(PERMANENT SLOPE AND PUBLIC UTILITY)
Tigard- Tualatin School District 23J, hereinafter called the Grantor, grants and conveys unto the City of
Tigard a perpetual easement for constructing, reconstructing, operating, maintaining, inspecting, and
repairing of public utilities and appurtenances, together with the right to remove, as necessary, vegetation,
foliage, trees, and other obstructions as well as a perpetual easement and right -of -way for the purpose of
constructing, reconstructing, maintaining, repairing, and using the same for a slope to support or help to
support the street or sidewalk construction on the adjacent real property on the parcel of land described in
Exhibit "A ", situated in the City of Tigard, Washington County, State of Oregon.
THE TRUE CONSIDERATION for this conveyance is $2,305.00. However, the actual consideration
consists of or includes other property or value given or promised which is the whole consideration.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title, or interest except
those expressly stated in this easement, nor otherwise prevent Grantors from the full use and dominion
thereover; provided, however, that such use shall not interfere with the uses and purposes of the intent of the
easement.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its successors or assigns should
cause said easement to be vacated, the right of the Grantee in the above - described easement will be forfeited
and shall immediately revert to the Grantors, its successors, and assigns in the case of such event.
TO HAVE AND TO HOLD the above - described and granted premises unto said Grantee, its successors,
and assigns forever.

A tract of land situated in the Northeast One - Quarter of Section 4 Township 2 South,
Range 1 West Willamette Meridian, City of Tigard, Washington County, Oregon
described as follows:
Beginning at the iron pipe at the intersection of county roads 494 (SW. Walnut Street)
and 495 (SW. Tiedeman Ave); thence S 89° 01' 15" W, along the center line of County
Road 494 a distance of 345.27 feet; thence N 00° 58' 45" W, leaving said center line, a
distance of 30.00 feet to the north right of way of said county road and the north line of
Dedication Deed recorded in Book 1022 Page 401 of the Washington County Deed
Records said point being 30.00 feet north of the center line being the north right of way of
SW. Walnut Street when measured at right angles and the True Point of Beginning;
thence N 89° 01' 15" E, along said north right of way, a distance of 286.95 feet to a point
of curve of a curve to the left; thence N 00° 58' 45" W a distance of 1.30 feet to a point
