Dear Mr. Torgerson:
•
This letter is in response to your request for approval to place a 384 square foot storage .'` 4.•
building on the Hall Blvd. Baptist Church site. This property is designated residential (R-7
Zoning District) in which the present use of the site is a Conditional Use. The site received
Conditional Use approval in 1984 (CU 2-84) and again, for an expansion, in 1987 (CU
87-01). The Tigard Community Development Code Chapter 18.144, Accessory Structures, -
provides that a detached, subordinate structure, the use of which is clearly incidental to and
associated with the principal structure, may be placed on the same lot subject to review.
Section 18.144.070 provides the approval criteria for an accessory structure.
A. DIMENSIONAL APPROVAL CRITERIA
1. The following dimensions shall apply to all accessory structures:
a. For parcels within a residential zone that are less than 2.5 acres in size,
any accessory building within a residential zone shall have no more
than 528 square feet of gross floor area;
b. For parcels within a residential zone that are 2.5 acres in size or larger, -
any accessory building shall have nor more than 1,000 square feet of
gross floor area; and ,
c. In no case shall the accessory building(s) and principal structure ,:<;; :•'
exceed the maximum lot coverage allowed by the base zone; f>
The subject parcel is located within the R-7 Zoning District (Medium Density
Residential). According to the Washington County Tax Assessor's records, the subject
parcel is 3.75 acres in size. The 384 square foot storage building proposed is less than -
the maximum size allowed for a parcel of this size. The maximum lot coverage allowed .
by the R-7 zone is 80%, however, the applicant has not submitted any information on
the total area of impervious surfaces on the site. Therefore, this criterion has not been .
fully met. A condition of approval will require the applicant to submit a revised site plan -
indicating the total percentage of the site covered with impervious surfaces.

2. Except as provided in Section 18.144.070.A.3 below, accessory structures, in
residential zones shall maintain a rear and side yard setback of 5 feet.
Accessory structures within commercial and industrial zones shall comply
with the setback requirements of the applicable zone; As noted above under
#1, the subject parcel is in a residential zone. The site plan shows that the
proposed structure would be placed ninety feet from the nearest property line.
Staff finds that the structure will maintain a rear and side yard setback of over 5
feet in compliance with this criterion.
3. All freestanding and detached towers, antennas, wind generating device and -
TV receiving dishes shall; have setbacks equal to or greater than the height of
the proposed structure. Suitable protective anti-climbing fencing and a
landscape planting screen, in accordance with Chapter 18.100, Landscaping
and Screening, shall be provided and maintained around these structures and
accessory attachments; No towers, antennas or other similar freestanding
detached structures are proposed. Therefore, this criterion does not apply.
4. See Chapter 18.98, Building Height Limitation Exceptions, for exceptions.
The maximum building height in the underlying R-7 zoning district is 35 feet. The
• proposed accessory structure is noted as 16 feet high on the site plan. . No
exceptions to the building height limitations are requested with this application.
Therefore, this criterion does not apply.
B. NON-DIMENSIONAL APPROVAL CRITERIA
1. Accessory structures or buildings shall comply with all requirements for the
principal structure, except where specifically modified by this chapter; The
principal structure received Conditional Use and Site Development Review
approval in 1984 and Conditional Use approval of an expansion in 1987. Neither
approval was conditioned with any additional requirements for the church
structure. Therefore, this criterion does not apply.
2. If an application proposed for an accessory structure meets the following -
criteria, the Director shall approve the application proposal;
a. No accessory building or structure -shall be allowed in any required
front yard; The applicants site plan shows the proposed location of the
'accessory structure approximately 82 feet south of the existing building
and setback over 300 feet from Hall Boulevard. The underlying R-7 zone

has a required front yard setback of 15 feet. Based on the applicant's site
plan, staff finds that the proposed structure will not infringe into the
required front yard. Therefore, this criterion has been met.
b. The applicant shall present documentation of the possession of any
required license by any federal, state or local agency; No federal, state
or local agency license is required for a storage building. Therefore, this
criterion does not apply.

c. Any accessory building or structure attached to the principal building
or structure must comply with all setbacks of the zoning district
(attached means wall-to-wall or any permanent roof attachment such
as breezeways); The proposed structure is not attached to the principal
structure by common wall or permanent roof. The site plan shows a
separation between the accessory structure and the principal structure of _
approximately 82 feet. Therefore, this criterion does not apply. •
d. No accessory building or structure shall encroach upon or interfere
with the use of any adjoining property or public right-of-way including y .
but not limited to streets, alleys and public or private easements; The
site plan shows the proposed accessory building located approximately 90 •
feet from the nearest (south) property line and several hundred feet from the
Hall Boulevard right-of-way. Staff finds that the proposed structure will not
encroach upon or interfere with the use of adjoining property or public right-
of-way. The applicant has not, however, shown the location of any public or
private easements. Therefore, this criterion has not been fully met.
e. TV receiving dishes may be erected upon the roof of a structure only
within a commercial or industrial zone; This proposal does not include
installation of a TV receiving dish. Therefore, this criterion does not apply.
f. All accessory structures shall be built in accordance with the Uniform
Building Code; The City of Tigard Building Division will require compliance
with the uniform Building Code prior to issuance of Building Permits.
Therefore, this criterion has not been met at this time. A condition of.
approval will require that the applicant obtain building permits before
beginning work.
3. Accessory structures which are non-conforming are subject to the
requirements of Chapter 18.132., Non-conforming Situations, where an
alteration, extension or reconstruction is requested; This proposal is for
placement of a new storage building and does not involve alteration, expansion •
or reconstruction of an existing non-conforming accessory structure. Therefore,
this criterion does not apply.
4. In instances where an alteration, extension or reconstruction is requested,
applicant shall apply for an accessory structure permit in accordance with
Section 18.144.040; This application does not involve alteration, extension or
reconstruction of an existing structure. Therefore, this criterion does not apply.
5. A conflict of interpretation concerning whether the structure is an accessory
structure shall be resolved in accordance with the provisions of Section
18.32.090. The proposed structure is to be used for storage only. This use is
incidental to and associated with the principal church use. Furthermore, the site
plan clearly shows that the proposed 384 square foot storage building would be

subordinate to the principal church structure. Staff finds that the proposed
structure meets the definition of an accessory structure (18.144.020). Therefore,
this criterion does not apply.
Based on the above findings, the Director's designee has determined that the approval
• criteria have been met. The proposed Accessory Structure permit is therefore
approved.
THIS REQUEST HAS BEEN APPROVED SUBJECT TO THE FOLLOWING
CONDITIONS OF APPROVAL:
1. . All conditions must be satisfied prior to issuance of site or building permits.
2. A revised site plan shall be submitted for approval. Staff Contact: M.J. Roberts
(503-639-4171 x315). The revised plan shall include:
a. Updated labeling of existing structures to indicate the accessory structure as
"proposed" and the existing buildings as "existing";
b. Calculations of the percentage of the site covered with impervious surfaces;
and
c. Location, size and purpose of all public and private easements located on
the subject property, or a statement that no easements exist.
3. A building permit must be obtained for the proposed accessory structure.
Please provide a copy of this letter when applying for permits. There is a fee for the
required permits. Please contact the Development Services Division for information on
current fees.
