y/7LfefT"R„ • CITY OF TIGARD LOT LINE ADJUSTMENT MIS 95-0001 REISSUED DECISION DAVIS/COLE APPLICATION: The applicant requests approval of a Lot Line Adjustment to adjust two parcels of approximately 3.25 acres and 34,848 square feet into two parcels of approximately 3.50 acres and 23,719 square feet respectively. This decision has been reissued because the scheduled City Council Meeting within the previous appeal period was not held due to weather conditions. Reissuance of the decision is allowed under Section 18.32.300(A) of the Community Development Code. ZONING DESIGNATION: R-4.5 (Single Family Residential) COMPREHENSIVE PLAN DESIGNATION: Low Density Residential (1-5 units per acre) LOCATION: 8811 SW Spruce Street (WCTM 1S1 35AD, tax lot 1103) and 8800 Block of SW Spruce Street (WCTM 1S1 35AD, tax lot 1300). DECISION: Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to the following conditions: 1. A lot line adjustment survey map and legal descriptions showing the existing and proposed lot lines shall be reviewed and approved by the Engineering Department. STAFF CONTACT: John Hadley, Engineering Department. THE FOLLOWING CONDITION SHALL BE SATISIFIED PRIOR TO THE ISSUANCE OF BUILDING PERMITS: 1. Screening on the proposed flag lot shall be provided along the property line of tax lot 1300 where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening is also required to be provided to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. STAFF CONTACT: Mark Roberts, Planning Division. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE FINAL DECISION DATE NOTED UNDER THE PROCESS AND APPEAL SECTION BELOW. FINDINGS AND CONCLUSIONS: The findings and conclusions on which the decision is based are noted below: Community Development Code Section 18.162.060 contains standards for approval of a lot line adjustment request: 1. An additional parcel is not created by the lot line adjustment, and the existing parcels reduced in size by the adjustment are not reduced below the minimum lot size established by the zoning district; NOTICE OF REISSUED DECISION - DAVIS/COLE - MIS 95-0001 PAGE 1 111 • 2. By reducing the lot size, the lot or structure(s) on the lot will not be in violation of the site development or zoning district regulations for that district; and 3. The resulting parcels are in conformity with the dimensional standards of the zoning district. The proposed lot line adjustment is consistent with these standards. The proposed adjustment would reconfigure the lot lines, however no additional parcels will be created by the adjustment. The R-4.5 zone requires a minimum lot area of 7,500 square feet. Both reconfigured parcels will continue to exceed the 50 foot average minimum lot width requirement of the zone. All site development improvements applicable to the parcels will remain consistent with Code requirements. In addition to meeting the above standards, a lot line adjustment must also meet the following criteria applicable to lots created through the minor land partition process (Code Section 18.162.050): A. Lot Width: The minimum width of the building envelope area shall meet the lot requirement of the applicable zoning district. B. Lot Area: The lot area shall be as required by the applicable zoning district. In the case of a flag lot, the accessway may not be included in the lot area calculation. C. Lot Frontage: Each lot created through the partition process shall front a public right-of- way of at least 15 feet or have a legally recorded minimum 15 foot wide access easement. D. Setbacks: Setbacks shall be as required by the applicable zoning district. E. Front Yard Determination for Flag Lot: When the partitioned lot is a flag lot, the developer may determine the location of the front yard, provided that no side yard is less than 10 feet. Structures shall generally be located so as to maximize separation from existing structures. F. Screening on Flag Lots: A screen shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. G. Fire Protection: The fire district may require the installation of a fire hydrant where the length of an accessway would have a detrimental effect on fire fighting capabilities. H. Reciprocal Easements: Where a common drive is to be provided to serve more than one lot, a reciprocal easement which will ensure access and maintenance rights shall be recorded with the approved partition map. I. Accessway: Any accessway shall comply with the standards set forth in Chapter 18.108, Access, Egress, and Circulation. NOTICE OF REISSUED DECISION - DAVIS/COLE - MIS 95-0001 PAGE 2 • • • J. Where landfill and/or development is allowed within or adjacent to the one-hundred-year floodplain, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain. This area shall include portions at a suitable elevation for the construction of a pedestrian/bicycle pathway with the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Criteria A, B, C and D are satisfied through the design of this adjustment. Criteria A is met because both lots comply with the minimum lot area required in the R-4.5 zone. The proposed lot widths for the parcels exceed the 50 foot average lot width requirement. Criteria B is met because each parcel will have total square footage in excess of the 7,500 square foot lot minimum for the R-4.5 zone. Criteria C has been met because the properties will have direct property frontage along SW Spruce Street with a minimum of 15 feet in width. Criteria D has been met because the existing residence on the Tax Lot 1103 (8811 SW Spruce Street) will continue to comply with setback requirements in the R-4.5 zone. The 3.50 acre parcel with wetlands and 100- year flood plain area will gain legal access to SW Spruce Street. Criteria E will be reviewed and designed for through the Building Permit Plan Check review of building setbacks. Criteria G will be reviewed through the Building Permit Plan Check Review. Criteria F, H and I are applicable to this property line adjustment because screening on the proposed flag lot shall be provided along the property line of a lot of record where the paved drive in an accessway is located within ten feet of an abutting lot in accordance with Sections 18.100.080 and 18.100.090. Screening may also be required to maintain privacy for abutting lots and to provide usable outdoor recreation areas for proposed development. Criteria J has been reviewed through this application no additional Conditions of Approval are recommended due to the following circumstances. The proposed flag lot is partially within the 100-Year Floodplain and is designated as a portion of the Pedestrian and Bicycle Pathway System within the adopted Park and Trail Master Plan. Because the precise alignment and design of the trail system within this area has not been determined, dedication of right-of-way or the creation of an easement for this purpose is not possible. Service providing agencies will have the opportunity to review the proposal and decision within the 10-day appeal period and may request reconsideration of the decision if it may adversely affect their ability to provide service to the subject properties or neighboring properties.
