Dear Mr. Hudson:
This letter is in response to your request for Minor Modification approval (MMD1999- 00016) to
expand the Metzger Elementary School Facility located at 10255 SW 90 Avenue. You have
requested approval to place one (1) additional modular classroom building on the site.
This property is designated for Low - Density Residential use and is located within the R -4.5
zoning district. The R -4.5 zone lists "Schools" as a Conditional Use. The Tigard Community
Development Code Chapter 18.330, Conditional Use, provides that a modification to an
approved conditional use may be a major or a minor modification. Major modifications are
processed as a new conditional use application.
Section 18.330.020.B.2 states that the Director shall determine that a major modification(s) has
resulted if one (1) or more of the changes listed below have been proposed:
1. An increase in dwelling unit density. No additional dwelling units are proposed.
Therefore, this criterion does not trigger Major Modification review.
2, A change in ratio or number of different types of dwelling units. According to the
applicant and as indicated on the site plan, the proposed modification will not involve
dwelling units. Therefore, this criterion does not trigger Major Modification review.
3. A change that requires additional on -site parking in accordance with Chapter
18.795. The proposed modification is to accommodate existing educational programs.
The applicant is not proposing any new on -site parking. Based on this analysis, this .
criterion does not trigger Major Modification review.
4. A change in the type of commercial or industrial structures as defined by the
Uniform Building Code. No change in the structural occupancy type of the building is
proposed. Therefore, this criterion does not apply.
5. An increase in the height of the building(s) by more than 20 %. No increase in the
height of the existing buildings is proposed. Therefore, this standard does not apply.

6. A change in the type and location of accessways and parking areas where off -site
traffic would be affected; The proposal does not include revisions to existing driveway
locations or parking areas. Therefore, off -site traffic would not be affected.
7. An increase in vehicular traffic to and from the site and the increase can be
expected to exceed 100 vehicles per day; This proposal is to add space to serve
existing students, that will not increase vehicular traffic. Therefore, this criterion does not
trigger Major Modification review.
8. An increase in the floor area proposed for a nonresidential use by more than 10%
excluding expansions under 5,000 square feet; The applicant is proposing a 1,680
square foot expansion. The existing buildings equal 52,874 square feet. Therefore, the
proposed building is under the ten - percent (10 %) by 3,607 square feet.
This request is determined to be a minor modification to an approved conditional use. Pursuant
to Section 18.330.020.3.C., the Director's designee has determined, based on the above
findings, that the proposed modification is not a major modification and that it is in compliance
with the applicable requirements of the Tigard Community Development Code. The proposed
minor modification is, therefore, approved.
THIS REQUEST HAS BEEN APPROVED SUBJECT TO THE FOLLOWING CONDITION:
1. A building permit must be obtained for the proposed expansion.
Please provide a copy of this letter when applying for permits. There is a fee for the required
permits. Please contact the Development Services Division for information on current fees.

TRAFFIC IMPACT FEE FOR METZGER ELEMENTARY MODULAR CLASSROOM
Enclosed with this letter you will find a calculation sheet showing the computation that has
been performed to determine the amount of the Traffic Impact Fee (TIF) to be paid for the
project noted above. The amount of the TIF is $3,078.00.
You have two payment options available to you. The first is to pay the TIF at the time you
are issued a building permit. The. second is to arrange for payment over time by signing a
promissory note (if you wish to exercise this second option please contact me for additional
details). Traffic impact fees are subject to an annual increase of up to 6% if not paid or
financed prior to July 1st of each year.
Please note that you may appeal the discretionary decisions made in determining the
appropriate category and the amount of the fee based on that category. A notice of appeal
must be received by the City Recorder no later than 5:00 p.m. on November 9, 1999 and
must be accompanied by the $638.00 appeal fee required by Washington County. Although
filed with the City Recorder, an appeal would be heard by the Washington County Hearings
Officer.

The Ordinance allows for deferral of payment of the TIF until issuance of the
occupancy permit if the TIF is greater than $5,000. If the TIF meets this
requirement, I also request this option. I understand the TIF must be paid prior to

recalculated based on the prevailing rates at the time of payment. Please be
advised that TIF rates may increase up to six percent each July 1st. This rate

This •decision may be appealed and a public hearing held by filling a signed petition for review (appeal)
within fourteen (14) calendar days of the date written notice is provided (date mailed).

A motion for reconsideration also may be filled within seven calendar days of the date written notice of
the decision is provided (see Section 208 of the Washington County Community Development Code). A
motion for reconsideration does not stop the appeal period(s) from running and is available only as an
extraordinary remedy for when a mistake of law or fact has occurred. A motion for reconsideration
requires a filling fee of $638.00.
This decision will be final if an appeal is not filed by the due dates(s), and a motion for reconsideration is
not granted by the Director.

A petition for review (appeal) must contain the following:
1." The name of the applicant and the relevant casefile /building permit/other development
permit number; •

individual shall be designated as the group's representative for all contacts with the
Department. All Department communications regarding the petition, including
correspondence, shall be with this representative;
3. A statement of the interest of the petitioner;
4. The date the notice of decision was sent as specified in the notice;
5. The petition for review (appeal) shall state the relevant facts', applicable ordinance
provisions, and relief sought; and
6. The fee of $638.00 for Director's decisions being appealed to the Washington County
Hearings Officer.
