BACKGROUND INFORMATION Site Information: The subject parcel is located on the west side of SW 69th Avenue, and south of SW Taylors Ferry Road. A search of City records did not show any other land-use decisions associated with this parcel. Proposal Description: The applicant is proposing to construct an 800 square foot attached garage with associated 800 square foot residential unit on the second floor. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: ACCESSORY RESIDENTIAL UNITS- APPROVAL STANDARDS: Section 18.710.020 contains the following standards for approval of an Accessory Residential Unit request: Section 18.710.020 - Approval Criteria states that an accessory residential unit is permitted providing there is compliance with all of the following standards: An accessory residential unit may be created within or as an addition to a detached single-family dwelling. For the purposes of this chapter, "addition" means the sharing of a common wall with the primary residence. A garage may not be converted to an accessory residential unit unless it is rebuilt as part of the primary structure; According to the site plan, the proposed garage and accessory residential unit will be attached to the south side of the primary structure. Therefore, this standard has been satisfied. An accessory residential unit may not exceed 50% of the size of the primary unit, up to a maximum of 800 square feet; NOTICE OF TYPE I DECISION PAGE 2 OF 4 MIS2000-00020-PAINE ACCESSORY RESIDENTIAL UNIT • • The proposed addition is a 2-story building of approximately 1,600 square feet. The first floor will be an 800 square foot garage and the second floor (residential unit) will be a total of 800 square feet. Therefore, this standard has been satisfied. The number of residents permitted to inhabit the accessory residential unit is regulated by the Uniform Building Code; This standard is deferred until building permits are submitted. Either the primary or accessory residential unit must be owner-occupied; The primary residence will be owner-occupied. Therefore, this standard is met. A primary residence in which an accessory residential unit has been created may have only one home occupation. No home occupations have been proposed with this application, nor is there any record of a home occupation for this property. In addition to the number of parking spaces required for the primary residence, as established in Chapter 18.765, one parking space shall be provided for the accessory residential unit. This parking space shall be paved and/or covered; The primary residence is required to have one parking space. The accessory residential unit is also required to have one parking space. The applicant's proposed addition includes a 3-car garage on the lower level. Therefore, this standard is satisfied. The front door of the accessory residential unit shall not be located on the front façade of the primary unit unless the door already exists. The applicant has not indicated on the plans, the location of the front door to the accessory unit. According to the applicant, the front door to the unit is to be constructed between the new bay doors of the associated garage. Therefore, the applicant will be conditioned to submit a plan that shows the front door does not open to the front façade of the primary unit. There shall be compliance with all development standards established in the base zone. • According to the site plan, the proposed addition meets all of the applicable setbacks of the R-4.5 zoning district. Therefore, this standard has been met. FINDING: Based on the analysis above, Staff finds that the Accessory Residential Unit standards have no been satisfied. If the applicant complies with the condition below, the standards will be met. I would like to have a living room,one bedroom,and a kitchen included in the floor plan. Either a friend or relative would live in the new unit. There will be a separate exterior entrance and a stairway constructed between the first and second garage bays. This new unit would be connected to my existing home's utilities.A separate furnace and water heater would be installed and connected to the gas line used by my home. A doorway will open from the unit's living room onto an existing deck used by my family. This project will have a beneficial impact upon the neighborhood. ZONING DESIGNATION: R-4.5; the R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory resident residential units at a minimum lot size of '7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. BACKGROUND INFORMATION • Site Information: The subject parcel is located on the west side of SW 59th Avenue, and south of SW Taylors Ferry Road. A search of City records did not show any other land-use decisions associated with this parcel. Proposal Description: The applicant is proposing to construct an 800 square foot attached garage with associated 800 square foot residential unit on the second floor. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS . • COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: ACCESSORY RESIDENTIAL UNITS- APPROVAL STANDARDS: Section 18.710.020 contains the following standards for approval of an Accessory Unit request: Section 18.710.020 - Approval Criteria states that an accessory residential unit is permitted providing there is compliance with all of the following standards: An accessory residential unit may be created within or as an addition to a detached single-family dwelling. For the purposes of this chapter, "addition" means the sharing of a common wall with the primary residence. A garage may not be converted to an accessory residential unit unless it is rebuilt as part of the primary structure; According to the site plan, the proposed garage and accessory residential unit will be attached to the south side of the primary structure. Therefore, this standard has been satisfied. An accessory residential unit may not exceed 50% of the size of the primary unit, up to a maximum of 800 square feet; NOTICE OF TYPE I DECISION PAGE 2 OF 4 MIS2000-00020-PAINE ACCESSORY RESIDENTIAL UNIT • • The proposed addition is a 2-story building of approximately 1,600 square feet. The first floor will be an 800 square foot garage and the second floor (residential unit) will be a total of 800 square feet. Therefore, this standard has been satisfied. The number of residents permitted to inhabit the accessory residential unit is regulated by the Uniform Building Code; This standard is deferred until building permits are submitted. Either the primary or accessory residential unit must be owner-occupied; The primary residence will be owner-occupied. Therefore, this standard is met. A primary residence in which an accessory residential unit has been created may have only one home occupation. No home occupations have been proposed with this application, nor is there any record of a home occupation for this property. In addition to the number of parking spaces required for the primary residence, as established in Chapter 18.765, one parking space shall be provided for the accessory residential unit. This parking space shall be paved and/or covered; The primary residence is required to have one parking space. The accessory residential unit is also required to have one parking space. The applicant's proposed addition includes a 3-car garage on the lower level. Therefore, this standard is satisfied. The front door of the accessory residential unit shall not be located on the front facade of the primary unit unless the door already exists. The applicant has not indicated on the plans, the location of the front door to the accessory unit. According to the applicant, the front door to the unit is to be constructed between the new bay doors of the associated garage. Therefore, the applicant will be conditioned to submit a plan that shows the front door does not open to the front façade of the primary unit. There shall be compliance with all development standards established in the base zone. According to the site plan, the proposed addition meets all of the applicable setbacks of the R-4.5 zoning district. Therefore, this standard has been met. FINDING: Based on the analysis above, Staff finds that the Accessory Residential Unit standards have no been satisfied. If the applicant complies with the condition below, the standards will be met. CONDITION:Submit plan showing the entrance to the accessory residential unit does not open to the front facade of the primary unit.
