APPLICATION SUMMARY FILE NAME: MIRAGE MINI STORAGE ADJUSTMENT CASE NO.: Adjustment (VAR)—Type II VAR2008-00002 PROPOSAL: The applicant is requesting an Adjustment to the maximum cul-de-sac length criteria of 200 feet (Chapter 18.810). The proposed cul-de-sac length is approximately 541 feet. Construction of the cul-de-sac will be at the terminus of SW Warner Avenue. This Adjustment is a condition of approval for a previously approved Conditional Use Permit (CUP2005-00001). APPLICANT: Mirage Works,LLC Attn: Saj Jivanjee 9055 SW Beaverton-Hillsdale Hwy. Portland, OR 97225 OWNER: Same. LOCATION: 11708 SW Warner Avenue; Washington County Tax Map 1S135DD, Tax Lot 05200. ZONING DESIGNATION: C-G: General Commercial District. The C-G zoning district is designed to accommodate a full range of retail, office and civic uses with a City-wide and even regional trade area. Except where non-conforming, residential uses are limited to single-family residences which are located on the same site as a permitted use. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations, are permitted conditionally.. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.390, 18.520 and 18.810. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section VI. NOTICE OF TYPE II DECISION VAR2008-00002 MIRAGE MINI STORAGE ADJUSTMENT PAGE 1 OF 4 • SECTION III. BACKGROUND INFORMATION Vicinity Information: Bordered by R-12 zoning to the north and Hwy 217 to the east; the site is surrounded by a mix of multi-family, single-family and commercial uses. Most of these uses have been long established and no significant re-development has occurred on the surrounding properties. Site History& Site Information: The .60-acre site is located at the end of SW Warner Avenue, north of Highway 99W. The applicant gained approval for a 44,790 square-foot mini storage development in 2006 (CUP2005-00001). Warner Avenue is currently a dead-end street and the applicant must construct a cul-de-sac terminus in conjunction with the approved development. Site Information and Proposal Description: The applicant requests an adjustment to the to the cul-de-sac standard for Warner Avenue as required by a condition of approval for the Conditional Use Permit (CUP2005-00001). This adjustment will allow construction of a cul-de-sac that is 541 feet in length. The maximum length allowed by code is 200 feet per Section 18.810.030.L. SECTION IV. APPLICATION SUMMARY The applicant has requested an Adjustment to Section 18.810.030.L: Cul-de-sacs, which states, "A cul-de-sac shall be no more than 200 feet long and shall not provide access to greater than 20 dwelling units, and shall only be used when environmental or topographical constraints,existing development pattern, or strict adherence to other standards in this code preclude street extension through circulation!' The applicant desires to extend the maximum permitted length of a cul-de-sac to 541 feet from 200 feet for Warner Avenue. This applicant requests approval of the adjustment to meet a condition of approval for CUP2005-00001 and has submitted the necessary materials for staff to review this application. SECTION V. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET No comments were received from property owners within 500 feet relating directly to the cul-de-sac length. A question was sent by Eldon Mains,Jr. via e-mail about access onto the cul-de-sac from 11700 SW Hall Boulevard (WCTM 1S135DD-01201). He owns the property and would like access to the rear of his site for deliveries and employee parking. Staff explained that creating an access point requires approval by both the Planning and Engineering Divisions. Because a new access oint affects off-site traffic, a major modification to the approved Site Development Review is required for tax lot 1201. The Engineering Division would require a Public Facilities Improvement Permit to ensure the access is constructed to city standards. SECTION VI. APPLICABLE REVIEW CRITERIA AND FINDINGS VARIANCES AND ADJUSTMENTS: Adjustments to Street and Utility Improvement requirements (Chapter 18.810). By means of a Type II procedure, as governed by Section 18.390.040, the Director shall approve, approve with conditions, or deny a request for an adjustment to the street improvement requirements, based on findings that the following criterion is satisfied: Strict application of the standards will result in an unacceptably adverse impact on existing development, on the proposed development, or on natural features such as wetlands, steep slopes or existing mature trees. In approving an adjustment to the standards, the Director shall determine that the potential adverse impacts exceed the public benefits of strict application of the standards. NOTICE OF TYPE II DECISION VAR2008-00002 MIRAGE MINI STORAGE ADJUSTMENT PAGE 2 OF 4 A Section 18.810.030.L, Cul-de-sacs, states that "a cul-de-sac shall be no more than 200 feet long shall not provide access to greater than 20 dwelling units, and shall only be used when environmental or topographical constraints, existing development pattern, or strict adherence to other standards in this code preclude street extension and through circulation. The project site lies at the end of Warner Avenue and is surrounded by Highway 217 to the east and developed properties in all other directions. Only 4 dwelling units access onto Warner Avenue from an apartment building adjacent to the site. If Warner Avenue were extended, it would connect with Hall Boulevard. Hall Boulevard is a state highway and is under the jurisdiction of the Oregon Department of Transportation (ODOT). Access to Hall is regulated by ODOT and would likely be denied. A connection to Hall Boulevard could not meet the 600-foot access spacing standard along an arterial. There are currently 15 driveways along the 1,000-foot stretch of Hall Boulevard between Pacific Highway and the Highway 217 overpass to the north. Limiting access points along arterials reduces congestion and increases safety for users. In addition, Warner Avenue is currently a dead-end street, and building the cul-de-sac facilitates safer traffic flow. Existing development patterns prevent the applicant from constructing Warner Avenue to intersect with Hall Boulevard. All parcels in the path of a street connection are developed with homes, businesses and apartment buildings. These parcels are also not under the control of the applicant. Even if a connection to Hall were permitted by ODOT, the street extension is not possible at this time. The only feasible option is to terminate the street with a cul-de-sac bulb. FINDING: Staff finds that strict application of the 200-foot maximum standard would adversely impact existing development and access management along Hall Boulevard; therefore, staff recommends approval of the requested adjustment. SECTION VII. OTHER STAFF & AGENCY COMMENTS The length and design of the cul-de-sac was reviewed by the Building and Engineering Divisions, Public Works, and Tigard Police staff during the Conditional Use application. Tigard Engineering staff and Tigard Police were routed application packets of the adjustment request for further comment. There were no objections to or comments on the proposal by either group. Affected outside agencies include Tualatin Valley Fire and Rescue along with Oregon Department of Transportation. These agencies were notified with the original conditional use application. No changes were made to the origina_proposal. ODOT gave no comments during that process. Tualatin Valley Fire and Rescue had no comments after reviewing construction plans for the Public Facilities Improvement Permit (PFI, ENG2007-00072), SECTION VIII. Of the Tigard Community Development Code which provides that a written appeal together with the required fee shall be filed with the Director within ten (10) business days of the date the notice of the decision was mailed. BACKGROUND INFORMATION Vicinity Information: Bordered by R-12 zoning to the north and Hwy 217 to the east; the site is surrounded by a mix of multi-family, single-family and commercial uses. Most of these uses have been long established and no significant re-development has occurred on the surrounding properties. Site History& Site Information: The .60-acre site is located at the end of SW Warner Avenue, north of Highway 99W. The applicant gained approval for a 44,790 square-foot mini storage development in 2006 (CUP2005-00001). Warner Avenue is currently a dead-end street and the applicant must construct a cul-de-sac terminus in conjunction with the approved development. Site Information and Proposal Description: The applicant requests an adjustment to the to the cul-de-sac standard for Warner Avenue as required by a condition of approval for the Conditional Use Permit (CUP2005-00001). This adjustment will allow construction of a cul-de-sac that is 541 feet in length. The maximum length allowed by code is 200 feet per Section 18.810.030.L. SECTION IV. APPLICATION SUMMARY The applicant has requested an Adjustment to Section 18.810.030.L: Cul-de-sacs, which states, "A cul-de-sac shall be no more than 200 feet long and shall not provide access to greater than 20 dwelling units,and shall only be used when environmental or topographical constraints,existing development pattern, or strict adherence to other standards in this code preclude street extension through circulation?' The applicant desires to extend the maximum permitted length of a cul-de-sac to 541 feet from 200 feet for Warner Avenue. This applicant requests approval of the adjustment to meet a condition of approval for CUP2005-00001 and has submitted the necessary materials for staff to review this application. SECTION V. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET No comments were received from property owners within 500 feet relating directly to the cul-de-sac length. A question was sent by Eldon Mains,Jr. via e-mail about access onto the cul-de-sac from 11700 SW Hall Boulevard (WCTM 1S135DD-01201). He owns the property and would like access to the rear of his site for deliveries and employee parking. Staff explained that creating an access point requires approval by both the Planning and Engineering Divisions. Because a new access oint affects off-site traffic, a major modification to the approved Site Development Review is required for tax lot 1201. The Engineering Division would require a Public Facilities Improvement Permit to ensure the access is constructed to city standards. SECTION VI. APPLICABLE REVIEW CRITERIA AND FINDINGS VARIANCES AND ADJUSTMENTS: Adjustments to Street and Utility Improvement requirements (Chapter 18.810). By means of a Type II procedure, as governed by Section 18.390.040, the Director shall approve, approve with conditions, or deny a request for an adjustment to the street improvement requirements, based on findings that the following criterion is satisfied: Strict application of the standards will result in an unacceptably adverse impact on existing development, on the proposed development, or on natural features such as wetlands, steep slopes or existing mature trees. In approving an adjustment to the standards, the Director shall determine that the potential adverse impacts exceed the public benefits of strict application of the standards. NOTICE OF TYPE II DECISION VAR2008-00002 MIRAGE MINI STORAGE ADJUSTMENT PAGE 2 OF 4 • • Section 18.810.030.L, Cul-de-sacs, states that "a cul-de-sac shall be no more than 200 feet long shall not provide access to greater than 20 dwelling units, and shall only be used when environmental or topographical constraints, existing development pattern, or strict adherence to other standards in this code preclude street extension and through circulation. The project site lies at the end of Warner Avenue and is surrounded by Highway 217 to the east and developed properties in all other directions. Only 4 dwelling units access onto Warner Avenue from an apartment building adjacent to the site. If Warner Avenue were extended, it would connect with Hall Boulevard. Hall Boulevard is a state highway and is under the jurisdiction of the Oregon Department of Transportation (ODOT). Access to Hall is regulated by ODOT and would likely be denied. A connection to Hall Boulevard could not meet the 600-foot access spacing standard along an arterial. There are currently 15 driveways along the 1,000-foot stretch of Hall Boulevard between Pacific Highway and the Highway 217 overpass to the north. Limiting access points along arterials reduces congestion and increases safety for users. In addition, Warner Avenue is currently a dead-end street, and building the cul-de-sac facilitates safer traffic flow. Existing development patterns prevent the applicant from constructing Warner Avenue to intersect with Hall Boulevard. All parcels in the path of a street connection are developed with homes, businesses and apartment buildings. These parcels are also not under the control of the applicant. Even if a connection to Hall were permitted by ODOT, the street extension is not possible at this time. The only feasible option is to terminate the street with a cul-de-sac bulb. FINDING: Staff finds that strict application of the 200-foot maximum standard would adversely impact existing development and access management along Hall Boulevard; therefore, staff recommends approval of the requested adjustment. SECTION VII. OTHER STAFF & AGENCY COMMENTS The length and design of the cul-de-sac was reviewed by the Building and Engineering Divisions, Public Works, and Tigard Police staff during the Conditional Use application. Tigard Engineering staff and Tigard Police were routed application packets of the adjustment request for further comment. There were no objections to or comments on the proposal by either group. Affected outside agencies include Tualatin Valley Fire and Rescue along with Oregon Department of Transportation. These agencies were notified with the original conditional use application. No changes were made to the original proposal. ODOT gave no comments during that process. Tualatin Valley Fire and Rescue had no comments after reviewing construction plans for the Public Facilities Improvement Permit (PFI, ENG2007-00072), SECTION VIII.
