MIS 97-0021 will adjust the common property line between Tax Lot 01103 and 01300 on WCTM 1 S135AD. The adjustment will increase Tax Lot 01300 by 11,359 square feet to 154,229 square feet and decrease Tax Lot 01103 to 23,635 square feet. The second lot line adjustment (MIS 97-0020) will further adjust Tax Lot 01300 by altering the lot line between Tax Lot 01300 and Tax Lot 01200. This adjustment will decrease Tax Lot 01300 by 134,231 square feet, leaving 19,998 square feet (after the first adjustment) and will increase Tax Lot 01200 by the same amount leaving 217,474 square feet. The approval has, therefore, expired. No other land use applications were found to have been filed for this site. Vicinity Information: The property is within the city limits of the City of Tigard and zoned R-4.5. Properties to the east, west and south are zoned R-4.5. The property to the north of the site is zoned R-12. Site Information and Proposal Description: There is an existing residence on Tax Lot 01103. Tax lots 01300 and 01200 are vacant. Ash Creek runs through existing Tax Lot 01300 with associated wetlands and 100-year floodplain. The adjustment will create a new lot line for Tax Lot 01300 that follows the line of Ash Creek. The adjustment will provide access via the proposed panhandle to the currently landlocked Tax Lot 01300. NOTICE OF DECISION MIS 97-0020 and MIS 97-0021 -DAVIS LOT LINE ADJUSTMENT PAGE 2 OF 6 SECTION IV. - APPLIIBLE REVIEW CRITERIA AND ft DINGS THE APPLICABLE SECTIONS OF THE COMMUNITY DEVELOPMENT CODE ARE INDICATED IN THIS SECTION IN THE"BOLD"PRINT FOLLOWED BY A REVIEW FOR COMPLIANCE AND FINDINGS,IF ANY,BY STAFF. LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.162.060 contains the following standards for approval of a lot line adjustment request: An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; The lots will not be reduced below the minimum 7,500 square feet in the R-4.5 zone. There are three (3) lots before the adjustment and there will be three (3) lots after the adjustment, therefore, no additional lots are being created. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and Tax Lots 01200 and 01300 are currently vacant. There is an existing single-family dwelling on Tax Lot 01103, however, the adjustment will not result in a violation of any existing setback ;r standards. The house will retain a 7-foot side yard setback from the property line and no other property line will be adjusted that would affect setbacks from existing structures. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed Lot Line Adjustment is within the R-4.5 zoning district which requires 7,500 square foot lots with an average width of no less than 50 feet. The proposed re-configured lots will meet these standards. Any new structures placed on the vacant lots will require compliance with the code in effect at the time of development. The dimensional requirements of the underlying zone are discussed in further detail in the following pages. FINDING: Because the proposed lot line adjustments meet the dimensional standards of the underlying zone and no additional parcels are created, the lot line adjustment approval criteria have been satisfied. SPECIAL PROVISIONS FOR LOTS CREATED THROUGH PARTITION PROCESS: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. The required lot width for lots zoned R-4.5 is 50 feet. The lot widths after the Lot Line Adjustment will be 105 feet for Tax Lot 01103, approximately 115 feet for Tax Lot 01300 and well over 300 feet for Tax Lot 01200. NOTICE OF DECISION MIS 97-0020 and MIS 97-0021 -DAVIS LOT LINE ADJUSTMENT PAGE 3 OF 6 Lot Area: The lot area sib be as required by the applicable�ning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. The altered lot area for each lot will exceed the 7,500 square foot minimum required in the R-4.5 zone. Lot Frontage: Each lot created through the partition process shall front a public right-of- way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. Tax Lot 01200 currently has adequate access to SW Oak Street. Tax Lot 01300 is currently landlocked and will, after the adjustments, have 15 feet of frontage on SW Spruce. Tax Lot 01103 will have 90 feet of frontage after the lot line adjustment is recorded. Setbacks: Setbacks shall be as required by the applicable zoning district. Setbacks have been discussed previously in this decision under Lot Line Adjustment - Approval Standards. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. Tax Lot 01300 will be a flag lot as result of this adjustment, however, this standard cannot be applied until a structure is proposed to be constructed. This standard will be required to be met at time of development. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. This standard applies to Tax Lot 01300 because it is a flag lot, however, this standard will not be applied until Tax Lot 01300 is developed. A condition of approval of building permits will be the screening of the paved access drive. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. The accessway to Tax Lot 01300 meets the standards for access widths serving single-family residential lots. The length would not require an additional fire hydrant. Fire protection will be looked at in more detail at the time of development for either of the vacant lots. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. No reciprocal easements are required or proposed for this lot line adjustment. NOTICE OF DECISION MIS 97-0020 and MIS 97-0021 -DAVIS LOT LINE ADJUSTMENT PAGE 4 OF 6 Accesswav: Any accessay shall comply with the stands set forth in Chapter 18.108; Access, Egress, and Circulation. The accessway to the residence on Tax Lot 01103 is existing and will not be altered as a result of this proposal. Any access Tax Lot 01300 or 01200 will be addressed when building permits are obtained and must meet all applicable standards in effect at the time of construction. Floodplain: Where landfill and/or development is allowed within or adjacent to the one- hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Tax Lot 01300 is in the 100-year floodplain of Ash Creek and there are associated wetlands. This area is designated as a portion of the pedestrian and bicycle pathway system within the adopted Park and Trail Master Plan. Staff has determined that no conditions of approval to dedicate open space will be required due to several factors. The first reason, is that the precise alignment and design of the trail system within this area has not been determined, making dedication of the right-of-way, or an easement, not possible. The second reason, is that because no lots are being created as a result of this proposal, staff cannot justify dedications based on a rough proportionality of development costs. At the time of development for Tax Lot 01300, it may be possible to justify a dedication for this purpose. NOTE TO APPLICANT: This site has sensitive lands and is regulated by the Water Resources Overlay standards. Please be aware that any development,including the construction of a single family-dwelling may require additional review and additional restrictions. FINDING: Because the Lot Line Adjustment proposal meets or exceeds the Special Provisions for Lots Created Through the Partition Process, as stated above, and required by 18.162.060, staff finds the criteria for approval have been met. SECTION V. ADDITIONAL STAFF COMMENTS The Engineering Department will complete a detailed review of the submitted Lot Line Adjustment survey map and legal descriptions prior to recording of the Lot Line Adjustment. SECTION VI. AGENCY COMMENTS Service providing utilities will have the opportunity to review the proposal and decision within the ten (10) day appeal period and may request reconsideration of the decision if it may adversely affect the utilities or fire district's abilities to provide service to the subject properties or the neighboring properties. The adjustment was to the corner of the driveway to lot 1300. Rather than having a sharp corner at the end of the drive it has been curved to make egress and ingress to lot 1300 easier as well as giving more clearance between house and west lot line. Lot 1103 had 23,719 sq.ft. before the lot line adjustment and is now 23,635 sq. ft.. See Exhibits "A" and "B" for more detail. Exhibit "A" is after the lot line adjustment has been made, while Exhibit "B" is before the adjustment. Tax Lot 1200 & Tax Lot 1300 The current north lot line of TL 1300 is to be moved down to the middle point of creek (see yellow line on marked up drawing). The approval has, therefore, expired. No other land use applications were found to have been filed for this site. Vicinity Information: The property is within the city limits of the City of Tigard and zoned R-4.5. Properties to the east, west and south are zoned R-4.5. The property to the north of the site is zoned R-12. Site Information and Proposal Description: There is an existing residence on Tax Lot 01103. Tax lots 01300 and 01200 are vacant. Ash Creek runs through existing Tax Lot 01300 with associated wetlands and 100-year floodplain. The adjustment will create a new lot line for Tax Lot 01300 that follows the line of Ash Creek. The adjustment will provide access via the proposed panhandle to the currently landlocked Tax Lot 01300. APPLIABLE REVIEW CRITERIA AND IDINGS THE APPLICABLE SECTIONS OF THE COMMUNITY DEVELOPMENT CODE ARE INDICATED IN THIS SECTION IN THE"BOLD"PRINT FOLLOWED BY A REVIEW FOR COMPLIANCE AND FINDINGS,IF ANY,BY STAFF. LOT LINE ADJUSTMENT - APPROVAL STANDARDS: Section 18.162.060 contains the following standards for approval of a lot line adjustment request: An additional parcel is not created by the Lot Line Adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; The lots will not be reduced below the minimum 7,500 square feet in the R-4.5 zone. There are three (3) lots before the adjustment and there will be three (3) lots after the adjustment, therefore, no additional lots are being created. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and Tax Lots 01200 and 01300 are currently vacant. There is an existing single-family dwelling on Tax Lot 01103, however, the adjustment will not result in a violation of any existing setback standards. The house will retain a 7-foot side yard setback from the property line and no other property line will be adjusted that would affect setbacks from existing structures. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed Lot Line Adjustment is within the R-4.5 zoning district which requires 7,500 square foot lots with an average width of no less than 50 feet. The proposed re-configured lots will meet these standards. Any new structures placed on the vacant lots will require compliance with the code in effect at the time of development. The dimensional requirements of the underlying zone are discussed in further detail in the following pages. FINDING: Because the proposed lot line adjustments meet the dimensional standards of the underlying zone and no additional parcels are created, the lot line adjustment approval criteria have been satisfied. SPECIAL PROVISIONS FOR LOTS CREATED THROUGH PARTITION PROCESS: Section 18.162.060 states that in addition to meeting the above standards, a Lot Line Adjustment must also meet the following criteria applicable to lots created through the Minor Land Partition process: Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. The required lot width for lots zoned R-4.5 is 50 feet. The lot widths after the Lot Line Adjustment will be 105 feet for Tax Lot 01103, approximately 115 feet for Tax Lot 01300 and well over 300 feet for Tax Lot 01200. NOTICE OF DECISION MIS 97-0020 and MIS 97-0021 -DAVIS LOT LINE ADJUSTMENT PAGE 3 OF 6 Lot Area: The lot area shall a as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. The altered lot area for each lot will exceed the 7,500 square foot minimum required in the R-4.5 zone. Lot Frontage: Each lot created through the partition process shall front a public right-of- way by at least 15 feet, or have a legally recorded minimum 15 foot wide access easement. Tax Lot 01200 currently has adequate access to SW Oak Street. Tax Lot 01300 is currently landlocked and will, after the adjustments, have 15 feet of frontage on SW Spruce. Tax Lot 01103 will have 90 feet of frontage after the lot line adjustment is recorded. Setbacks: Setbacks shall be as required by the applicable zoning district. Setbacks have been discussed previously in this decision under Lot Line Adjustment - Approval Standards. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. Tax Lot 01300 will be a flag lot as result of this adjustment, however, this standard cannot be applied until a structure is proposed to be constructed. This standard will be required to be met at time of development. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. This standard applies to Tax Lot 01300 because it is a flag lot, however, this standard will not be applied until Tax Lot 01300 is developed. A condition of approval of building permits will be the screening of the paved access drive. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. The accessway to Tax Lot 01300 meets the standards for access widths serving single-family residential lots. The length would not require an additional fire hydrant. Fire protection will be looked at in more detail at the time of development for either of the vacant lots. Reciprocal Easements: Where a common drive is to be provided to serve more than one (1) lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. No reciprocal easements are required or proposed for this lot line adjustment. NOTICE OF DECISION MIS 97-0020 and MIS 97-0021 -DAVIS LOT LINE ADJUSTMENT PAGE 4 OF 6 Accesswav: Any acces•y shall comply with the standards set forth in Chapter 18.108; Access, Egress, and Circulation. The accessway to the residence on Tax Lot 01103 is existing and will not be altered as a result of this proposal. Any access Tax Lot 01300 or 01200 will be addressed when building permits are obtained and must meet all applicable standards in effect at the time of construction. Floodplain: Where landfill and/or development is allowed within or adjacent to the one- hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Tax Lot 01300 is in the 100-year floodplain of Ash Creek and there are associated wetlands. This area is designated as a portion of the pedestrian and bicycle pathway system within the adopted Park and Trail Master Plan. Staff has determined that no.conditions of approval to dedicate open space will be required due to several factors. The first reason, is that the precise alignment and design of the trail system within this area has not been determined, making dedication of the right-of-way, or an easement, not possible. The second reason, is that because no lots are being created as a result of this proposal, staff cannot justify dedications based on a rough proportionality of development costs. At the time of development for Tax Lot 01300, it may be possible to justify a dedication for this purpose. NOTE TO APPLICANT: This site has sensitive lands and is regulated by the Water Resources Overlay standards. Please be aware that any development including the construction of a single family-dwelling may require additional review and additional restrictions. FINDING: Because the Lot Line Adjustment proposal meets or exceeds the Special Provisions for Lots Created Through the Partition Process, as stated above, and required by 18.162.060, staff finds the criteria for approval have been met. SECTION V. ADDITIONAL STAFF COMMENTS The Engineering Department will complete a detailed review of the submitted Lot Line Adjustment survey map and legal descriptions prior to recording of the Lot Line Adjustment. SECTION VI. AGENCY COMMENTS Service providing utilities will have the opportunity to review the proposal and decision within the ten (10) day appeal period and may request reconsideration of the decision if it may adversely affect the utilities or fire district's abilities to provide service to the subject properties or the neighboring properties.
