KNOW ALL MEN BY THESE PRESENTS, that Terry E. Crane and Willodean
Crane, hereinafter referred to as Grantor, in consideration of the sum of ONE THOUSAND
AND NO /100 ($1,000.00) Dollars and other good and valuable consideration to said Grantor
in hand paid by The City of Tigard, a municipal corporation and political subdivision of the
State of Oregon, hereinafter referred to as Grantee, does hereby grant, bargain, sell and
convey to the Grantee, its successors and assigns, a perpetual easement and right -of -way for
the purpose of constructing, reconstructing, maintaining, repairing, and using the same for
Slope and Utility purposes, together with a temporary easement for construction purposes
over, across, in and through the real property located in the City of Tigard, County of
Washington, State of Oregon and described as follows:
See attached exhibit "A" incorporated by reference and made part of this
document.
To have and hold the above granted and described premises unto the Grantee, its
successors and assigns forever, for the uses and purposes above provided.
The Grantee shall have the right at any time hereafter to enter upon the above
described real property for the purposes hereinabove mentioned. In connection therewith
Grantee may remove any trees, shrubs, brush, paving or other materials necessary or
convenient to accomplish said purposes. Grantee shall repair any damages to the property
caused by Grantee's use for the purposes above described.
Grantee agrees to hold Grantor harmless for all injury to person or property caused
by Grantee's use of property for the purposes above described.
The Grantor, their heirs, successors, assigns or representatives shall not construct or
maintain any building or other structures upon the above described real property prior to
lwritten approval by the City as to conformance with City specifications regarding
construction.
This instrument does not grant nor convey to the Grantee any right or title to the
surface of the soil along the route of said slope and easement area except for the purpose
of constructing, operating, inspecting, maintaining and replacing the utility lines.
IN WITNESS WHEREOF, the Grantor above named, have hereunto set their hands
