BACKGROUND INFORMATION Site Information: In 1998, an application for a Land Partition and a Lot Line Adjustment were applied for but were withdrawn for WCTM 1 S135AA, Tax Lot 00901. An existing home is located on 1 S135AA, Tax Lot 01000, no other records could be found. There is a pre-existing home located on 1S135AA, Tax Lot 01001, no other records could be found for this parcel. A designated wetland is located on 1S135AA, Tax Lot 01301. No land-use applications or other records were found for the parcel. Proposal Description: The applicant has requested three (3) Lot Line Adjustment approvals. No development is currently being proposed. The first Lot Line Adjustment (MIS1999-00032) associated with this application is the adjustment of the north property line of Tax lot 1000. The north property line of Tax lot 1000 will be moved 90 degrees north to become Tax Lot 901's new east property line, thus adding 13,342 square feet to Tax Lot 1000 and reducing Tax Lot 901 from 22,325 square feet to 7,500 square feet. The second proposed Adjustment (MIS1999-00033) will adjust the northern lot line of Tax Lot 1001, ten feet to the north. The Adjustment will increase the parcel from 7,000 square feet to 8,000 square feet. The third Lot Line Adjustments (MIS1999-00034) will take the north property line of Tax Lot 01301 and move it 133 feet north, adding 49,029 square feet to Tax •Lot 01301. The proposed lot line would reduce Tax Lot 1000 from 52;757 square feet to 17,553 square feet. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: NOTICE OF TYPE I DECISION MIS1999-00032-34—FINEVIEW LOT LINE ADJUSTMENTS PAGE 2 OF 5 �, Section 18.410.040 - 1 roval Criteria states that the Dir fbor shall approve or deny • a request for a Lot Line Adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the Lot Line-Adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No new lots will be created as part of this Adjustment; four (4) lots exist and four (4) lots will remain after the proposed Adjustments. The minimum lot size in the R-4.5 zone is 7,500 square feet. The smallest lot will be 7,500 square feet after the adjustment. Therefore, this standard is satisfied. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; According to the site plan, three (3) buildings exist on Tax Lot 901. After the proposed Lot Line Adjustment is made, the structure closest to the new east property line will be in violation of setbacks according to the City of Tigard's zoning regulations. According to the applicant, the non-conforming structure is to be removed. The second structure in violation of the City of Tigard's zoning regulations would be the eastern most structure located on the newly adjusted Tax Lot 1000. By adjusting the north property line of Tax Lot 1301 and decreasing the square footage of Tax Lot 1000, the structure in question is in violation of setbacks. According to the applicant, this non-conforming structure is also to be removed. Therefore, ' the standards have been met. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access • easement; and • Setbacks shall be as required by the applicable zoning district. The resulting parcels of the Adjustments are located in the R-4.5 zoning district. Therefore, there is no minimum lot coverage and each lot has at least 15-feet of frontage onto a public street. Two (2) flag lots are the result of the Adjustments each with a 15-foot-wide access. Therefore, this criterion has been satisfied. With regard to flag lots: • When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures; and • A screen shall be provided along the property line of a lot of record where the. paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Two (2) flag lots will result in the approval of this application. The two flag lots will have accessways within ten feet of abutting lots. The applicant has not addressed the buffering and screening between the required 15-foot accessway and the adjoining properties. Therefore, buffering and screening will be conditioned in this decision. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. This standard is deferred until time of development. Therefore, this criterion has been satisfied. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. A common drive is not proposed, therefore, this criterion does not apply. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. All lots will have access onto SW 90th Avenue. Two of the newly adjusted lots are flag lots and will have at least 15 feet of frontage onto SW 90th Avenue. BACKGROUND INFORMATION Site Information: In 1998, an application for a Land Partition and a Lot Line Adjustment were applied for but were withdrawn for WCTM 1 S135AA, Tax Lot 00901. An existing home is located on 1S135AA, Tax Lot 01000, no other records could be found. There is a pre-existing home located on 1 S135AA, Tax Lot 01001, no other records could be found for this parcel. A designated wetland is located on 1 S135AA, Tax Lot 01301. No land-use applications or other records were found for the parcel.. Proposal Description: The applicant has requested three (3) Lot Line Adjustment approvals. No development is currently being proposed. The first Lot Line Adjustment (MIS1999-00032) associated with this application is the adjustment of the north property line of Tax lot 1000. The north property line of Tax lot 1000 will be moved 90 degrees north to become Tax Lot 901's new east property line, thus adding 13,342 square feet to Tax Lot 1000 and reducing Tax Lot 901 from 22,325 square feet to 7,500 square feet. The second proposed Adjustment (MIS1999-00033) will adjust the northern lot line of Tax Lot 1001, ten feet to the north. The Adjustment will increase the parcel from 7,000 square feet to 8,000 square feet. The third Lot Line Adjustments (MIS1999-00034) will take the north property line of Tax Lot 01301 and move it 133 feet north, adding 49,029 square feet to Tax Lot 01301. The proposed lot line would reduce Tax Lot 1000 from 52,757 square feet to 17,553 square feet. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.410.040 contains the following standards for approval of a Lot Line Adjustment request: NOTICE OF TYPE I DECISION MIS1999-00032-34-FINEVIEW LOT LINE ADJUSTMENTS PAGE 2 OF 5 Section 18.410.040 - A (oval Criteria states that the Dir or shall approve or deny a request for a Lot Line Adjustment in writing based on findings that the following criteria are satisfied: An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; No new lots will be created as part of this Adjustment; four (4) lots exist and four (4) lots will remain after the proposed Adjustments. The minimum lot size in the R-4.5 zone is 7,500 square feet. The smallest lot will be 7,500 square feet after the adjustment. Therefore, this standard is satisfied. By reducing the lot size, the lot or structures(s) on the lot will not be in violation of the site development or zoning district regulations for that district; According to the site plan, three (3) buildings exist on Tax Lot 901. After the proposed Lot Line Adjustment is made, the structure closest to the new east property line will be in violation of setbacks according to the City of Tigard's zoning regulations. According to the applicant, the non-conforming structure is to be removed. The second structure in violation of the City of Tigard's zoning regulations would be the eastern most structure located on the newly adjusted Tax Lot 1000. By adjusting the north property line of Tax Lot 1301 and decreasing the square footage of Tax Lot 1000, the structure in question is in violation of setbacks. According to the applicant, this non-conforming structure is also to be removed. Therefore, the removal of the non- • conforming structures on Tax Lots 901 and 1000 will be included as a condition of approval. The resulting parcels are in conformity with the dimensional standards of the zoning district, including: • The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; • The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the access way may not be included in the lot area calculation; • Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and • Setbacks shall be as required by the applicable zoning district. The resulting parcels of the Adjustments are located in the R-4.5 zoning district. Therefore, there is no minimum lot coverage and each lot has at least 15-feet of frontage onto a public street. Two (2) flag lots are the result of the Adjustments each with a 15-foot-wide access. Therefore, this criterion has been satisfied. With regard to flag lots: • When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures; and • • A screen shall be provided along the property line of a lot of record where the paved drive in an access way is located within ten feet of an abutting lot in accordance with Section 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Two (2) flag lots will result in the approval of this application. The two flag lots will have accessways within ten feet of abutting lots. The applicant has not addressed the buffering and screening between the required 15-foot accessway and the adjoining properties. Therefore, buffering and screening will be conditioned in this decision. The fire district may require the installation of a fire hydrant where the length of an access way would have a detrimental effect on fire-fighting capabilities. This standard is deferred until time of development. Therefore, this criterion has been satisfied. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. A common drive is not proposed, therefore, this criterion does not apply. Any access way shall comply with the standards set forth in Chapter 18.705: Access, Egress, and Circulation. All lots will have access onto SW 90th Avenue. Two of the newly adjusted lots are flag lots and will have at least 15 feet of frontage onto SW 90th Avenue. INTRODUCTION The applicant is requesting approval of a lot line adjustment to change the property line of four adjacent parcels. The lot line adjustment will be changed as shown on the attached site plan (Exhibit 1). III. FINDINGS A. CITY OF TIGARD COMPREHENSIVE PLAN: COMMENT: Except where required by the Community Development Code, this application is not required to address goals and policies of the Comprehensive Plan, as it relates to development of the subject property, since the Plan is implemented by the Code. The subject property is situated within Washington County's Metzger-Progress Community Plan. However, there are no general or specific design elements on the Community Plan that are applicable to the requested lot line adjustment. According to the Metzger- Progress Significant Natural Resources Map,the subject property is not designated as containing any significant natural resources. However,there is a wetland located on the site as shown on the attached site plan (Exhibit 1). B. TIGARD COMMUNITY DEVELOPMENT CODE: CHAPTER 18.390: DECISION-MAKING PROCEDURES COMMENT: According to Table 18.390.1 a Lot Line Adjustment is a Type I Procedure. As a result, this application is submitted under the Type I criteria. CHAPTER 18.410: LOT LINE ADJUSTMENTS 18.410.030 Application Submission Requirements A. General submission requirement. All applications shall be made on forms provided by the Director and shall include information required for a Type I application, as governed by the Director. 2 • • COMMENT: A Type I Lot Line Adjustment application provided by the Director is submitted in conjunction with this Applicant's Statement. All information required by Chapter 18.390 is included with this application. B. Specific submission requirements. All applications shall include the preliminary lot line map and necessary data or narrative, detailed information for which shall be obtained from the Director. COMMENT: A lot line map and necessary narrative is included with this application. 18.410.40 Approval Criteria A. Approval criteria. The Director shall approve or deny a request for a lot line adjustment in writing based on findings that the following criteria are satisfied. 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district; COMMENT: No additional parcels are being created by the proposed lot line adjustment. Furthermore, the existing parcels are not being reduced below the minimum lot size established by the zoning district as shown on the attached site plan(Exhibit 1). Tax Lot 901 is currently 22,325 square feet in size and is proposed to be 7,500 square feet after the lot line adjustment. Tax Lot 1000 is currently 52,757 square feet and is proposed to be 17,553 square feet after the lot line adjustment. Tax Lot 1001 is currently 7,000 square feet in size and is proposed to be 8,000 square feet. Tax Lot 1301 is 4,455 square feet in size and is proposed to be 53,484 square feet after the lot line adjustment. 2. By reducing the lot size,the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; COMMENT: Existing structures to remain on the project area will not be in violation of the zoning regulations as shown on the attached site plan. 3. The resulting parcels are in conformity with the dimensional standards of the zoning district,including: a. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district; COMMENT: The building envelope meets the requirements of the R-4.5 Zoning District as shown on the attached site 3 • • • plan. b. The lot area shall be as required by the applicable zoning district. In the case of a flag lot,the accessway may not be included in the lot area calculation; COMMENT: The flag lots are well above the lot size minimum of 7,500 square feet without including the accessway. c. Each lot created through the partition process shall front a public right-of- way by at least 15 feet or have a legally recorded minimum 15-foot wide access easement; and COMMENT: Both flag lots will have 15 feet of frontage along SW 90th Avenue, a public road. d. With regard to flag lots: a. When the partitioned lot is a flag lot,the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. b. A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.745.040. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. COMMENT: There is an existing building on Tax Lot 1000 that meets the dimensional and setback standards of the R-4.5 District as shown on the attached site plan (Exhibit 1). Tax Lot 1301 is currently vacant. However, any future development on the site will occur within the R-4.5 standards. 5. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire-fighting capabilities.
