APPLICATION: The applicant requests approval of a Lot Line Adjustment to adjust two parcels of approximately 5,541 and 5,317 square feet into two parcels of approximately 5,295 and 5,563 square feet. ZONING Designation: R-25 (Residential, 25 units per acre) LOCATION: 11840 SW Tallwood Drive (WCTM 1S1 33CD, tax lot 13500) and 11866 SW Tallwood Drive(WCTM 1S1 33CD,tax lot 13600). DECISION: Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to the following conditions: 1. A lot line adjustment survey map and legal descriptions showing the existing and proposed lot lines shall be reviewed and approved by the Engineering Department. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE FINAL DECISION DATE NOTED UNDER THE PROCESS AND APPEAL SECTION BELOW. BACKROUND: No development applications were found to have been filed with the City. FINDINGS AND CONCLUSIONS: The findings and conclusions on which the decision is based are noted below: Community Development Code Section 18.162.060 contains standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the lot line adjustment, and the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by the zoning district; 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and NOTICE OF DECISION - RAK DEVELOPMENT CO. MIS95-0019 PAGE 1 • • r: 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment will reconfigure the lot lines, however an additional parcel will not be created by the adjustment. Both lots will meet the 3,050 square foot minimum lot size. There is no minimum lot width requirement in the R-25 zone. All site development improvements applicable to lot 27 will remain consistent with Code requirements. A building permit has been issued for lot 26. The site drawings submitted with that permit had already incorporated the lot line adjustment, therefore lot 26 will be consistent with code requirements. In addition to meeting the above standards, a lot line adjustment must also meet the following criteria applicable to lots created through the minor land partition process (Code Section 18.162.050): A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right-of-way by at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. - F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. s NOTICE OF DECISION - RAK DEVELOPMENT CO. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108,Access, Egress, and Circulation. J. Where landfill and/or development is allowed within or adjacent to the one- hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria A is satisfied as there is no minimum lot width requirement in the R-25 zone. Criteria B is satisfied as the lot areas are approximately 5,541 and 5,317 square feet, exceeding the minimum 3,050 minimum lot size requirement. Criteria C is satisfied as each lot contains approximately 50 feet of frontage on a SW Tallwood Drive, exceeding the minimum 15 foot minimum width requirement. The proposed adjustment will provide complaince with the setback standards on lot 27, thereby satisfying criteria D. Criteria D shall be satisfied on lot 26 as setbacks have been reviewed as part of the building permit issued for that lot. The site drawings submitted with that permit had already incorporated the lot line adjustment. Criteria E and F are not applicable as these lots are not flag lots. Fire hydrants shall be consistent with Uniform Fire Code standards thereby satisfying Criteria G. Criteria H is not applicable as these lots do not share a common driveway. Criteria I is satisfied as shown on the approved building permit site plans. Criteria J is not applicable as neither parcel is within the floodplain. The City of Tigard Engineering Department and Building Division have reviewed the proposal and have offered no comments or objections. The Engineering Department will complete a detailed review of the submitted lot line adjustment survey map and legal descriptions prior to the end of the appeal period. Service providing utilities will have the opportunity to review the proposal and decision within the 10 day appeal period and may request reconsideration of the decision if it may adversely affect the utility's or fire district's abilities to provide service to the subject properties or neighboring properties. Costa Pacific Homes is also building all the houses within the subdivision. Lot 26 is currently vacant and a house is under construction on Lot 27. During the layout for the foundation of the Lot 27 house, a field error was made with respect to its placement relative to the northerly line of Lot 27. Instead of being parallel to and 5 feet southerly of the north line of Lot 27 as shown on the approved plot plan, the foundation is parallel to and 5 feet southerly of a line drawn from the northwest corner of the Lot 27 to an angle point in the rear line of Lot 26, which angle point is 5.01 feet northerly of the northeast corner of Lot 27. The original proposed location for the foundation and its actual as-constructed position is shown on the accompanying Stakeout Plan. Costa Pacific Homes does not wish to demolish the errantly placed foundation, and requests that the boundary line between Lots 26 and 27 be adjusted to the location shown on the accompanying Proposed Lot Line Adjustment plan. This will enable the as-constructed foundation on Lot 27 to conform to required setbacks. Costa Pacific Homes is currently developing plans for a house on Lot 26 and is able to incorporate the revised lot configuration into its plot plan.
