Condition of Approval (# 15) required the applicant to apply for an adjustment to the access and egress standards. The applicant is requesting approval to reduce the access spacing standard from 200 feet to 104 feet for an existing driveway along Burnham Street. A second adjustment is to reduce the spacing standard from 600 feet to approximately 20 feet for an existing driveway along SW Hall Boulevard. The CBD zoning district is designed to provide a concentrated central business district, centered on the City's historic downtown, including a mix of civic, retail and office uses. Single-family attached housing, at a maximum density of 12 units/net acre, equivalent of the R-12 zoning district, and multi-family housing at a minimum density of 32 units/acre, equivalent to the R-40 zoning district, are permitted outright. A wide range of uses, including but not limited to adult entertainment, utilities, facilities with drive-up windows, medical centers, major event entertainment and gasoline stations, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.370, 18.390, and 18.705. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request for the subdivision subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section V of this Decision. BACKGROUND INFORMATION Site History: Staff conducted a search of City records for the subject property. Land use applications related to on-site work include construction, expansion and remodel the existing buildings. These include a Conditional Use Permit to allow a Department of Motor Vehicles office within an industrial zone (CU 18-76), construction of an office/warehouse building to be used by an electrical contractor (SDR24-77), and redevelopment of the site for the City Hall complex (SDR91-0017). The most recent case is to construct the Tigard Skate Park (SDR2006-00005). No other land use cases were found to be on file with the City besides some temporary sign permits. Site and Vicinity Inf ormation: The subject site is located at the intersection of Hall Boulevard and Burnham Street. There are five existing buildings on the site (City Hall &Police, Permit Center the Niche and two modular offices). The property is zoned CBD with properties to the north and east also zoned CBD. Properties to the east across Hall Blvd. are zoned Light Industrial. To the south of the City Hall complex across Fanno Creek is residential zoning (R-12). Surrounding properties are developed with a mix of commercial, industrial, municipal and residential uses. Proposal Description: The applicant received Site Development Review approval (SDR2005-00006) to construct a 15,000 square foot skate park on the City Hall site. Condition of Approval# 15 requires the applicant to apply for a variance to the access spacing requirement for both existing driveways (18.705.030.I� The access spacing standards along an arterial are 600 feet, while only 200 feet along a collector street. Hall Boulevard is an arterial and Burnham Street is a collector. The existing Hall Boulevard access is 20 feet from another existing access on the opposite side of the street. The Burnham Street access is 104 feet from a neighboring driveway. There-fore, a variance is required for both existing access points. SECTION IV. COMMENTS FROM PROPERTY OWNERS WITHIN 500 FEET The Tigard Community Development Code requires that property owners within 500 feet of the subject site be notified of the proposal, and be given an opportunity for written comments and/or oral testimony prior to a decision being made. In addition, staff has posted a notice at the driveway to the site, visible from the street. Staff received no comments or letters from adjacent property owners. SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS VARIANCES AND ADJUSTMENTS: Section 18.370.020.C.5.a provides that in all zoning districts where access and egress drives cannot be readily designed to conform to Code standards within a particular parcel, access with an adjoining property shall be considered. If access in conjunction with another parcel cannot reasonably be achieved, the Director may grant an adjustment to the access requirements of Chapter 18.705 through a Type II procedure, as governed in Section 18.390.030,using approval criteria contained in Subsection 5.b below. The applicant has requested a variance to 18.705.030.H Access Management. Minimum spacing of driveways along a collector shall be 200 feet and 600 feet along an arterial. The applicant has requested to reduce the requirement from 200 feet to 104 feet on Burnham Street and from 600 feet to 20 feet on Hall Boulevard. Both of these driveways are pre-existing. The Director may approve, approve with condition, or deny a request for an adjustment from the access requirement contained-in Chapter 18.705, based on the following criteria: It is not possible to share access. Burnham - The City has approached the owner of the adjacent parcel to the west about access consolidation as part of the Burnham Street Community Investment Program (CEP) project. This option has been abandoned due to the limited space and resultant substandard turning movements as determined by the City's Capital Construction and Transportation Division and the City's consultant on the project, OTAK. Other options are being considered as part of this project, but no decisions or agreements have been made at this time. Shared access with that parcel is not possible because a creek crossing would be required. There are no other alternative access points on the street in question or from another street. Burnham - The Burnham access is located as far as possible from the Burnham/Hall intersection (approximately 117 feet). Due to code requirements for driveways within influence areas of intersections, there are no other access points along Burnham that will meet the spacing standard. Hall - There are existing access drives on the east side of Hall Boulevard, across from the City Hall site. Even if the applicant moved the driveway to the furthest point to the south, the access points would still only be 100 feet apart. The drive cannot be moved to the north because of the Burnham/Hall intersection, the existing curve of the street and location of the Skate Park The access separation requirements cannot be met. The access separation requirements cannot be met for the reasons stated above. Neither shared access nor alternative access locations are possible. In addition neither access can be eliminated. Both are necessary to meet the minimum number of access drives required for a project with 100 or more parking spaces. The request is the minimum adjustment required to provide adequate access. The spacing standard along Burnham Street is 200 feet and the current spacing is approximately 104 feet. Along Hall Boulevard the standard is 600 feet, but the existing spacing is 20 feet. There are existing driveways for neighboring properties and no other possible access locations on site that meet the standards. Therefore,the request is the minimum adjustment required to provide adequate access. The approved access or access approved with conditions will result in a safe access; and Both existing riveways have served the subject site adequately to date and have not been labeled by the Engineering Division as an "unsafe" access point. Stopping sight distance was measured by the Applicant's traic engineer and was found to meet or exceed AASHTO requirements. These sight distance certifications were required as part of the Tigard Skate Park Site Development Review(SDR2006-00005). The visual clearance requirement of Chapter 18.795 will be met. The visual clearance requirements have been met as conditioned by the Site Development Review(SDR2006- 00005). No changes are proposed with this application that would affect visual clearance. FINDING: Staff finds that the access/egress adjustment criteria are satisfied. SECTION VI. OTHER STAFF COMMENTS The Tigard Building Division and the Tigard Police have reviewed the application and have no objections. SECTION VII. AGENCY COMMENTS Clean Water Services (CWS) has reviewed the proposal. Comments have been considered. Although this application does not propose any changes to the site that would affect utilities, water quality, erosion or sensitive lands,the applicant must meet CWS requirements for all construction activities. RECEIVED PLANNING MAY 2 9 2007 MEMORANDUM CITY OF TIGARD DATE: May 24, 2007 FROM: David Schweitzer, Clean Water Services TO: Cheryl Gaines Assistant Planner, City of Tigard SUBJECT: Review Comments—VAR 2006-00014, 00015 GENERAL COMMENTS • This Land Use Review by Clean Water Services (District) does not constitute approval of storm or sanitary sewer compliance with the NPDES permit held by the District. The • District,prior to issuance of any connection permit, must review and approve final construction plans. • All provisions of the development submittal shall be in accordance with Clean Water Services (CWS) Design and Construction Standards,presently Resolution and Order No. 07- 20 (R&O 07-20), and all current Intergovernmental Agreements between the City and CWS. • Final construction plans must be reviewed by CWS for conformance with R&O 07-20 (current version) and a Stormwater Connection Permit must be issued by the District prior to construction. SANITARY SEWER • Proposed plans do not indicate a sanitary connection. If the project is later designed to include a sanitary connection, each lot shall be provided with a direct gravity side sewer (service lateral) connection to a public sanitary sewer mainline in accordance with current CWS Design and Construction Standards. Each sanitary lateral shall provide service to only one lot and shall be contiguous with pubic right-of-way or public sewer easement. STORM DRAINAGE AND WATER QUALITY • Each lot shall be provided with an individual connection to a public storm conveyance. • A hydraulic and hydrological analysis of the existing storm conveyance system in accordance with R&O 07-20 is required. A downstream conveyance analysis is required. Proprietary treatment systems (Storm Water Filter Vault) shall be allowed if the criteria of R&O 07-20 section 4.05.8c are met. Payment of a fee-in-lieu of constructing a public water quality facility may be approved by the City in accordance with CWS Design and Construction Standards. • Maintenance access shall be provided for public water quality and/or detention facilities in accordance with current CWS Design and Construction Standards (presently R&O 07-20). • Final construction plans shall show all existing and proposed public and private storm conveyance and easements. Tax/Map 2S1 02DA 00200 is not covered under this SPL and will require a SPL. EROSION CONTROL • If the improvements are disturbing more than 1-acre; site improvements and any improvements within the public Right Of Way, a 1200-C Permit is required.. Adjustments to driveway spacing standards are considered "special adjustments" and the criteria for such an adjustment are found at 18.370.020..C.5. That section states that if access in conjunction with another parcel cannot reasonably be achieved, the Director may grant an adjustment. According to 18.370.020.C.5.b, the Director may approve, approve with conditions, or deny a request for an adjustment from the access requirements contained in 18.705, based upon the following criteria: 1. It is not possible to share access; 2. There are no other alternative access points on the street in question or from another street; 3. The access separation requirement cannot be met; 4. The request is the minimum adjustment required to provide adequate access; 5. The approved access or access approved with conditions will result in a safe access; and 6. The visual clearance requirements of Chapter 18.795 will be met. BURNHAM STREET ACCESS The Director's Decision for SDR 2006-00005 states that the driveway on Burnham Street is only 104 feet from the next adjacent driveway to the west, whereas the minimum spacing requirement is 200 feet. Skate Park Project, SDR 2006-00005 Page 1 Driveway Spacing Adjustment • • Burnham Driveway Adjustment Justification: 1. It is not possible to share access The City has approached the owner of the adjacent parcel to the west (embroidery business) about consolidation of that parcel driveway and the City Hall driveway, as a part of the Burnham Street CIP project. The Capital Construction and Transportation (CCT) Division and OTAK (City consultant for the Burnham Street project) considered a consolidation of the Niche driveway and the embroidery shop driveway. However, they abandoned that option due to limited space and resultant substandard turning movements. The CCT Division indicated that OTAK will also hold discussions with Verizon, as they have two existing driveways in close proximity. The City owns a small triangle- shaped property between the embroidery business and the Verizon driveways that has historically be used only for a public sandbag depot. The latest concept is to consolidate the Verizon driveways and the embroidery business driveway into one new driveway using the triangle-shaped parcel. Attachment 1 is a sketch that shows the potential spacing of driveways if this new consolidated access point is created. The spacing between the Niche Driveway and the new access point would be approximately 205 feet, thereby meeting the spacing standard. Based upon the fact that the Burnham Street access management effort is being managed by the Engineering Department, and they are exploring a consolidation option that would meet spacing standards, the Applicant respectfully requests that this criterion be found to be met. 2. There are no other alternative access points on the street in question or from another street The existing driveway from City Hall onto Burnham Street is at the west end of the site frontage and is only 117 feet from the intersection at Hall Boulevard. There are no other opportunities on site for an access onto Burnham Street. The site has frontage and a separate access point on Hall Boulevard. However, both access points are required to satisfy Table 18.705.3 and fire code requirements. Therefore, no other access points can be achieved on Burnham Street or from another street, thereby satisfying this criterion. Skate Park Project, SDR 2006-00005 Page 2 Driveway Spacing Adjustment • • 3. The access separation requirement cannot be met As stated above, the Burnham Street driveway is roughly 104 feet from the next access point to the west. The City has discussed consolidation of these two driveways with the adjacent property owner. Please see the discussion under #1 above regarding the outcome of that investigation and the concept of a new access point. Based upon that information, the Applicant finds that this criterion is met. 4. The request is the minimum adjustment required to provide adequate access The Burnham Street driveway has served the subject site to date and is not a new access point proposal. The driveway is necessary in order to continue to provide adequate traffic flow into the Niche area and egress from the Niche area and the main City Hall campus. The Applicant is not proposing to relocate the driveway which would make the spacing issue worse. Therefore, this adjustment is the minimum necessary to provide adequate access to the site. This criterion is met. 5. The approved access or access approved with conditions will result in a safe access The existing driveway has served the subject site adequately to date and has not been flagged by the Engineering Department as an "unsafe" access point. Sight distance was measured by the Applicant's traffic engineer and was found to meet and exceed AASHTO requirements. Therefore, this access will continue to serve as a safe access, thereby satisfying this criterion. 6. The visual clearance requirements of Chapter 18.795 will be met The Applicant's narrative states that vision clearance will be met at this driveway. Attachment 2 is a sketch from the Applicant's plan with the vision clearance triangle sketched in relation to the proposed ROW. The sketch shows that the requirements of 18.795 are met, and therefore this criterion is met. Conclusion: The Applicant meets all six criteria of 18.370.020.C.5.b with regard to the existing access on Burnham Street. Skate Park Project, SDR 2006-00005 Page 3 Driveway Spacing Adjustment • • HALL BOULEVARD ACCESS The Director's Decision for SDR 2006-00005 states that the driveway on Hall Boulevard is closer than 600 feet from several driveways along the east side of the roadway, whereas the minimum spacing requirement is 600 feet. Hall Boulevard Driveway Adjustment Justification: 1. It is not possible to share access The City owns land to the south that stretches beyond Fanno Creek. To share a driveway with the adjacent property would require an access driveway across the creek,which would not be permitted. Therefore, this criterion is met. 2. There are no other alternative access points on the street in question or from another street The City has no other access points along Hall Boulevard. Attachment 3 is a sketch map that shows the two driveways on the east side of the roadway in relation to the City's access. The sketch shows that even if the Applicant were to relocate the Hall Boulevard access to the furthest feasible point to the south (north bank of Fanno Creek), the spacing between that point and the closest driveway on the east side of the roadway would only be 100 feet. Therefore, there are no other alternate access points on this street. This criterion is met. 3. The access separation requirement cannot be met As was stated under # 2 above, even if the Applicant were to move the driveway to the south end of the site, the access spacing can not be met. This criterion is therefore met. 4. The request is the minimum adjustment required to provide adequate access The Hall Boulevard access is not a new proposal and has served the City Hall site since initial construction. The access spacing issue is an existing issue and will not be worsened by the Applicant's proposal. Therefore, this request is the minimum adjustment needed to provide adequate access. The approved access or access approved with conditions will result in a safe access The existing driveway has served the subject site adequately to date and has not been flagged by the Engineering Department as an "unsafe" access point. Stopping sight distance from the north was measured by the Applicant's traffic engineer and was found to meet and exceed AASHTO requirements. Also, the vision clearance criteria of 18.795 are met (see #6 below). Therefore, this access will continue to serve as a safe access, thereby satisfying this criterion. 6. The visual clearance requirements of Chapter 18.795 will be met The Applicant's narrative states that vision clearance will be met at this driveway. Attachment 4 is a sketch from the Applicant's plan with the vision clearance triangle sketched in relation to the proposed ROW. Note that the Applicant's plan was incorrect in how the triangle was first measured. Attachment 4 correctly shows where the vision clearance triangles should be. There are two street trees that fall into that zone; however, the Applicant has pruned those trees up to meet the eight- foot height restriction to meet 18.795. The sketch shows that the requirements of 18.795 will be met. Therefore, this criterion is met. Conclusion: The Applicant meets all six criteria of 18.370.020.C.5.b with regard to the existing access on Hall Boulevard. FINAL CONCLUSION The Applicant has shown that they meet the criteria of 18.370.020.C.5.b with regard to both site access points and hereby requests that adjustments to the access spacing standard of 18.705.030.H.3 be granted.
