Hudson Tigard Tualatin School District No. 23J OREGON 13137 SW Pacific Highway Tigard, OR 97223 Dear Mr. Hudson: This letter is in response to your request for Minor Modification approval to expand the Metzger Elementary School Facility on SW 92' Avenue. You have requested approval to place one (1) additional modular classroom building on the site. This property is designated for Low- Density Residential use and is located within the R-4.5 zoning district. The R-4.5 zone lists "Schools" as a Conditional Use. The Tigard Community Development Code Chapter 18.330, Conditional Use, provides that a modification to an approved conditional use may be a major or a minor modification. Major modifications are processed as a new conditional use application. Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. A change in land use. The use is currently an elementary school and no change in use is proposed as part of the modification. Therefore, this criterion does not trigger Major . Modification review. 2. A 10% increase in dwelling unit density. No dwelling units are existing or proposed. Therefore, this criterion does not trigger Major Modification review. 3. A change in the type and /or location of access ways and parking areas where off- site traffic would be affected. According to the applicant and as indicated on the site plan, the proposed modification will not require any change to parking areas or access ways. Therefore, this criterion does not trigger Major Modification review. 4. An increase in the floor area proposed for a non - residential use by more than 10% where previously specified. The proposed modification would involve placement of one (1) additional modular classroom building of approximately 1,680 square feet. The applicant has stated that the existing building square footage is approximately 52,874 square feet and that the proposed expansion would, therefore, be less than 10 %. Based on this analysis, this criterion does not trigger Major Modification review. 5. A reduction of more than 10% of the area reserved for common open space and/or usable open space. According to the applicant, there is no common open space located on the site. According to the site plan, however, there are significant areas of useable open space on the site. Since the site plan is to scale it is clear that the proposed modular building will not reduce the useable open space by 10% or more. A reduction of specified setback requirements by more than 20 %. The site plan indicates that the proposed new structure will be constructed in the vicinity of the front lot line. The R -4.5 zoning district requires a front yard setback of 20 feet. The proposed modular building would fall entirely outside the required front yard and thus, no reduction of any required setbacks will be required. Therefore, this criterion does not trigger Major Modification review. 7. An elimination of project amenities by more than 10% where previously specified, such as: 1. Recreational facilities; 2. Screening; or, 3. Landscaping provisions. The proposed modification will require removal of grass from the footprint areas. The lawn area could be regarded as a "recreational facility" although the reduction in the lawn area necessary for placement of the modular building is far less than 10 %. Therefore, this criterion does not trigger Major Modification review. 10. A 10% increase in the approved density. This proposal is for the expansion of an elementary school facility and does not include residential development. Therefore, this criterion does not trigger Major Modification review. This request is determined to be a minor modification to an approved conditional use. Pursuant to Section 18.330.020.3.C., the Director's designee has determined, based on the above findings, that the proposed modification is not a major modification and that it is in compliance with the applicable requirements of the Tigard Community Development Code. The proposed minor modification is, therefore, approved. THIS REQUEST HAS BEEN APPROVED SUBJECT TO THE FOLLOWING CONDITION: 1. A building permit must be obtained for the proposed expansion. Please provide a copy of this letter when applying for permits. There is a fee for the required permits. Please contact the Development Services Division for information on current fees.
