APPLICATION SUMMARY FILE NAME: LAIDLAW LOT LINE ADJUSTMENT CASE: Lot Line Adjustment MIS 98-0021 PROPOSAL: The applicant has requested Lot Line Adjustment approval to adjust the common property line between Tax Lots 00501 and 00100 on WCTM 2S102DA by decreasing Tax Lot 00501 by 5,102.22 square feet and increasing Tax Lot 00100 by that same amount. APPLICANT: E. ZONING DESIGNATION: Light Industrial; I-L. The purpose of the I-L zoning district is to provide appropriate locations for general industrial uses including industrial service, manufacturing and production, research and development, warehousing and freight movement, and wholesale sales activities with • few, if any, nuisance characteristics such as noise, glare, odor, and vibration. LOCATION: 12970 and 13070 SW Hall Boulevard; WCTM 2S102DA, Tax Lots 00100 and 00501. Tax lot 00500 is included as part of "Tract 2", however, the lot area in not being adjusted for this tax lot. APPLICABLE • REVIEW CRITERIA: The applicable Community Development Code Sections in effect prior to the 11/26/98 effective date of the Code rewrite are as follows: 18.32, 18.70 and 18.162. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF DECISION MIS 98-0021-LAIDLAW LOT LINE ADJUSTMENT PAGE 1 OF 5 • • CONDITION OF APPROVAL PRIOR TO THE RECORDING OF THE LOT LINE ADJUSTMENT,THE FOLLOWING CONDITION SHALL BE SATISFIED: UNLESS OTHERWISE NOTED,THE STAFF CONTACT SHALL BE BRIAN RAGER IN THE ENGINEERING DEPARTMENT(503) 639-4171. 1. A Lot Line Adjustment survey map and legal descriptions showing the existing and proposed lot lines shall be reviewed and approved by the Engineering Department. The survey map shall include all access and utility easements. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site History: TUP for temporary offices to operate school bus transportation service for Tigard/Tualatin schools. No other development applications were found to have previously been filed with the City of Tigard. Vicinity Information: To the west of and across SW Hall Boulevard, is property zoned CBD. Property to the north, south and east are zoned I-L. Property to the south, including a portion of "Tract 2" has an open space designation due to the Fanno Creek floodplain. Site Information and Proposal Description: The sites are currently developed. The applicant has identified the areas as "Tract 1" and "Tract 2." "Tract 2" consists of two (2) tax lots, only one (1) of which is being adjusted. The calculations provided are for all of Tract 2, not for the individual tax lot being adjusted. An existing structure on "Tract 1" (consisting of tax lot 00100) currently appears to encroach over the property line of "Tract 2" (consisting of tax lots 00501 and 00500). With the proposed adjustment, this situation will no longer exist. The Lot Line Adjustment will adjust the property line between "Tract 1" and "Tract 2" by increasing "Tract 1" by 5,102.22 square feet. Currently, the southern portion of "Tract 1" is triangular. The adjustment will square-up the lot line, creating a more "regular" shaped lot for both "Tract 1" and "Tract 2." SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.162.060 contains the following standards for approval of a Lot Line Adjustment request: An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; NOTICE OF DECISION MIS 98-0021-LAIDLAW LOT LINE ADJUSTMENT PAGE 2 OF 5 • An additional lot will not be created through this Lot Line Adjustment. Both existing lots are currently very large (1.49 acres for tax lot 00100 and 3.9 acres for tax lot 00501) and will not be reduced below the minimum lot size for the I-L zone. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and The existing building on "Tract 1" which is currently encroaching over the property line will better comply with the setbacks of the I-L zone after the adjustment. The existing building on "Tract 2" will not be in violation of the setbacks as a result of this adjustment. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed Lot Line Adjustment is within the I-L zoning district which has no minimum lot area requirement and an average lot width of 50 feet. Both lots have lot widths greater than 50 feet. FINDING: Because the resulting parcels will be in conformance with the dimensional standards of the zoning district, staff finds that these criteria have been met. SPECIAL PROVISIONS FOR LOTS CREATED THROUGH PARTITION PROCESS: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. The required lot width for lots zoned I-L is 50 feet. The lot widths after the Lot Line Adjustment will be in excess of 50 feet for both lots. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. Lot area was addressed previously in this decision under Lot Line Adjustment - Approval Standards. Lot Frontage: Each lot created through the partition process shall front a public right- of-way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. Each lot has, and will continue to have, more than 15 feet frontage along SW Hall Boulevard. Setbacks: Setbacks shall be as required by the applicable zoning district. The front yard setback in the I-L zone is 30 feet. No other setbacks apply because the lots do not abut a residential zoning district and are not corner or through lots. While the structures on these lots appear to have front yard setbacks of less than 30 feet, the Lot Line Adjustment does not make these setbacks more non-conforming. This criteria, therefore, has been met. NOTICE OF DECISION MIS 98-0021-LAIDLAW LOT LINE ADJUSTMENT PAGE 3 OF 5 • • Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. Neither lot is a flag lot, therefore, this standard does not apply. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Neither lot is a flag lot, therefore, this standard does not apply. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. This criterion is met because both sites will continue to use the existing accessways and will not be affected by this proposal. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. A common drive is not required as a result of this Lot Line Adjustment, however, the applicant is recording a 45-foot-wide ingress/egress easement in conjunction with this Lot Line Adjustment. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. The accessways are existing and will not be altered as a result of this proposal, therefore, this criterion has been satisfied. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication. of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. While portions of the lots are in the floodplain, no new development is proposed. FINDING: The Lot Line Adjustment proposal meets or exceeds the Special Provisions for Lots Created through the Partition Process, therefore, the SPECIAL PROVISIONS FOR LOTS CREATED THROUGH THE PARTITION PROCESS criteria have been met.
