existing single-family dwelling, as indicated by the white area on the site plan. Therefore,this criterion is met. 2. An accessory residential unit may not exceed 50% of the size of the primary unit, up to a maximum of 800 square feet; The proposed accessory unit will be 490 or 562 square feet, depending on the side of the closet and/or bedroom addition. The applicant's plans indicate.that if the applicant builds just the closet addition of 70 square feet the accessory unit would be 490 square feet. If the applicant builds the bedroom and closet addition 4'222 square feet, the accessory unit will be 562 square feet. The smaller accessory unit with the smaller addition would be 45% of the pn.mary.unit. The larger accessory unit with the larger addition would be 46% of the primary unit. Therefore, in neither case would the accessory unit exceed 50% of the size of primary unit. 3. The number of residents permitted to inhabit the accessory residential unit is regulated by the Uniform Building Code; Number of residents is not regulated by the Uniform Building Code; however, the Tigard Municipal Code (Buildings and Construction) regulates the number of residents per dwelling unit. The Municipal Code states (Buildings No dwelling unit shall be permitted to be overcrowded. A dwelling unit be considered overcrowded iE there are more residents than one plus one additional resident for every 150 square feet of floor area of the habitable rooms in the dwelling unit" (14.16.290.A). Using the formula above,either of the proposed 490-square foot or 562-square foot accessory residential unit may not house more than 4 residents. The owner indicates the accessory unit would not become overcrowded. Therefore,this criterion is met. 4. Either the primary or accessory residential unit must be owner-occupied; Ronald Bekey,the owner,will occupy the primary unit. Therefore,this criterion is met. 5.A primary residence in which an accessory residential unit has been created may have only one home occupation; NOTICE OF TYPE I DECISION MIS2007-00012 BEKEY ACCESSORY RESIDENTIAL UNIT PAGE 2 OF 3 • . City records show that there is no home occupation in the existing dwelling. In addition,the applicant does not propose a home occupation in the accessory unit. Therefore,this criterion does not apply. 6. In addition to the number of parking spaces required for the primary residence, as established in Chapter 18.765, one parking space shall be provided for the accessory residential unit. This parking space shall be paved and/or covered; The.applicant indicates that there is one parking space available for the accessory unit in addition to one parking space available to the pprimary unit. The code requires one space for the pnmary unit. Both parking spaces are paved,as indicated bythe asphalt area on the site plan. Therefore,this cntenon is met. 7. The front door of the accessory residential unit shall not be located on the front facade of the primary unit unless the door is already existing; The front door of the accessory unit will be on the side façade of the primary unit. Therefore,this criterion is met. 8. There shall be compliance with all development standards established in the base zone. The accessory residential unit will be attached to the existing dwelling. Setback standards for flag lots in the R-4.5 zone apply(20 foot front, 10 foot side, 15 foot rear). The setbacks for the existing dwelling with the accessoryunit are 40 feet front,5 feet west side, 10 or 18 feet east side and 15 feet rear. The primary unit does not comply with the 10-foot minimum side setback for a flag lot on the west side; however,the dwelling was built in 1984 when there were no setback standards for flag lots. Otherwise, the existing dwelling meets all current setback standards for flag lots. The accessory residential unit is on the east side of the property and complies with the 10-foot minimum side setback for a flag lot. With the 490-square foot accessory unit, the east side setback would be 18 feet. With the 562-quare foot accessory unit,the east side setback would be 10 feet. Front and rear setbacks will remain the same. Therefore, the proposed addition complies with all development standards in the R-4.5 zone. Therefore,this criterion is met. FINDING: Based on the analysis above, the approval criteria for an accessory residential unit have been satisfied. SECTION V. PROCEDURE AND APPEAL INFORMATION Final Decision: A setback Adjustment is a Type I procedure. As such, the Director's decision is final on the date it is mailed or otherwise provided to the applicant,whichever occurs first. The Director's decision may not be appealed locally and is the final decision of the City. There are 2 parts to this plan. 1) Addition to current house: The plan includes moving 2 bedroom closets in order to extend the existing hallway, and adding an additional bedroom. This will increase the square feet of the existing house by 22 sq. ft., to 1230 sq. ft. total. 2) Accessory Residential Unit (ADU): The plan is for a one-bedroom unit, with 562 square feet. This meets all of the requirements, including: a) Shares a common wall with the primary residence. b) Does not exceed 50% of the size of the primary unit (after the addition to the current house above), and is less than 800 square feet. The main house will be 1230 sq. ft., and the ADU will be 562 sq. ft., after the addition. c) Parking space has been provided (actually long enough for 2 cars). It will be not be covered, but it will be paved. d)The front door of the ADU faces the side of the house. The front door of the main house faces the front of the house. e) Setbacks meet City requirements. Front: 40 ft., Rear: 15 ft., Left side (existing garage): 5 feet, and Right side (next to new addition): 10 feet. Firewall separates the ADU from the rest of the house. Additional Notes: 1. PGE has been out here to look at the transformer that is at the base of the current driveway. They have approved the plan shown in the diagrams here—barrier posts and a low, one-foot wall to guide cars away from the posts. 2. PGE has been out here to look at meter locations. They have approved a 2-gang setup, with a separate meter for the new unit adjacent to the current meter. They have also verified that I can have a separate 200-amp service for the new unit. 3. Clean Water Services has approved the addition. A copy of that document is attached. 3. There is a door between the new addition to the existing house and the ADU.
