MIS1995-00020 • NOTICE OF DECISION LOT LINE ADJUSTMENT MIS 95-0020 • MISTLE R/SMITH APPLICATION: The applicant requests approval of a Lot Line Adjustment on two parcels of approximately .14 and .18 acres. ZONING DESIGNATION: R-4.5 (Residential, 4.5 units per acre). LOCATION: 10040 SW Johnson Street (WCTM 2S1 2BB, tax lot 800) and 10050 SW Johnson Street (WCTM 2S1 2BB, tax lot 833). South of SW Brookside Avenue, north of SW Grant Avenue and west of SW Johnson Street. DECISION: Notice is . hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to the following conditions: 1. A lot line adjustment survey map and legal descriptions showing the existing and proposed lot lines shall be reviewed and approved by the Engineering Department. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE FINAL DECISION DATE NOTED UNDER THE PROCESS AND APPEAL SECTION BELOW. BACKGROUND: The subject lots were created in 1979 through a lot line adjustment (MLP 17-79). An existing house is located on the front lot. A garage to be partially removed is located on the rear lot. The proposed adjustment will reconfigure the lots while retaining the existing lot areas. No other development applications were found to have been filed with the City. NOTICE OF DECISION MISTIER/SMITH-MIS 95-0020 PAGE f • • FINDINGS AND CONCLUSIONS: The findings and conclusions on which the decision is based are noted below: Community Development Code Section 18.162.060 contains standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure the lot lines, however an additional parcel will not be created by the adjustment. The request also reconfigures an equal amount of square footage which means that neither parcel will be reduced in size. The subject properties are considered non-conforming lots of record. The non-conforming status is related to lot area. Section 18.132.040.A.2.b. allows development of a single family residence on a non-conforming lot. Since the adjustment will not change the lot areas, the subject request will not increase the non-conforming status of the lots. In addition to meeting the above standards, a lot line adjustment must also meet the following criteria applicable to lots created through the minor land partition process (Code Section 18.162.050): A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area.calculation. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved:_ partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for - the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. NOTICE OF DECISION MISTIER/SMITH-MIS 95-0020 PAGE 3 • • Criteria A is satisfied as the minimum lot widths of parcel 1 (tax lot #833) and parcel 2 (tax lot#800) are 67 and 77 feet respectively, thereby exceeding the 50 foot minimum lot width. Criteria B is satisfied as the lots are considered non-conforming lots of record as related to lot area. The proposal will not increase the non-conformity of either lot. Criteria C is not applicable as this request does not involve a land partition and the proposed adjustment will not effect the frontage currently provided. It should be noted however, that parcel 2 is a non-conforming lot of record with only 10 feet of frontage on SW Johnson Street. A 10 foot paved driveway can be provided, satisfying the minimum required paved driveway width. The proposed adjustment will continue to satisfy the setback standards for the existing house on parcel 1, thereby satisfying criteria D. Criteria D shall be satisfied on parcel 2 as setbacks will be reviewed when it is build upon. Section 18.96.090 states that the owner of a flag lot may determine the location of the front yard, provided that the side yard setback area is not less than 10 feet. The applicant will have to revise the planned addition to comply with the 10 foot side yard setback standard, to be done at the time of building permit plan submission. The applicant is proposing to remove a portion of the existing garage in order to satisfy the setback requirements. Criteria E and F are not applicable as this application does not involve a partition of land, only a slight adjustment in property lines. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H is not applicable as these lots do not share a common driveway. Criteria I is satisfied on lot 1. Criteria I shall be satisfied on lot 2 when it is built upon and reviewed during the building permit process. Criteria J is not applicable as neither parcel is within the floodplain. The City of Tigard Engineering Department and Building Division have reviewed the proposal and have offered no comments or objections. The Engineering Department will complete a detailed review of the submitted lot line adjustment survey map and legal descriptions prior to the end of the appeal period. Service providing utilities will have the opportunity to review the proposal and decision within the 10 day appeal period and may request reconsideration of the decision if it may adversely affect the utility's or fire district's abilities to provide service to the subject properties or neighboring properties. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. J. Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. • NOTICE OF DECISION MISTIER/SMITH-MIS 95-0020 PAGE 3 • • Criteria A is satisfied as the minimum lot widths of parcel 1 (tax lot#833) and parcel 2 (tax lot#800) are 67 and 77 feet respectively, thereby exceeding the 50 foot minimum lot width. Criteria B is satisfied as the lots are considered non-conforming lots of record as related to lot area. The proposal will not increase the non-conformity of either lot. Criteria C is not applicable as this request does not involve a land partition and the proposed adjustment will not effect the frontage currently provided. It should be noted however, that parcel 2 is a non-conforming lot of record with only 10 feet of frontage on SW Johnson Street. A 10 foot paved driveway can be provided, satisfying the minimum required paved driveway width. The proposed adjustment will continue to satisfy the setback standards for the existing house on parcel 1, thereby satisfying criteria D. Criteria D shall be satisfied on parcel 2 as setbacks will be reviewed when it is build upon. Section 18.96.090 states that the owner of a flag lot may determine the location of the front yard, provided that the side yard setback area is not less than 10 feet. The applicant will have to revise the planned addition to comply with the 10 foot side yard setback standard, to be done at the time of building permit plan submission. The applicant is proposing to remove a portion of the existing garage in order to satisfy the setback requirements. Criteria E and F are not applicable as this application does not involve a partition of land, only a slight adjustment in property lines. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H is not applicable as these lots do not share a common driveway. Criteria I is satisfied on lot 1. Criteria I shall be satisfied on lot 2 when it is built upon and reviewed during the building permit process. Criteria J is not applicable as neither parcel is within the floodplain. The City of Tigard Engineering Department and Building Division have reviewed the proposal and have offered no comments or objections. The Engineering Department will complete a detailed review of the submitted lot line adjustment survey map and legal descriptions prior to the end of the appeal period. Service providing utilities will have the opportunity to review the proposal and decision within the 10 day appeal period and may request reconsideration of the decision if it may adversely affect the utility's or fire district's abilities to provide service to the subject properties or neighboring properties.
