APPLICATION SUMMARY FILE NAME: ACT III THEATRES LOT LINE ADJUSTMENT CASE: Lot Line Adjustment MIS 98-0016 PROPOSAL: The applicant has proposed a Lot Line Adjustment to common property lines between two (2) parcels. The purpose for the Lot Line Adjustment is to incorporate the revised area, currently developed as a parking lot that serves the Theatre, into the existing Act III Theatre site. Portland, OR 97205 Tigard, OR 97223 COMPREHENSIVE PLAN DESIGNATION: General Commercial; C-G. ZONING DESIGNATION: General Commercial; C-G. The purpose of the general commercial areas is to provide for major retail goods and services. Permitted uses in the C-G zoning district are public agency administrative services, lodge, fraternal and civic assembly, parking, amusement, animal sales and services, automotive sales and light equipment repairs, among other uses. LOCATION: 11626 SW Pacific Highway; WCTM 1S136DC, Tax Lot 00500 and 11640 SW Pacific Highway; WCTM 1 S136DB, Tax Lot 02400. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.32, 18.62 and 18.162. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. NOTICE OF DECISION MIS 98-0016- ACT III THEATRES LOT LINE ADJUSTMENT PAGE 1 OF 5 • • CONDITIONS OF APPROVAL PRIOR TO RECORDING THE LOT LINE ADJUSTMENT PLAT, THE FOLLOWING CONDITION SHALL BE SATISFIED: Unless otherwise noted, the staff contact shall be MARK ROBERTS, Planning Division (503) 639-4171. 1. A Lot Line Adjustment survey map and legal descriptions showing the existing and proposed property lines shall be reviewed and approved prior to recording. The survey map shall include all access and utility easements. AFTER RECORDING THE LOT LINE ADJUSTMENT PLAT, THE FOLLOWING CONDITION SHALL BE SATISFIED: 2. After recording the lot line adjustments, provide a copy of the recorded adjustment plat to the City of Tigard Engineering Department. STAFF CONTACT: Brian Rager. THIS APPROVAL SHALL BE VALID FOR 18 MONTHS FROM THE EFFECTIVE DATE OF THIS DECISION. SECTION III. BACKGROUND INFORMATION Site History: This site was previously a drive-in Theatre that was converted into an 5 screen Theatre through Site Development Review (SDR) 87-12. The Theatre was then later expanded by 6 screens to its current 11 screens through Site Development Review (SDR) 88-27. The applicant previously had approval for the Lot Line Adjustment as proposed under Lot Line Adjustment application (MIS) 91-0014. A related Minor Modification to the previous Site Development Review approvals was also completed at that time to add parking spaces within the affected adjustment area. Vicinity Information: This area has been designated General Commercial (C-G) since the Comprehensive Plan was adopted in 1983. Adjoining properties are primarily developed with a mixture of commercial and residential properties. To the west of the Act III Theatres site is a vacant commercial property. Site Information and Proposal Description: The applicant has proposed Lot Line Adjustment to incorporate areas that were previously developed with parking to serve the Theatre use. The Lot Line Adjustment would reduce a neighboring commercial parcel from 1.14 acres to .79 acres. The Theatre site would then correspondingly expand from 10.12 acres to 10.46 acres. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: • Lot Line Adjustment - Approval Standards: Section 18.162.060 contains the following standards for approval of a lot line adjustment request: NOTICE OF DECISION MIS 98-0016- ACT III THEATRES LOT LINE ADJUSTMENT PAGE 2 OF 5 / • • 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed adjustment will reconfigure the lot lines but no additional parcels will be created by the adjustment. The proposed Lot Line Adjustment will not create lot widths with an average of less than 50 feet. The General Commercial Zoning District does not have a minimum lot size requirement. The applicant has proposed to provide a 20-foot setback from the existing residence on Tax Lot 02400. No new structures are proposed at this time. Any future structures will be required to be reviewed for compliance with the underlying zoning setback standards through the building permit plan check review process. Special Provisions for Lots Created Through Partition Process: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15-foot-wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. NOTICE OF DECISION MIS 98-0016- ACT III THEATRES LOT LINE ADJUSTMENT PAGE 3 OF 5 • Criteria 1 has been met because an average lot width of 50 feet has been maintained. Criteria 2 is not applicable because the General Commercial Zoning District does not have a minimum lot size requirement. Criteria 3 is satisfied as both properties will continue to have access as previously approved. The Theatre site is provided access via a private street from SW Pacific Highway and from a driveway from SW 72nd Avenue. The other affected property has an existing driveway from SW Pacific Highway. Criteria 4 is addressed because a 20-foot setback has been provided to the existing residence which is the only existing structure in this area. Criteria 5 and 6 are not applicable to these properties because none of these sites meet the definition of a flag lot due to the common access easement. Upon future development of these properties, fire hydrants and other required Uniform Fire Code standards will be addressed, thereby, satisfying Criteria 7. Criteria 8 and 9 have been addressed because an existing private street was developed to serve the Theatre site and a driveway exists to serve the other site. Criteria 10 is not applicable as none of the parcels are within or adjacent to floodplain areas. SECTION V. OTHER STAFF COMMENTS A detailed review of the survey map and legal descriptions prior to the applicant recording the Lot Line Adjustment. SECTION VI. AGENCY COMMENTS Service providing utilities will have the opportunity to review the proposal and decision within the ten (10) day appeal period and may request reconsideration of the decision if it may adversely affect the utility's or fire district's abilities to provide service to the subject or neighboring properties. SECTION VII. BACKGROUND INFORMATION Site History: This site was previously a drive-in Theatre that was converted into an 5 screen Theatre through Site Development Review (SDR) 87-12. The Theatre was then later expanded by 6 screens to its current 11 screens through Site Development Review (SDR) 88-27. The applicant previously had approval for the Lot Line Adjustment as proposed under Lot Line Adjustment application (MiS) 91-0014. A related Minor Modification to the previous Site Development Review approvals was also completed at that time to add parking spaces within the affected adjustment area. • Vicinity information: • This area has been designated General Commercial (C-G) since the Comprehensive Plan was adopted in 1983. Adjoining properties are primarily developed with a mixture of commercial and residential properties. To the west of the Act III Theatres site is a vacant commercial property., • Site Information and Proposal Description: The applicant has proposed. Lot Line Adjustment to incorporate areas that were previously developed with parking to serve the Theatre use. The Lot Line Adjustment would reduce a neighboring commercial parcel from 1.14 acres to .79 acres. By reducing the lot size, the lot or Structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are In conformity with the dimensional standards of the zoning district. The proposed adjustment will reconfigure the lot lines but no additional parcels will be created by the adjustment. The proposed Lot Line Adjustment will not create lot widths with an average of less than 50 feet. The General Commercial Zoning District does not have a minimum lot size requirement. The applicant has proposed to provide a 20-foot.setback from the existing residence on Tax Lot 02400. No new structures are proposed at this time. Any future structures will be required to be reviewed for compliance with the underlying zoning setback standards through the building permit plan check review process. • 5.gecial Provisions for Lots Created Through Partition Process: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. . Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15-foot-wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Dgterjniriatign for Flag Lot: When the partitioned lot is a flag lot, the ;, developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on FlagLotts: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an ': '` abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening • may also be required to maintain privacy for abutting tots and to provide usable. outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Criteria c is not applicable because the General Commercial Zoning District does not have a minimum lot size requirement. Criteria 3 is satisfied as both properties will continue to have access as previously approved. The Theatre site is provided access via a private street from SW Pacific Highway and from a driveway from SW 72nd Avenue. The other affected property has.an existing driveway from SW Pacific Highway. Criteria 4 is addressed because a 20-foot setback has been provided to the existing residence which is the only existing structure in this area. Criteria 5 and 6 are not applicable to these properties because none of these sites meet the definition of a flag lot due to the common access easement. Upon future development of these properties, fire hydrants and other required Uniform Fire Code standards will be addressed, thereby, satisfying Criteria 7. Criteria 8 and 9 have been addressed because an existing private street was developed to serve the Theatre site and a driveway exists to serve the other site. Criteria 10 is not applicable as none of the parcels are within or adjacent to floodplain areas. • SECTION V. BACKGROUND INFORMATION Site History: This site was previously a drive-in Theatre that was converted into an 5 screen Theatre through Site Development Review (SDR) 87-12. The Theatre was then later expanded by 6 screens to its current 11 screens through Site Development Review (SDR) 88-27. The applicant previously had approval for the Lot Line Adjustment as proposed under Lot Line Adjustment application (MIS) 91-0014. A related Minor Modification to the previous Site Development Review approvals was also completed at that time to add parking spaces within the affected adjustment area. Vicinity Information: This area has been designated General Commercial (C-G) since the Comprehensive Plan was adopted in 1983. Adjoining properties are primarily developed with a mixture of commercial and residential properties. To the west of the Act III Theatres site is a vacant commercial property. Site Information and Proposal Description: The applicant has proposed Lot Line Adjustment to incorporate areas that were previously developed with parking to serve the Theatre use. The Lot Line Adjustment would reduce a neighboring commercial parcel from 1.14 acres to .79 acres. The Theatre site would then correspondingly expand from 10.12 acres to 10.46 acres. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Lot Line Adjustment - Approval Standards: Section 18.162.060 contains the following standards for approval of a lot line adjustment request: NOTICE OF DECISION MIS 98-0016- ACT III THEATRES LOT LINE ADJUSTMENT PAGE 2 OF 5 • . • 1. An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed adjustment will reconfigure the lot lines but no additional parcels will be created by the adjustment. The proposed Lot Line Adjustment will not create lot widths with an average of less than 50 feet. The General Commercial Zoning District does not have a minimum lot size requirement. The applicant has proposed to provide a 20-foot setback from the existing residence on Tax Lot 02400. No new structures are proposed at this time. Any future structures will be required to be reviewed for compliance with the underlying zoning setback standards through the building permit plan check review process. Special Provisions for Lots Created Through Partition Process: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: 1. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. 2. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. 3. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet, or have a legally recorded minimum 15-foot-wide access easement. 4. Setbacks: Setbacks shall be as required by the applicable zoning district. 5. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. 6. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. 7. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. 8. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement that will ensure access and maintenance rights shall be recorded with the approved partition map. 9. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. 10. Floodplain: Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. NOTICE OF DECISION MIS 98-0016- ACT III THEATRES LOT LINE ADJUSTMENT PAGE 3 OF 5 • • Criteria 1 has been met because an average lot width of 50 feet has been maintained. Criteria 2 is not applicable because the General Commercial Zoning District does not have a minimum lot size requirement. Criteria 3 is satisfied as both properties will continue to have access as previously approved. The Theatre site is provided access via a private street from SW Pacific Highway and from a driveway from SW 72nd Avenue. The other affected property has an existing driveway from SW Pacific Highway. Criteria 4 is addressed because a 20-foot setback has been provided to the existing residence which is the only existing structure in this area. Criteria 5 and 6 are not applicable to these properties because none of these sites meet the definition of a flag lot due to the common access easement. Upon future development of these properties, fire hydrants and other required Uniform Fire Code standards will be addressed, thereby, satisfying Criteria 7. Criteria 8 and 9 have been addressed because an existing private street was developed to serve the Theatre site and a driveway exists to serve the other site. Criteria 10 is, not applicable as none of the parcels are within or adjacent to floodplain areas. SECTION V. OTHER STAFF COMMENTS A detailed review of the survey map and legal descriptions prior to the applicant recording the Lot Line Adjustment. SECTION VI. AGENCY COMMENTS Service providing utilities will have the opportunity to review the proposal and decision within the ten (10) day appeal period and may request reconsideration of the decision if it may adversely affect the utility's or fire district's abilities to provide service to the subject or neighboring properties. Summary of Proposal Act III Theatres ("Applicant") is resubmitting a lot line adjustment application which was approved by Senior Planner Dick Bewersdorff August 26, 1992. The final survey of the lot line adjustment was never filed with the County Surveyor and the approval lapsed after 18 months. The Applicant leases the Tax Lot 500 from property owner Tom Moyer. Ron Champion is the adjacent property owner to the west. Tigard Community Development Code Approval Criteria Tigard Community Development Code ("TCDC") section 18.162.060 contains the standards for approval of a lot line adjustment request: 1 (17/000925/113095/DMD/200658.1) • • 18.162.060A(1). "An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustments is not reduced below the minimum lot size established by the zoning district;" Response: The proposed lot line adjustment will not create a new parcel. Parcel 2 is just increasing in square footage. Parcel l's dimensions will remain in compliance with CG zoning district size standards. 18.162.060A(2) "By reducing the lot size,the lot or structure(s)on the lot will not be in violation of the site development or zoning district regulations for that district; and" Response: Approval of the proposed lot line adjustment will not violate any of the CG development standards or zoning district setback requirements for the existing structures. This criterion is satisfied. 18.162.060A(3) 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. Response: Approval of the proposed lot line adjustment will not increase or decrease any parcel's dimensions in violation of the CG zoning district's size standards. This criterion is satisfied. 18.162.060(B) B. The provisions of Section 18.162.050 shall also apply to lot line adjustments. 18.162.050 Special Provisions for Lots Created through Partition Process. A. Lot Width: 1. The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: 1. Lot Frontage: 1. Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: 1. Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flat Lot: 1. When the partitioned lot is a flag lot,the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: 1. • A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: 1. The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on firefighting capabilities. H. Reciprocal Easements: 1. Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: 1. Any accessway shall comply with the standards set forth in Chapter 18.108,Access,Egress, and Circulation. J. Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain,the City shall require the dedication of sufficient open land area for greenway adjoining and within the 3 (17/000925/113095/DMD/200658.1) i • floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. (Ord. 90-41; Ord. 87-66; Ord. 84-29; Ord. 83-52) Response: Criteria A, B, C, and D are satisfied. Both parcels will exceed the 50 foot average minimum lot width. There is no minimum lot area required in the C-G zone. Each parcel will continue to have more than 15 feet of frontage on the public right-of-way, (tax lot 2400) on S.W. Pacific Highway and (tax lot 500) on S.W. 72nd Avenue. Existing structures on tax lot 500 will continue to meet setback requirements. Future development on tax lot 2400 will be reviewed to assure compliance with setback requirements. Criteria E,F and J are not applicable to these lots because neither are flag lots, and neither lot is within the floodplain. Existing accesses and fire hydrants are provided consistent with Community Development Code and Uniform Fire Code standards thereby satisfying criteria G. Criteria H is not applicable to these lots because a reciprocal easement is not required for these lots. Any accessway shall comply with code standards when required. IV.
